A RESOLLTMON RELATING TO ACCESS TO Ct\BLE
TELEVISION LMLITY RECORDS: PROVIDING A PENALTY
FOR VIOLKTION Of RULL: PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the purpose of telecommunications rule making
Is to obtain, consistent with the public Interest standard of the Communi-
cations Act of 1934, the full benefits of developing communications
technology for the public, with particular immediate reference to cable
television technology and potential services; and
WHEREAS, the City of Cape Canaveral has entered into a
franchise agreement granting particular privileges to further the above
purpose; and
WHERLAS, the City of Cape Ctnavernl has all obligation to
be informed regarding financial matters relating to the operation of a
public utillty;
NOW, TIIEREFORE, BI? fl' RESOLVED BY THL CITY
COUNCIL OF THE, CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS:
SECTION 1. ACCESS TO PUBLIC UTILITY RECORDS
REQUIRED. Pursuant to Section 1V and Section Vill, subsection (a).
Ordinance No, 36-64, known as the Cable Television Franchise, the City
of Cape Canaveral shall have access to the COnlplllly's books and records
at reasonable times and at reasonable places in any matter relating to the
operation of the cable television utility.
SECI'ION 2. DENIAL OF ACCESS SIIAU, CONSTITUTE
BRLACII. Violation of the access rule promulgated above shall constitute
a breach of the duty, responsibility and obligation of the Company under
Section \SII, Ordinance No. 36 -64.
SECI'ION 3. This Resolution shall become effective
inal»ediately upon adoption by the City Council of the Cite of Cape
Canaveral, Florida.
ADOPTED this day of December, 1972, by the City
Council of the City of Cape Canaveral, Florida.
