HomeMy WebLinkAboutResolution No. 1970-40 RESOLUTION NO. 70- 40 r'°. 0- MICROFILMED -- Mk-. 440-80 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO INITIATE FORECLOSURE PROCEEDINGS AGAINST THOSE WHO HAVE NOT PAID THEIR PAVING ASSESS- MENT LIENS, AS REQUIRED PURSUANT TO RESOLUTION NO. 68-1 AND CHAPTER 174, FLORIDA STATUTES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of Cape Canaveral, Florida, has adopted Resolution No. 68-1 regarding a special assessment for paving and street improvements to those property owners specially benefiting therefrom, and WHEREAS, this special assessment has become a lien on the ,4,01 properties so benefited, and WHEREAS, certain of the property owners have failed to pay the assessments when due, and WHEREAS, the Chapter 174, Florida Statutes, adopted by Resolution No. 68-1, makes it mandatory for the City to foreclose the paving assessment liens when unpaid; NOW THEREFORE, be it resolved by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The City Attorney is hereby instructed to initiate foreclosure proceedings of the paving assessment liens against those property owners in the City of Cape Canaveral, Florida, who have failed to pay the assessments when due and who are now delinquent, as determined by the City Clerk. The City Attorney is instructed to begin these proceedings in accordance with Chapter 174, Florida Statutes, on January 4, 1971, against those property owners declared delinquent by the City Clerk. SECTION 2. This Resolution shall become effective immediately upon its adoption by the City Council of the City of Cape Canaveral, Florida.
