HomeMy WebLinkAboutMinutes 02-28-2000City of Cape Canaveral Board of Adjustment Meeting Minutes February 28, 2000 A Meeting of the City of Cape Canaveral Board of Adjustment was held on February 28, 2000 at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Rigerman called the meeting to order at 7:30 P.M. The Board Secretary called the roll. MEMBERS PRESENT Marilyn Rigerman Chairperson Ronnie Farmer Vice Chairperson Robert Laws Connie McKone Earl McMillin Paula Collins 2nd Alternate OTHER PRESENT: Beatrice McNeely Ex- Officio Member Kohn Bennett City Attorney Dennis Franklin Building Official Susan Chapman Secretary Motion by Mr. Laws, seconded by Ms. McKone to approve the meeting minutes of October 11, 1999 as submitted. Vote on the motion carried unanimously. Dennis Franklin, Building Official; Kurt Tezel, Property Owner; and Grant Vernon, Petitioner, were sworn in by Kohn Bennett, City Attorney. NEW BUSINESS 1. Special Exception Request No. 99 -14 to Allow Frank's Seaside Italian Restaurant to Serve Beer & Wine (8501 Astronaut Boulevard Unit 8) - Grant Vernon, Authorized Agent. Mr. Grant Vernon, owner of Frank's Seaside Italian Restaurant advised that he was in the restaurant business for the past five years. He testified that the request for his restuarant to serve beer and wine was for the convenience of his patrons. Mr. Kurt Tezel, property owner, advised that he supported the request. Mr. Vernon suggested that a checklist be created to assist the applicant to ensure a proper and complete submittal of the required documents. Chairperson Rigerman inquired why this submittal took so long. Mr. Franklin responded that the submittal was a simple communication process, he reviews the submittal packet for the requirements, and contacts the applicant when additional documents are required. Board of Adjustment Meeting Minutes February 28, 2000 Page 2 Motion by Mr. McMillin, seconded by Mrs. McKone, to approve Special Exception Request No. 99 -14 as follows: Findings of Fact: Grant Vernon was the authorized agent of the real property described in the Petition. The property was located in the C -1 zoning classification and was subject to the Land Development Regulations pertaining to said district. The granting of this special exception request would not adversely affect the public interest. This special exception was consistent with the goals, objectives and policies of the Comprehensive plan; was consistent with the intent of the C -1 zoning district; this request would not create any adverse impacts to adjacent property through the creation of noise, light, vibration, traffic, utility requirements, or stormwater runoff; no unusual police, fire or emergency services will be required; all the requirements of the zoning district were met with this special exception. Conclusion of Law: That the Board of Adjustments has lawful power and authority to grant special exceptions under special conditions and circumstances as set forth in Section 110 -171, Paragraph (C)(1 -4) of the Cape Canaveral Code of Ordinances. The petitioner has met the minimum requirements for the requested special exception and has demonstrated entitlement to the special exception which will not adversely affect the public interest. Order: Grant E. Vernon dba Frank's Seaside Italian Restaurant is granted the special exception with no noted limitations, restrictions and conditions. Vote on the motion carried unanimously.
