FLA. 0-,ki , L 1 ' 7a .. 1972 th�P"` PM4 21 RESOLUTION NO. 72-12 77501,4 .,e,: rT„ :514-,n A RESOLUTION TO ABANDON, CLOSE AND VACATE A DEDICATED ALLEYWAY IN BLOCK 60, AVON-BY- THE-SEA, WITH CERTAIN EXCEPTIONS; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Cape Canaveral, Florida, deems it in the best interest of the City to abandon, close and vacate a certain dedicated alleyway in Block 60, Avon-By-The-Sea Subdivision; and WHEREAS, a public hearing was held on April 4, 1972, after being duly advertised, recording the City's intention to vacate this alleyway; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS: SECTION L That a certain dedicated alleyway located in Block 60, Avon-By-The-Sea, as recorded in Plat Book 3, at page 7, Public Records of Brevard County, Florida, is hereby abandoned, closed and vacated by the City of Cape Canaveral, Florida, and said City renounces and dis- claims any right of the City and the public in and to such alleyway, except as provided in Section 2 hereof. SECTION 2. The vacation and abandonment of this alleyway is for the benefit of the record holder of title as of this date and is also contingent upon said owner commencing construction on the property hereinbefore described within six months from this date, and also upon said owner dedicating a utility easement of ten feet to be located approximately in the vicinity of said alleyway, to the City of Cape I Canaveral, Florida. SECTION 3.
