COMMUNITY APPEARANCE BOARD
JUNE 18, 2001
MINUTES
A meeting of the City of Cape Canaveral Community Appearance Board was held on
June 18, 2001 at 7:00 P.M. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral,
Florida. The Secretary called the roll.

Approval of Meeting Minutes: June 4, 2001.
Motion by Ms. Hayes, seconded by Mr. Camomilli to approve the meeting minutes of
June 4, 2001 as submitted. Vote on the motion carried unanimously.
2. Request No. 01 -23 - Fence - 299(A) Chandler Street, Lot 12 Block B Canaveral
Beach Gardens Subdivision - Kathleen Solomon, Applicant.
Ms. Solomon apologized to the Board for missing the last meeting. Ms. Solomon testified
that she wanted to place a 4 ft. high wood shadow box fence around the perimeter of her
property along the sidewalk as depicted on the submitted survey. She agreed that the
fence would not be erected within a five ft. radius of the fire hydrant, the fence would be
placed approximately one ft. from the sidewalk and she would install plants along the
fence. Ms. Solomon explained that her property was close to the elementary school on a
corner lot, the general public walks on her grass, and people let there dogs defecate on the
property. Discussion followed regarding where the fence would be placed.
Motion by Ms. Hayes, seconded by Mr. Camomilli to approve Request No. 01 -23 even if
the applicant changes the located of the fence. Motion carried unanimously.
3. Request No. 01 -24 - Maintenance Storage Building - 8600 Ridgewood Avenue
Royal Mansions), Parcels 751 & 753, Canaveral Beach Gardens Subdivision -
Monte Brown, Applicant.

The Board members reviewed the submitted photographs. Mr. Monte Brown submitted
color swatches of the proposed building. He testified that the building would be attached
to the existing building that housed the dumpster, the building would have a flat roof, the
building colors would match the existing buildings, this would be a block structure used
solely for maintenance storage, the back of the building would not have any windows.
Motion by Ms. Hayes, seconded by Mr. Bowman to approve Request No. 01 -24.
Discussion followed. There was no roll call on the vote.
Mr. Steve Testa, resident, 8700 Ridgewood Avenue, testified that he and other residents
of Ocean Oaks objected to the maintenance building. Chairperson Easler asked what is
objection was. He stated everything. Mr. Testa submitted a packet to the board. He
advised that residence that live above the first floor of Ocean Oaks looked down onto the
dumpster building with excessive trash, broken awnings, lumber, and debris. Ms. Easler
clarified that the Board could only make a decision on the building appearance. Mr.
Brown, applicant, verified that this was a roofed structure. Mr. Borraggine, Building
Inspector advised that their concerns should be addressed by code enforcement and the
placement of the building should be addressed by the Planning & Zoning Board during
the site plan review. Mr. Testa advised that Royal Mansions had approximately 200 ft. to
the south of the property to construct the proposed building. He explained that if the
proposed maintenance building was constructed on the southeast corner of their property,
it would be located approx. 150 ft. away from the nearest condominium at Canaveral
Sands, if constructed as proposed, it would only be placed approximately 12 ft. from
Ocean Oaks property.
Ms. Hayes commented that the Board had previously approved a maintenance building
for Royal Mansions. Mr. Brown responded that the building was never constructed
because of its large size and its placement was east of the construction control line.
Ms. Suzy Carter, resident explained that the placement of the building was an appearance
issue and requested that they move the building to the other side of their property. There
was more room on the south side. The building in its proposed location would create a
visual obstruction to two -way traffic, would create disruptive noise, and would be
aesthetically unpleasing to the residents of Ocean Oaks.
Mr. James Underwood, resident testified that there were times that there had been at least
50 trash bags of garbage and rodents outside and around the dumpster area. Discussion
followed.
Assistant City Attorney, Mark McQuagge clarified that the Board could not dictate the
location and that garbage was an issue for code enforcement. Mr. Underwood responded
that Royal Mansions did not receive a Notice of Violation until four months after the
complaint was filed. He reiterated that the garbage was unsanitary and an eyesore. Mr.
Underwood asked the Board to table this item so the Board members could look at the
location.

Mr. Brown further testified that Royal Mansions was trying to resolve the issues by
constructing the maintenance building. Discussion was held regarding if the location of
the building was within the Board's purview. Following an ensuing discussion, Assistant
City Attorney McQuagge clarified that the Board could only table a request one -time and
he would need to research from a legal standpoint if the Board had the authority to dictate
where the structure will be placed.
Motion by Mr. Bowman, seconded by Ms. Hayes for the purpose of discussion to table
the Request until the next meeting. Discussion followed. Vote on the motion carried
unanimously.

John Baker, Applicant.
Mr. Baker testified that the townhouse would be located on a cul -de -sac in the Ocean
Gardens Subdivision. The building would be desert bone with ash trim, and Beachwood
sand roof shingles. Discussion was held regarding landscaping. Mr. Borraggine,
Building Inspector clarified that there were no landscaping requirements for residential �-
properties. The Board reviewed photographs of the site. Mr. Baker advised that as many
trees as possible would be preserved. He advised that the Ocean Gardens Home Owners
Association maintained the front of the properties. Discussion followed regarding
landscaping the property.
Motion by Mr. Bowman, seconded by Mr. Camomilli to approve Request No. 01 -25 with
the condition that landscaping be added to the left and right sides of the property. Vote
on the motion carried unanimously.
Request No. 01 -26 - Wall Signs - 6211 N. Atlantic Avenue, Lots 26 & 27, Banana
River Estates - Wavfast Signs, Applicant.
The applicant testified that two wall signs were proposed, one on the south side and the
other on the east side. This would be a dimensional sign with terra -cotta lettering and
brown shadow, ivy background and dark brown trim. The Board members reviewed a
colored rendering sample of the proposed sign and submitted photographs of the
building. He informed the Board that the owner of the Tea Room wanted a similar sign.
Chairperson Easler clarified that another sign would be need to be a separate application.
Motion by Mr. Camomilli, seconded by Ms. Hayes to approve Request No. 01 -26 as
presented. Vote on the motion carried unanimously.
