HomeMy WebLinkAboutResolution No. 1973-35RESOLUTION NO. 73 -35 A RESOLUTION ALTY[ IORIZINGTHE CITY OF CAPE CANAVERAL, FLORIDA, TO BILL AND COLLECT SANITARY SEWER PEES AND CHARGES: NOTIFICATION TO TIIE CITY OF COCOA, FLORIDA OF TERMINATION 017 AGREEMENT Wrl'll CITY OF COCOA FOR BILLING AND COLLECTION OF SANITARY SEWER SYSTEM CHARGES; AUrl IORIZING THE CITY ATTORNEY TO NEGOTIATE AN EARLY TERMINATION OF SAID AGREEMENT WITH CITY OF COCOA; AUI'IIORIZING TIIE CITY TREASURER TO ESTABLISH A SYSTEM OF COLLECTION OF SANITARY SEWER CHARGES; REPEALING ALL RESOLUTIONS IN CONFLICT THEREWITH; PROVIDING AN EFFECTIVE DATE. WIIEREAS, Resolution No. 6.5 -7 as amended regarding the acquisition and construction of a sanitary sewerage system for the City of Gape Canaveral, Florida, provides in Fart that the City shall be able to enforce or collect the rates, fees or other charges for the use of the sewer services and facilities if the City deems such action necessary or desirable; and WHEREAS, the City of Cape Canaveral has entered into an agreement with the City of Cocoa, Florida, on October 20, 1961, authoriz- ing the City of Cocoa to bill and collect sanitary sewer system charges for the City of Cape Canaveral; and WHEREAS, said agreement is to expire on October 20, 1973, and said agreement provides that If either party wishes to terminate said a grecment ninety (90) days notice thereof must be given In advance of the date of said termination; and WHEREAS, the City Council of the City of Cape Canaveral, Florida, dccros it desirable and necessary and in the best interest of the City that it Initiate a program for billing and collecting Its own sewer fees; NOW, THEREFORE, BE rl' RESOLVED 13Y THE CITY COUNCIL OF TIIE CITY OF CAPE CANAVERAI., FLORIDA, AS FOLLOWS: SECTION 1. The City of Cape Canaveral, Florida is hereby authorized to bill and collect all fees and charges which arise from the sanitary sewer system. SECTION 2. The City Clerk is hereby authorized to notify the City of Cocoa, Florida, that the City of Cape Canaveral shall terminate the agreement dated October 20, 1964, between the City of Cocoa and the RES 1J -JS PAGE / OF a. '9 7 c_; 9 1> 41 LF 11 n City of Cape Canaveral, pertaining to the billing and collection of sanitary sewer system charges by the City of Cocoa for the City of Cape Canaveral, pursuant to a clause therein requiring a ninety (90) day notice prior to the termination of said agreement. SECTION 3. The City Attorney is hereby authorized to negotiate with the City of Cocoa for an earlier mutual termination of said agreement between the City of Cocoa and the City of Cape Canaveral, to enable the City of Cape Canaveral to initiate its billing procedures for sanitary sewer system charges, without waiting for the 90 day notice period to expire. SECTION 4. The City Treasurer is hereby authorized and directed to establish a system for the billing of sanitary sewer charges and fees by the City of Cape Canaveral. Said billing is to commence upon an expiration of the agreement with the City of Cocoa as provided hereinabove. SECTION 5® All resolutions or ordinances in conflict herewith are hereby repealed. SECTION 6. This Resolution shall become effective immediately upon its adoption. ADOPTED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, THIS 7th DAY OF AUGUST, 1973.
