HomeMy WebLinkAboutMinutes 07-09-2001City of Cape Canaveral Board of Adjustment Meeting Minutes July 9, 2001 A Meeting of the City of Cape Canaveral Board of Adjustment was held on July 9, 2001 at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Rigerman called the meeting to order at 7:30 P.M. The Board Secretary called the roll. MEMBERS PRESENT Marilyn Rigerman Ronnie Farmer Robert Laws Connie McKone Paula Collins Chairperson 1st Alternate MEMBERS ABSENT: Earl McMillin Vice Chairperson OTHERS PRESENT Bea McNeely Mark McQuagge Morris Reid Susan Chapman Ex- Officio Member Assistant City Attorney Building Official Secretary Motion by Mr. Laws, seconded by Mr. Farmer to approve the meeting minutes of January 29, 2001 as submitted. Vote on the motion carried unanimously. Attorney McQuagge swore in all persons giving testimony. NEW BUSINESS 1. Special Exception Request No. 01 -01 to Allow Residential Use in the C -1 Zoning District - Lots 1 -4 & 9 -12, Block 7, Avon by the Sea Subdivision Section 14 Township 24 South Range 37 East - Thomas H Quinn Designated Agent Mr. Quinn testified that he proposed to develop 1.13 acres; the density allowed for seventeen units to be built; he was proposing only a total of eight units consisting of four 1- story - (2) unit buildings; the property fronted A1A with a 50 ft. setback which he would heavily landscape for beautification and buffering from traffic noise, the sidewalk was existing; residential use would be a less of an impact than commercial, the residential construction would complete Block 7 as residential; driveways would be on Jefferson or Adams Avenues; residential use would have less noise, light and traffic than a commercial use; all utilities are existing; the fire hydrant was existing; the 50 ft. landscaped area would be owned and maintained by the townhouse owners in the 1st building; as many trees as possible would be preserved, the palm trees would be transplanted. Mr. Quinn clarified that the maximum of eight units being constructed was a condition he had agreed to with the Planning & Zoning Board. Board of Adjustment Meeting Minutes July 9, 2001 Page 2 Mr. Laws complimented Mr. Quinn for both his verbal and written presentation. Citizens: Mr. Jim Galuzzi, Mr. Tom Cahill, Mr. Carl Clark, and Ms. Dorothea Tinney spoke in favor of the request. Citizens: Ms. Claudia Molloy, and Mr. Robert Hoog were opposed to the request. Ms. Louise Palmer inquired if the request met the requirements of the Comprehensive Plan. Mr. Reid, Building Official, verified that the request did meet the requirements of the Comprehensive Plan. Chairperson Rigerman clarified that residential use in a commercial zoning district was allowed by special exception. The Board members reviewed the Criteria Worksheet to verify that the request met all applicable code requirements. Motion by Mr. Farmer, seconded by Mr. Laws to approve Special Exception Request No. 01 -01 with the following conditions: 1. Landscape buffering shall be provided; and 2. Approval shall be limited to (8) townhouse units. Vote on the motion carried unanimously. There being no further business, the meeting was adjourned at 8:05 P.M. Approved this ,� - day of 2001.
