The suspect, 25 you Dustin D. Ferland, a city of Cape Canaveral resident was subsequently arrested by GCU Agents and provided a full confession. Supervisor's Remarks (If more space required,attach additional sheet) On Wednesday 11/04/09, at 0230 hours, an unidentified white male committed an attempted armed robbery of the Circle K convenience store located, 7700 N. Atlantic Ave. On the same date at 1245 hours, Sgt. Simpkins asked GCU Agent Jennings for a photo of the suspect from the store surveillance video. Sgt. Simpkins took the photo to the Poinsettia Lodge, located on the corner of Poinsettia and Jackson Ave., where he showed several residents the photograph. One resident advised Sgt. Simpkins the suspect is a local resident and had seen him in the 400 block of Tyler Ave. The resident instructed Sgt. Simpkins to check with the clerk at Shivm Foods, located at the corner of N. Atlantic and Jefferson Ave. Sgt. Simpkins made contact with the clerk at the store who also advised the suspect was a local resident. Sgt. Simpkins met with Cpl. Haggerty and showed him the photograph as well. Cpl. Haggerty and Sgt. Simpkins responded to 405 Tyler Ave. in an attempt to locate the suspect. Having no success finding the suspect, Cpl. Haggerty and Sgt. Simpkins started to leave when Cpl. Haggerty recognized another local resident, Edward Paschal. Based on Cpl. Haggerty'prior relationship with Mr. Paschal, he readily identified the suspect and directed him to his address at 406 Tyler Ave. Sgt. Simpkins and Cpl. Haggerty located the suspect, Dustin Ferland, at the residence. Should the Council desire to use this language, please remove the item from the consent agenda and motion to approve the resolution using the revised language. attachment RESOLUTION NO 0509 A RESOLUTION OF THE SPACE COAST LEAGUE OF CITIES, INC., A FLORIDA NOT-FOR-PROFIT COPRORATION, RELATING TO THE LIFTING OF THE MORATORIUM ON OFFSHORE PETROLEUM DRILLING; MAKING FINDINGS; OPPOSING THE LIFTING OF THE MORATORIUM ON OFFSHORE PETROLEUM DRILLING AND SUPPORTING THE SEARCH OF ALTERNATIVE ENGERGY SOURCES, PROTECTING FLORIDA'S TOURISM INDUSTRY, AND PRESERVING FLORIDA'S BEACHES; PROVIDING FOR DISTRIBUTION OF THIS RESOLUTION; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR ADOPTION. WHEREAS, a Congressional ban against offshore drilling has been in effect since 1981, the purpose of which was to reduce the chance of environmental damage from oil spills that would significantly harm Florida's tourism industry; and WHEREAS, according to a 2003 Congressional report, increasing offshore production would not displace enough in petroleum imports to reduce U.S. reliance on foreign oil; and WHEREAS, a 2007 report by the U.S. Department of Energy shows that opening the Florida coast to drilling would not have a significant impact on domestic crude oil prices before the year 2030, if ever; that it is not economically feasible to drill for oil in certain offshore areas; and that even if all available areas were opened, at the peak of production, it would have little, if any, effect on price; and WHEREAS, the previous findings were corroborated in a June 2008 repor: by the Center for Economic and Policy Research, showing that had Congress continued to increase fuel efficiency standards over the past 22 years, we would now have 16 :imes the savings in oil consumption than we could achieve by drilling for the next 20 years in now-protected areas; and WHEREAS, nearly 80 percent of estimated U.S. oil reserves are already currently available to exploration and more than 68 million acres are available to drill, S0/Z0 39tod SSC19N E6t£9£9tZ£ 6t:60 600Z/60/Zt and the U.S. is the third largest oil producer at over seven million barrels of oil per'day; and WHEREAS, in spite of the Florida Chamber of Commerce's and others' position that oil demand will grow, a study by Lawrence Livermore National Laboratory found that America used less coal and petroleum energy in 2008; and WHEREAS, in spite of the Florida Chamber of Commerce's and other's position that new technology has made offshore drilling safe and environmentally friendly with no major spills in over 30 years and they are proposing drilling three to six miles offshore, oil companies with this new technology still legally pollute by dumping drilling waste mud, cuttings, drainage and other matter every day that contain toxic waste, including heavy metals such as lead, mercury and cadmium, and carcinogens such as benzene, toluene and arsenic; and WHEREAS, not only do these wells pollute as part of normal production, but they are also susceptible to accidents, incidents, and weather; and WHEREAS, in 2005, Hurricane Katrina destroyed over 113 platforms and Hurricane Rita another 11 platforms, resulting in the destruction of 124 platforms and 741,000 gallons of oil spilled; and WHEREAS, since 2005, hurricanes have destroyed or damaged 378 rigs/platforms, more than 1 million gallons of petroleum have been spilled and many are still leaking today; and WHEREAS, in 2007, a cargo vessel, Cosco Busan, hit the Bay Bridge spilling 58,000 of bunker fuel into San Francisco Bay, and as recently as July 2009, a Shell Oil Company underground pipeline just 30 miles