TV Monitoring/Cleaning of Stormwater System
The City is preparing to initiate a TV Monitoring/Cleaning Program for the entire
stormwater system. Depending on the conditions observed in the stormwater pipes, this
process could take as long as three years. For FY2009-2010, $100,000 has been budgeted
- $100,000 will also be budgeted for FY2010-2011 and FY2011-2012 (if needed). It is
understood that due to the annual cost of this task it is required by the City's purchasing
policy to be put out for formal bid.
City staff conducted a preliminary request for quotes and received four responses. One

company, Vac and Jet Services, LLC (VAJ), was significantly lower for an anticipated
scenario than the other three firms (also see attached table):

• Vac and Jet Services, LLC (VAJ) $80,520.00
• Equitas Sewer Services, LLC $93,984.00
• Shenandoah Construction $123,024.00
• ALT, Inc. $125,664.00
The City has previously contracted with all four of the firms for various stormwater-
related work—all contractors performed well. It is our request, due to the significantly
lower bid by VAJ, that Council waive the requirement to put this project out to formal

bid. Our reasons are as follows:

• The bid process will add significant cost and time to the project with no it
discernable value added due to the low bid by VAJ. i
• VAJ is a quality firm (based on past experience with the City) and also inspected

numerous portions of the City's stormwater system prior to submitting their bid

Ceremony proceedings set for Thursday, September 11, 2009. Mayor Randels
reminded that this is Item No. 4 on the Consent Agenda and asked Council and the
City Manager if they had questions or concerns. Mr. Petsos and Mr. Boucher both
affirmed there should be no problems with the request.
• Mr. Burt also inquired about who is responsible for the P.O.W. and State flags at
Cape View Elementary. Mayor Randels offered to follow up on the inquiry. Ms.
Roberts suggested emphasizing the significance of the flags during the upcoming
City Government Week in October. Mayor Randels requested that the Acting
Deputy City Clerk take note of the idea as a possible theme.
• Mr. Mike Anderson, 8000 Ridgewood Avenue, expressed concern on behalf of a
vendor/resident selling ice cream and water on the beach. He explained that
complaints about the vending were coming into the City's Code Enforcement Office,
tio the Sheriff's Department and the Mayor. Mr. Anderson contended the vendor is not

answer questions.

LOCAL FOCUS PILOT PROGRAM
I. OVERALL: To establish a Local Focus Program for cities and unincorporated areas of
Brevard County in the Cocoa Beach Area Chamber of Commerce service area specifically
focused on the growth and prosperity of the business community in the cities and
unincorporated areas of Brevard County.The Local Focus will serve as a conduit for business
concerns between the community and the Cities/County and interact directly with the
Cities"Business and Cultural Development Boards"
II. The adoption of the Local Focus of the Cocoa Beach Area Chamber of Commerce will be a pilot
program for a 12 month period with evaluation of the project at the end of the 12 months
or sooner at the discretion of the President.The City of Cape Canaveral will be the first
municipality to pilot this program with the chamber. The program will be open only to
Cape Canaveral businesses with business occupational licenses issued by the City of Cape
Canaveral. Members of the Cocoa Beach Area Chamber of Commerce may participate in the
Local Focus Campaign at no additional charge. No other Cocoa Beach Area Chamber of
Commerce benefits, events, perks, etc will be associated with this program.
III. The purpose of the pilot Local Focus Program will be as follows:
1. Provide seminars that benefit Cape Canaveral businesses.
2. Provide networking opportunities for Cape Canaveral businesses.
3. Suggest marketing opportunities for businesses in Cape Canaveral.
IV. The City of Cape Canaveral will provide and/or arrange for; meeting space, advertising for
seminars within the city, speaker fees, if needed, refreshments, as needed, for seminars
and networking opportunities and plus pay for any other expenses associated with this pilot
activities located in the City of Cape Canaveral Local Focus Pilot Program.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL
ENDORSING EMPLOYER SUPPORT FOR THE NATIONAL GUARD
AND RESERVE, IN FURTHERANCE OF OUR COUNTRY'S
SERVICE MEMBERS AND THEIR FAMILIES DURING TIME OF
NEED; FURTHER INSTRUCTING THE CITY CLERK TO TRANSMIT
SAME TO THE CHAIRMAN OF THE NATIONAL COMMITTEE FOR
EMPLOYEE SUPPORT OF THE GUARD AND RESERVE.
WHEREAS, the City of Cape Canaveral as an employer who proffers
unconditional support for the Guard and Reserve recognizes that the National Guard
and Reserve are essential to the strength of our nation and the well being of our
communities; and
WHEREAS, in the highest of American tradition, the patriotic men and women of
the Guard and Reserve serve voluntarily in an honorable and vital profession; whereby
they are trained to respond to their community and their country during time of need;
further acknowledging that said individuals deserve the support of every segment of our
society; and
WHEREAS, if these volunteer forces are to continue to serve our nation,
increased public understanding is required of the essential role of the Guard and
Reserve in preserving our national security; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape
Canaveral, Florida:
SECTION 1. That foregoing "Whereas" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution upon
adoption hereof.
SECTION 2. That the City Council does hereby join other employees in pledging
that it fully recognizes, honors and enforces the Uniformed Services Employment and
Reemployment Rights Act (USERRA).
SECTION 3. That our managers and supervisors will have the tools they need to
effectively manage those employees who serve in the Guard and Reserve.
SECTION 4. That we will continually recognize and support our country's service
members and their families in peace, in crisis, and in war.
SECTION 5. That the City Clerk is hereby instructed to transmit a copy of this
resolution to both the Chairman of the National Committee and the Chair of the Florida
Committee for Employer Support of the Guard and Reserve.
SECTION 6. That this resolution is effective immediately upon the date of its
passage and adoption herein.

FLORIDA; ELECTING A MAYOR PRO TEM OF THE CITY OF CAPE

WHEREAS, Article V, Section 4, of the Charter of the City of Cape Canaveral, Florida,
requires the City Council to annually elect from its membership a Mayor Pro Tern.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1. Buzz Petsos is hereby elected as Mayor Pro Tern of the City of Cape
Canaveral, Florida; said Mayor Pro Tern is authorized and directed to undertake the duties and
responsibilities of Mayor Pro Tem, in conformity with the City Charter, and to serve in such
capacity until the next annual election.

Re: Deputy Of The Month
On August 25 2009, Deputy Mazzone responded to the"Happy Octopus Car Wash" located at
8095 Astronaut Blvd. regarding a burglary investigation.
While investigating the incident, Deputy Mazzone noticed that unknown suspect(s) had attempted
to gain entry into the coin-operated machines. Deputy Mazzone processed the crime scene and
while doing so, Deputy Stewart located and recovered a cash box that did not belong to the car
wash.
Deputy Mazzone began searching local Cape Canaveral businesses and noticed that the cash
box was removed from the coin-operated machine at the "Ice House" located at 8501 Astronaut
Blvd. Deputy Mazzone processed the cash box for latent prints and recovered one latent print.
This latent print was entered into A.F.I.S., which resulted in a successful hit, which resulted in the
identification of a white male suspect.
The investigation is still on going, but the recovered latent print revealed the following facts; the
"Ice House" Machines in both Brevard County and Orange County have been hit over the past two
months. Some of the other cases also have evidence that may lead to the same suspect.
According to General Crimes Unit Agent Hearon, Deputy Mazzone's outstanding work may be the
only link in solving at least five of these cases.
I would like to recommend Deputy Mazzone for the Cape Canaveral Precinct deputy of the month
for the month of September 2009.
