HomeMy WebLinkAboutResolution No. 1974-12RESOLUTION NO. 74-12 A RESOLUTION VACATING A PORTION OF A PLAT OF COLUMBIAD SUBDIVISION: PROVIDING AN EFFECTIVE DATE. Wi1EREAS. SOUTHERN GULF HOMES, INC., the owner in fee simple of the following described real property: I Lots 6 through 12, inclusive, and the West 135 feet of Lot 13, COLUMBIAD PLAZA SUBDIVISION, according to the plat thereof as recorded in Plat (look 18, at page 9 of the Public Records of Brevard County, Florida; and WHEREAS, the said SOUTHERN GULF HOMES, INC, has petitioned the City Council of the City of Cape Canaveral, Florida to vacate a portion of said COLUMBiAD PLAZA SUBDIVISION; and WHEREAS, the City has determined that the Petitioner does not Intend to use the streets or alleys in the vacated portion of said land as part of a development scheme and, further, said streets and alleys which may,bc located in said land have not become highways necessary for use by the travelling public; NOW, THEREFORE, BE iT RESOLVED 11Y THE CITY COUNCIL OF TI1E CiTY OF CAPE CANAVERAI., AS FOLLOWS: SECTION 1. The City of Cape Canaveral. Florida, hereby vacates a portion of the Plat of COLLIMBiAD PLAZA SUBDIVISION, said Plat being recorded in Plat Book 18, page 9, of the Public Records of Brevard County, Florida, and said portion to I)e vacated and all the lands lying therein, more particularly described as follows: That portion of COLUMBiAD PLAZA SUBDIVISION as recorded In Plat Rook 18, page 9, of the Public Records of Brevard County, Florida, lying westerly of a line 1, 065 feet west of and perpendicular to the easterly boundary of said Subdivision. SI :CTION 2. 'I'lie vacation of this plat is subject and conditioned upon Southern Gulf Ilomes, Inc, gr:nuting to the City an easement as more fully described on the attached Exhibit A1. •,.,� MiCROFI!�MED 4 .10. 50: - This Resolution shall become effective upon _: the delivery of said easement to the City.
