MEETING MINUTES
JULY 19, 2012
6:00 PM
A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida was
held on July 19, 2012, in the Cape Canaveral Public Library Meeting Room at 201 Polk Avenue,
Cape Canaveral, Florida.
Chairperson Mary Russell called the meeting to order at 6:00 PM. The Board Secretary called
the roll.

The Board members established that the next meeting would be held on August 23, 2012.
Assistant City Attorney Barrett swore in all persons giving testimony.
NEW BUSINESS:
Approval of Meeting Minutes: June 21, 2012.
Motion by Mr. Godfrey, seconded by Mr. Hale, to approve the meeting minutes of June 21,
2012, as written. Vote on the motion carried unanimously.

Case No. 11-00077 - Violation of Section 34-97(b)(3), Duties and Responsibilities for
Maintenance, of the City of Cape Canaveral Code of Ordinances, (6103 N. Atlantic Ave.)
— JWL LLC c/o Retail Site LLC, Keith A. Bennett, R.A.
Code Enforcement Officer, Ou[ee Alexander, provided an overview of the Case history and
presented exhibits for the Board's review. Officer Alexander testified that the viO/8bOn is for the
0aiOt8D3DCe of the parking lot.
Officer Alexander stated that the Respondent sent 8Oe-mail that explained that hewould beout
of the State and vVOu|d not be able to attend the nne8UDg. In his e-mail, M[ Bennett stated that
he would need additional time 1Obring the property into compliance.
Officer Alexander respectfully requested that the Board find the Respondent in DOn-00[np|i8Dce
of the Board Order and give the Respondent until January 17,2O13tOcome into compliance 0r
impose a fine in the amount Ofone hundred dO||8nS /$1OO.O0\for the first day and seventy-five
dO||8[S ($75.00) per day thereafter retroactively beginning on May 17. 2012 until found in
compliance.

PUBLIC HEARINGS:
Case No. 12-00020 - Violation of Section 105.1, Permit Required: Section 110.1,
General Inspections, of the Florida Building Code, as adopted by Section 82-31, of the
City of Cape Canaveral Code of Ordinances, (226 Canaveral Beach Blvd.) — Richard
Price Sr., PropertV Owner.
COU8 Enforcement Officer, [)urH8 Alexander, provided an overview Ofthe C8S8 history and
presented exhibits for the Board's review. Officer /U8X8Dder testified that the violation is for
vVO[k without a permit and an approved final inspection. Officer Alexander explained that,
fO||OvviDQ G complaint, an investigation revealed there was work being done without @ permit.
The property was posted with 3Stop Work Order.
Richard Price, property owner, testified that he was not 3vv@[a that 8 permit was required for the
tvo8 Of work he was doing and further Siah3d that he hired 8 COOtraCf0F for the plumbing vv0rh
and assumed he was within the |@vv. Mr. Price stated that he has applied for the permit and it is
currently under review.
Chairperson Russell asked Mr. PhC8 if 30 days vvOu|d be enough time to CO0e into 0OrOp|iaDCe.
Mr. Price Gt@(8d that one O0ODth should be enough time.

Officer Alexander respectfully requested that the Board find the Respondent in violation of
Section 105.1, Permit Required; Section 110.1, General Inspections, of the Florida Building
Code, as adopted by Section 82-31, of the City of Cape Canaveral Code of Ordinances, and
impose a fine in the amount of two hundred and fifty dollars ($250.00) per day until found in
compliance.
Motion by Mr. Godfrey, seconded by Mr. Hale, to find the respondent in violation and be given
until August 23, 2012 to obtain a permit. Vote on the motion carried unanimously.
2. Case No. 12-00029 - Violation of Section 14-55(a)(1-4), New Development; Section 14-
560)(2), Existing Development, of the City of Cape Canaveral Code of Ordinances, (514
Jackson Ave.) — Gary J. Patrick, Property Owner.
Code Enforcement Officer, Duree Alexander, testified that the Respondent did not take receipt
of the notice and therefore must withdraw the Case from the agenda.

There being no further business the meeting adjourned at 6:35 P.M.
