APRIL 15, 2002
MINUTES
A meeting of the City of Cape Canaveral Community Appearance Board was held on April 15, 2002 at
7:00 p.m. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The Recording Secretary
called the roll.

NEW BUSINESS
Approval of Meeting Minutes: April 1 2002.
Motion by Mr. Bruns, seconded by Ms. Hayes to approve the Meeting Minutes of April 1, 2002, motion
carried unanimously.
Ms. Hayes reported an ex -parte phone communication with Mr. Camomilli regarding the agenda packet.
Attorney McQuagge swore in all persons giving testimony.
2. Request No. 02 -16 - Resubmittal of Flore Del Mar - Fence, 8470 Ridgewood Avenue - Jovice
Gumpher, Applicant.
Ms. Gumpher, Allen Engineering, testified that the fence on the north side of Flores Del Mar would be
eliminated, and a solid hedge inserted. A new (green coated) chain link fence would be placed on the south
side along with a solid hedge. The wrought iron fencing would extend in front of the property only.
Mr. Bruns asked about landscaping plans for the north side. Ms. Gumpher testified there would be a solid
hedge and six trees. Motion by Mr. Bowman, seconded by Ms. Hayes to approve request NO. 02 -16. At
this time Chairperson Easler asked for audience testimony.
Mr. Ed Smalley, Canaveral Sands Condo Association stated that the existing chain link fence was put in as
a barrier and the Association wanted to see what would be installed by the Flores Del Mar prior to
removing the existing fence.
Ms. Jean Deck, 8494 Canaveral Sands, testified that the fence was a vinyl coated fence, not a chain link.
Ms. Deck further testified that she did not consider what was presently there to be a close hedge. Mr.
Bowman asked for clarification on the code. Mr. Reid responded that there is no code requirement for
residential shrubs. Mr. Bowman submitted that the code regarding moving lights should be reviewed. Ms.
Gumpher responded to Mr. Bruns that it is the intention along the north side to run a solid hedge of shrubs.
Mr. Smalley pointed out that the Community Appearance Board has no jurisdiction over this matter,
however someone must have jurisdiction. He explained the parking lot is 15 to 20 ft from the units and
cannot understand why the developers are not taking responsibility for the problem they have created. Mr.
Smalley thanked Ms. Gumpher for placing the shrubs, however, he expressed concern that the developer
would not be held liable for the proposed landscaping plans. Mr. Reid responded that the developer must
include all the trees and shrubs as listed on the submitted plans prior to issuance of a certificate of
occupancy.
Motion by Mr. Bowman, seconded by Ms. Hayes to approve request No. 02 -16. The motion carried
unanimously.
Request Nos. 02 -19 & 02 -20 - 146 & 148 Ocean Garden Lane - Perimeter Fence - John and
Jacob Baker. Applicants.
Mr. Baker explained it would be a six foot, pressure treated fence around the perimeter. The property
consisting of three lots all belong to his family. Chairperson Easler questioned Mr. Baker regarding gate
access. Mr. Baker testified that he would like gates installed close to the house on both sides allowing
access to both yards. Regarding the back edge of property he proposed a chain link fence, which would be
buffered with existing trees and brush.
Motion by Ms. Hayes, seconded by Mr. Bowman to approve request Nos. 02 -19 & 02 -20 inclusive of the
rear property chain link fence and two gates on either side of house. The motion carried unanimously.
There being no further business, the meeting was adjourned at 7:40 P.M.
