HomeMy WebLinkAboutResolution No. 1972-07 3- F IVHiC OFIL ED 4-10-80 RESOLUTION 72-7 A RESOLUTION APPROVING LEASE BETWEEN THE CITY OF CAPE CANAVERAL, FLORIDA, and BREVARD COUNTY FOR THE USE AND BENEFIT OF BREVARD COUNTY RECREATION DISTRICT TWO, PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS: SECTION 1. That the City of Cape Canaveral, Florida, hereby approves the Lease between the City of Cape Canaveral, Florida, and Brevard County For The Use And Benefit Of Brevard County Recreation District Two, a copy of said Lease being attached hereto and made a part hereof. SECTION 2. The City of Cape Canaveral, Florida, authorizes the Mayor and the City Clerk to execute said Lease on behalf of the City. SECTION 3. This Resolution shall become effective immediately upon its adoption by the City Council of the City of Cape Canaveral, Florida. 'file Lessor leases to the Lessee the premises in the City of Cape Canaveral, Florida, described as follows: All of Block 33, Avon by the Sea Subdivision, Section 23, 'Township 24, lunge 37, Iirevard County, Florida. ten (10) ^ 2. The term of this Lease shall be- Fire -(5) years from the date hereof; provided, however, that the Lessee shall have the ten (10)* option to renew this Lease for eight (8) successive terms of- five -(5) years each upon giving written notice thereof by certified mail to Lessor at least thirty (30) days prior to the expiration of each 4e.inr *term. Upon the failure of the Lessee to so 1 give notice of the exercise of its option within the time aforesaid, this Lease shall expire. 3. 'file consideration for this Lease will be financial assistance in the amount of $15,500.00 to be supplied by Lessee for the construction of recreational facilities on the above described property, according to plans and specifications prepared by Lessor, and such other amounts as may subsequently be agreed upon by the parties during the term of this lease. 4. The Lessee shall not assign this Lease except with the Lessor's written consent. 5. Lessor agrees to maintain the facility upon its comple- tion. G. The rules and regulations governing the use of said facility shall be mutually agreeable to the Lessor and Lessee and shall be such as to coordinate the facility with the rest of the City of Cape Canaveral recreation plans .