offshore leaked over 58,000 gallons of crude oil into the Gulf of Mexico covering over 80 square miles, and the leak continued without knowledge of the source for over two days; and S0/E0 3940d S9019N E6IE9E9tZE 61:60 600Z/60/Z1 WHEREAS, environmental impacts from oil can last for over 10 years, as witnessed in Alaska after the Exxon Valdez incident, and the latest government documents show as production goes up, so do spills; and WHEREAS, Dr. Sisskin of Gulf Coast Environmental Defense predicts at least one spill per year; and WHEREAS, according to a 2005 study by Florida Atlantic University and the Florida Department of Environmental Protection, beach tourism alone contributed $37.2 billion in state revenue in 2004 and tourism in general accounts for one-third of Fonda's, i budget revenues annually; and WHEREAS, many people visit, live and work in Florida for its fishing, swimming, surfing, diving, boating, and pristine beaches and clean and natural environment, and Florida is dependent on an overall $65 billion per year generated by the tourism industry; and WHEREAS, in July, 2009, a bipartisan letter from both Florida senators and 22 of 25 Florida house members was sent to Congress urging it not to expand offshore drilling, and many forward-thinking state senators and representatives also oppose Florida offshore drilling; and WHEREAS, Florida's leaders and all Americans should be pursing an energy policy that promotes responsibility and renewability based on sound science, honesty and facts; and WHEREAS, continuing to drill for oil off shore inhibits implementation of an energy policy based on responsibility and renewability, NOW THEREFORE, BE IT RESOLVED BY THE SPACE COAST LEAGUE OF CITIES, INC., that SECTION 1. That the Space Coast League of Cities, Inc., a Florida Not-for-Profit Corporation, is opposed to any attempt to lift the moratorium on offshore drilling off the S0/b0 39Vd SSV19N £6t£9£9TZ£ 6i:60 600Z/60/Z1 coast of Florida. Rather than to pursue this destructive, divisive, outdated, and economically short-sighted and unsustainable policy, the Space Coast League of Cities, Inc., supports a concept of leading our state and nation to cleaner alternative energy, preserving Florida's beaches, and protecting Florida's tourism industry. SECTION 2. The Space Coast League of Cities, Inc., Executive Secretary is directed to forward copies of this resolution to: each Brevard County municipality; the Brevard County Board of County Commissioners; Members of the Brevard County Legislative Delegation; the President of the Florida Senate; the Speaker of the Florida House of Representatives; the Governor of the State of Florida; both of Florida's U.S. Senators; all members of Florida Congressional Delegation in the U.S. House of Representatives; the Florida Today newspaper; and the Orlando Sentinel newspaper. The IPMC is a maintenance document intended to establish minimum maintenance standards for basic equipment,light,ventila- tion,heating,sanitation and fire safety. Responsibility is fixed among owners,operators and occupants for code compliance. The i IPMC provides for the regulation and safe use of existing structures in the interest of the social and economic welfare of the commu- nity. Arrangement and Format of the 2009 IPMC Before applying the requirements of the IPMC it is beneficial to understand its arrangement and format.The IPMC,like other codes published by ICC, is arranged and organized to follow sequential steps that generally occur during an inspection.The IPMC is divided into eight different parts: Chapters Subjects 1 Administration I 2 Definitions 3 General Requirements I4 Light,Ventilation and Occupancy.Limitations 5 Plumbing Facilities and Fixture Requirements 1 6 Mechanical and Electrical Requirements i 7 Fire Safety Requirements 8 Referenced Standards The following is a chapter-by-chapter synopsis of the scope and intent of the provisions of the International Property Maintenance Code: Chapter 1 Administration. This chapter contains provisions for the application,enforcement and administration of subsequent requirements of the code.In addition to establishing the scope of the code,Chapter 1 identifies which buildings and structures come under its purview. Chapter 1 is largely concerned with maintaining"due process of law"in enforcing the property maintenance cri- teria contained in the body of the code.Only through careful observation of the administrative provisions can the building official reasonably expect to demonstrate that"equal protection under the law"has been provided. Chapter 2 Definitions. All terms that are defined in the code are listed alphabetically in Chapter 2. While a defined term may be used in one chapter or another,the meaning provided in Chapter 2 is applicable throughout the code. Where understanding of a term's definition is especially key to or necessary for understanding of a particular code provision,the term is show in italics wherever it appears in the code. This is true only for those terms that have a meaning that is unique to the code. In other words,the generally understood meaning of a term or phrase might not be sufficient or consistent with the meaning pre- scribed by the