A RESOLUTION SPECIFYING THOSE LOCATIONS AS WHICH
THE DUNE AREA CAN BE CROSSED AS ESTABLISHED IN
THE CITY OF CAPE CANAVERAL DUNE PROTECTION ORDIN-
ANCE; EXCEPTIONS ALLOWED; CHARACTERISTICS OF PATHS;
SIGNS TO BE PROVIDED; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 14 -72, the City of Cape Canavex
Dune Protection Ordinance, makes it unlawful for a pedestrian
to cross the dune area except at those locations specifically
designated by the City of Cape Canaveral, and
WHEREAS, it is in the interest of the health, safety,
and welfare of the citizens of Cape Canaveral to repair and
protect the natural barriers which shield inland areas from the
ravages of storms, and
WHEREAS, the most permanent and effective means of
effecting this purpose is to preserve the natural vegetative
cover which binds the sand forming the natural barriers or dunes,
and
WHEREAS, the most critical vegetation, the dune grass,
is most vulnerable to trampling, behooving careful control. of
traffic on the dune area,
NOW, THEREFOR, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS:
SECTION 1. CROSSING LOCATIONS. Pursuant to Section 8,
City of Cape Canaveral Ordinance No. 14 -72, the following
locations are specifically designated as crossing paths for
pedestrian traffic. See figure 1.
(a) The location of paths 1 thru 18 extend along the
centerline of the streets from which they project.
(b) The location of line 19 extends along the east -
west centerline of
SECTION 2. EXCEPTIONS. Occasional traffic from
single family dwellings only, on lots fronting the Atlantic
coastline, is permissible across the dune area on said lot.
Other exceptions will be permitted only if a path is provided
in accordance with Section 3, paragraph (a), post.
SECTION 3. PATH CHARACTERISTICS. No path crossing
the dune area shall be more than six feet wide.
(a) Paths shall be elevated walkways with protective
rails and provide no more than seventy -five percent shade to the
vegetation below. They shall be constructed of lumber suitably
treated to endure coastal environment.
(b) All existing paths delineated in Section 1, supra,
shall be temporarily improved - using snow -fence and wooden
planking or stones as shown in figure 2. The snow -fence forms
a diagonal path across the dune area to lessen the inrush of
storm -tide waters and also collects wind -blown sand. The plank-
ing or stones keep the path from being cut lower in the sand.
SECTION 4. SIGNS TO DE PROVIDED. Such numbers of signs
as are necessary to inform the public of their responsibilities
under the Dune Protection Ordinance pedestrian traffic control
section shall be placed about the dune area. The sign content,
will be "Help us save our beaches s dunes - it is unlawful to
be on dune area except at paths provided." See figure 3.
SECTION 5. EFFECTIVE DATES PROVIDED. This resolution
shall take effect immediately upon its adoption except Section
3, Paragraph (b), and Section 4, supra, which . shall be imple-
mented with all deliberate speed.
