DEDICATED ALLEYWAY IN BLOCKS 45 AND 50, AVON- BY-THE-SEA, WITH CERTAIN EXCEPTIONS; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Cape Canaveral, Florida, deems it in the best interest of the City to abandon, close and vacate a certain dedicated alleyway in Blocks 45 and 50, Avon-By-The-Sea Subdivision; and WHEREAS, a public hearing was held on June 20 , 1972, after being duly advertised, recording the City's intention to vacate this alleyway; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA AS FOLLOWS: SECTION 1. That a certain dedicated alleyway located in Blocks 45 and 50, Avon-By-The-Sea, as recorded in Plat Book 3, page 7, Public Records of Brevard County, Florida, is hereby abandoned, closed and vacated by the City of Cape Canaveral, Florida, and said City renounces and disclaims any right of the City and the public in and to such alleyway, except as provided by Section 2 hereof. SECTION 2. The vacation and abandonment of this alleyway is for the benefit of the record holder of title as of this date and is also contin- gent upon said owner commencing construction on the property hereinbefore described within six months from this date, and also upon said owner dedicating a utility easement of ten feet to .be located approximately in the vicinity of said alleyway, to the City of Cape Canaveral, Florida. SECTION 3. This resolution shall become effective immediately upon its adoption by the City Council of the City of Cape Canaveral, Florida.
