HomeMy WebLinkAboutResolution No. 1972-18 MICROFILMED 4-10-80 RESOLUTION NO. 72-18 A RESOLUTION TO ABANDON, CLOSE AND VACATE A DEDICATED ALLEYWAY IN BLOCK 64, AVON-BY-THE- SEA, WITH CERTAIN EXCEPTIONS; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Cape Canaveral, Florida, deems it in the best interest of the City to abandon, close and vacate a certain dedicated alleyway in Block 64, Avon-By-The-Sea Sub- r ' division; and L WHEREAS, a public hearing was held on May 16, 1972, after being duly advertise, recording the City's intention to vacate this alleyway; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS: SECTION 1. That a certain dedicated alleyway located in Block 64, Avon-By-The-Sea, as recorded in Plat Book 3, at page 7, Public Records of Brevard County, Florida, is hereby abandoned, closed and vacated by the City of Cape Canaveral, Florida, and said City renounces and disclaims any right of the City and the public in and to such alleyway, except as provided in Section 2 hereof. SECTION 2. The vacation and abandonment of this alleyway is for the benefit of the record holder of title as of this date and is also II contingent upon said owner commencing construction on the property herein- before described within six months from this date, and also upon said owner dedicating a utility easement of ten feet to be located approximately in the vicinity of said alleyway, to the City of Cape Canaveral, Florida. SECTION 3. This resolution shall become effective immediately upon its adoption by the City Council of the City of Cape Canaveral, Florida.
