HomeMy WebLinkAboutResolution No. 1972-47 i it- MICROFILMED 4-10-80 RESOLUTION NO. 72- 47 A RESOLUTION EXTENDING THE TIME FOR COMMENCE- MENT OF CONSTRUCTION ON PROPERTY RELATIVE TO ABANDONMENT AND VACATION OF AN ALLEYWAY IN BLOCK 60, AVON-BY-THE-SEA. . WHEREAS, in Resolution 72-12 adopted by the City Council of the City of Cape Canaveral, Florida, on April 4, 1972, a certain dedicated alleyway pi;, in Block 60, Avon-By-The-Sea was abandoned, closed and vacated; and WHEREAS, said resolution provided that construction was to commence within six months from April 4, 1972; and WHEREAS, construction was not commenced by the record holder of title on the date designated for valid reasons, and the City Council deems it advisable and in the best interest of the City of Cape Canaveral to extend the time in which said owner may commence construction on the property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS: SECTION 1. That the record holder of title as of this date of Block 60, Avon-By-The-Sea, as recorded in Plat Book 3, at page 7 of the Public Records of Brevard County, Florida, is hereby given an extension of time in which to commence construction on said property of one month: from this date. In the event that construction is not commenced within that time, the abandon- ment, closing and vacation of the dedicated alleyway, pursuant to Resolution 72-12 shall be rescinded. SECTION 2. This resolution shall become effective immediately upon its adoption by the City Council of the City of Cape Canaveral, Florida. ADOPTED by the City Council of the City of Cape Canaveral, Florida, this 7th day of November, 1972.