code;therefore,it is essential that the code-defined meaning be known. Guidance regarding tense,gender and plurality of defined terms as well as guidance regarding terms not defined in this code is provided. Chapter 3 General Requirements. Chapter 3,"General Requirements,"is broad in scope.It includes a variety of requirements for the exterior property areas as well as the interior and exterior elements of the structure.This chapter provides requirements that are intended to maintain a minimum level of safety and sanitation for both the general public and the occupants of a structure,and to maintain a building's structural and weather-resistance performance. Chapter 3 provides specific criteria for regulating the installa- tion and maintenance of specific building components;maintenance requirements for vacant structures and land;requirements reg- ulating the safety, sanitation and appearance of the interior and exterior of structures and all exterior property areas;accessory structures;vehicle storage regulations and establishes who is responsible for complying with the chapter's provisions.This chapter also contains the requirements for swimming pools,spas and hot tubs and the requirements for protective barriers and gates in these 2009 INTERNATIONAL PROPERTY MAINTENANCE CODE® v I I I 3 J 5 barriers. Chapter 3 establishes the responsible parties for exterminating insects and rodents,and maintaining sanitary conditions in 1 all types of occupancies. i Chapter 4 Light,Ventilation and Occupancy Limitations. The purpose of Chapter 4 is to set forth these requirements in the code and to establish the minimum environment for occupiable and habitable buildings,by establishing the minimum criteria for light 1 and ventilation and identifies occupancy limitations including minimum room width and area,minimum ceiling height and restric- tions to prevent overcrowding.This chapter also provides for alternative arrangements of windows and other devices to comply with the requirements for light and ventilation and prohibits certain room arrangements and occupancy uses. Chapter 5 Plumbing Facilities and Fixture Requirements. Chapter 5 establishes the minimum criteria for the installation,main- '3 tenance and location of plumbing systems and facilities,including the water supply system,water heating appliances,sewage dis- I posal system and related plumbing fixtures. Sanitary and clean conditions in occupied buildings are dependent upon certain basic plumbing principles,including providing potable water to a building,providing the basic fixtures to effectively utilize that water and properly removing waste from the build- 3 ing. Chapter 5 establishes the minimum criteria to verify that these principles are maintained throughout the life of a building. 7, Chapter 6 Mechanical and Electrical Requirements. The purpose of Chapter 6 is to establish minimum performance require- , 1 I ments for heating,electrical and mechanical facilities and to establish minimum standards for the safety of these facilities. i This chapter establishes minimum criteria for the installation and maintenance of the following: heating and air-conditioning 1 I equipment, appliances and their supporting systems;water-heating equipment,appliances and systems;cooking equipment and j appliances; ventilation and exhaust equipment; gas and liquid fuel distribution piping and components; fireplaces and solid fuel-burning appliances;chimneys and vents;electrical services;lighting fixtures;electrical receptacle outlets;electrical distribu- tion system equipment,devices and wiring;and elevators,escalators and dumbwaiters. Chapter 7 Fire Safety Requirements. The purpose of Chapter 7 is to address those fire hazards that arise as the result of a build- s ing's occupancy.It also provides minimum requirements for fire safety issues that are most likely to arise in older buildings. This chapter contains requirements for means of egress in existing buildings,including path of travel,required egress width, I means of egress doors and emergency escape openings. Chapter 7 establishes the minimum requirements for fire safety facilities and fire protection systems,as these are essential fire safety systems. Chapter 8 Referenced Standards. The code contains numerous references to standards that are used to regulate materials and methods of construction. Chapter 8 contains a comprehensive list of all standards that are referenced in the code.The standards are part of the code to the extent of the reference to the standard. Compliance with the referenced standard is necessary for compliance with this code. By providing specifically adopted standards,the construction and installation requirements necessary for compli- ance with the code can be readily determined.The basis for code compliance is,therefore,established and available on an equal basis to the code official,contractor,designer and owner. Chapter 8 is organized in a manner that makes it easy to locate specific standards. It lists all of the referenced standards,alphabeti- cally,by acronym of the promulgating agency of the standard. Each agency's standards are then listed in either alphabetical or numeric order based upon the standard identification.
