RESOLUTION NO. 71-40
A RESOLUTION APPROVING AGREEMENT FOR TAX
ASSESSMENTS BETWEEN THE CITY OF CAPE CANAVERAL,
FLORIDA, AND THE BREVARD COUNTY TAX ASSESSOR,
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CAPE CANAVERAL, FLORIDA, AS FOLLOWS:
SECTION 1. That the City of Cape Canaveral, Florida, hereby
approves the Tax Assessment Agreement between the City of Cape
Canaveral, Florida, and Clark Maxwell, Brevard County Tax Assessor, a
copy of said agreement being attached hereto and made a part hereof.
SECTION 2. The City of Cape Canaveral, Florida, authorizes
the Mayor and the City Clerk to execute said agreement on behalf of the
City.
SECTION 3. This Resolution shall become effective immediately
upon its adoption by the City Council of the City of Cape Canaveral, Florida.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 2lstlay of December, 1971.

TAX ASSESSMENT AGREEMENT
THIS AGREEMENT made and entered into this the 21st day of
December , A.D. 1971 , by and between the CITY and /or TOWN of
Cape Canaveral _, a municipality, hereinafter referred to
as "CITY ", and CLARK MAXWELL, HREVARD COUNTY TAX ASSESSOR,
hereinafter referred to as "ASSESSOR."
WITNESSETH:
FOR AND IN CONSIDERATION of the mutual promises and covenants
the parties agree as follows
1. The ASSESSOR shall provide services for the CITY by
assessing all property within the corporate limits of the CITY for
the purposes of taxation by said CITY.
2. The ASSESSOR shall provide the CITY advance estimated
valuations for budgetary purposes for the CITY prior to July lst,1972
and on the 1st day of July of each succeeding year during the term
of this Agreement.
3. The ASSESSOR shall provide the CITY with a preliminary
Tax Roll showing current valuations during the month of Jyly each
year.
4. The ASSESSOR shall provide the CITY with a Tax Roll showing
taxes extended, as soon after November 1st each year, as possible.
5. The ASSESSOR will perform these services for the CITY at
no charge.
6. The CITY shall provide the ASSESSOR with all information he
requires for the purpose of fulfilling this Agreement.
7. Valuations placed by the ASSESSOR on properties in the CITY
will be in accordance with Florida Statutes and ratio levels set by
the Auditor General and Department of Revenue.
6. The CITY shall provide the ASSESSOR with the millage rate
for tax purposes no later than the 15th day of September of each year.
9. In the event the CITY does not provide the millage tax rate
for tax rates of the CITY by the above date, then the CITY shall be
subject to a fee of $500 which would reimburse the ASSESSOR for over-
time necessary to produce the tax rolls and tax bills. In the event
the ASSESSOR fails to comply with the provisions of this Agreement,
this penalty shall not be effective.

10. This Agreement shall be binding upon the inure to the
benefit of both parties and their successors in office; and shall
be in full force and effect from year to year until such time as
either party, after first giving no less than six (6) months
written notice of their intention, cancel the same.
11. All notice of whatsoever kind or nature shall be di-
rected to the parties at the following addresses, to -wit:
