OF SEWER CHARGES UPON THE ISSUANCE OF A
CERTIFICATE OF OCCUPANCY; REPEALING ALL
ORDINANCES OR RESOLUTIONS IN CONFLICT IIEREWITII;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Cape Canaveral, Florida, adopted Resolution
No. 65 -7 setting forth a preliminary schedule of rates, fees and charges
for municipal sewer services; and
WHEREAS, the City Council has revised the said rates from time to
time, as set forth in Ordinance No. 6 -66 as amended; and
WI IEREAS, the City now deems it In the hest interest of all partles
concerned to establish when said sewer fees and charges should commence,
III that the previous resolutions and ordinances have not so established such
a method for commencement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION L All fees and charges, as set forth in the Schedule of
Rates found in Resolution No. 65 -7, as amended by Ordinance No. 6 -66 as
amended, shall commence to any customer or user of the City of Cape
Canaveral sewer system, us provldcd In said resolutions and ordinances,
immediately upon the issuance of a Certificate of Occupancy as otherwise
provided by the City of Cape Canaveral.
SE'C`TION 2. The City of Cape Canaveral specifically intends that
tills Ilesolution shall not be retroactive, but IS merely a declaration of the
City's latent effective with tills Resolution. The City Council acknowledges
that the previous method of commencement of sewer 61111119 upon tine
issuance of a final sewer permit was a valid exercise of the City's author -
Ity pursuant to the sewer resolutions and ordinances, but Inasmuch as
said resolutions and ordinances do not prescribe at which tine said billing
should commence, then such clutter Is at the discretion of the City Council.

SECTION 3. All ordinances or resolutions in conflict herewith
are hereby repealed.
SECTION 4. This resolution shall become effective immediately
upon its adoption, and all new users and customers of the City sewer
U services shall be billed in accordance with the provisions of this resolu-
tion.
Nothing contained herein shall specifically or by inference affect
in any manner the method for commencement of sewer services by the
City of Cape Canaveral, prior to the effective date of this resolution.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 27th day of may , 1975.
