ZONING BOARD OF ADJUSTMENTS
JULY 25, 1 Q94
A Meeting of the City of Cape Canaveral Zoning Board of Adjustments was held on
July 25, 1994, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida.
Chairman Lloyd called the meeting to order at 7:30 P.M. The Secretary called the roll.

Motion by Mrs. Thurm, seconded by Mr. Laws to approve the minutes of June 13,
1994 as submitted. Motion carried unanimously.
DISCUSSION
1. Discussion Re: Findings of Fact, Conclusion of Law and Order.
Mr. Markey advised that the new form was to be used to assist in stating for the
record the basis of decisions. He encouraged the Board to incorporate as much
factual data as possible to support approval or denial of a request.
NEW BUSINESS
1. Special Exception Request No. 94 -07 to Allow Rockwell International to
Purchase and Install One Hazardous Chemical Storage Container Section 15
Township 24 South, Range 37 East, Parcel 813 (Located at 260 West Central
Boulevard, Rockwell International) - M. Craig Dixon, Agent.

The Board members reviewed the submitted application. Mr. Dixon explained that
four units existed which were approved by NFPA for chemical storage. He explained
that the CCVFD was aware of the types of chemicals being stored and that a current
list of all the chemicals was being placed in a knox -box on -site daily. Mr. Dixon
advised that the chemicals were presently being stored in an NFPA approved locker
inside the building. He stated that the chemical storage had not increased however,
the CCVFD had requested that the chemicals be stored outside the building in an
approved NFPA hazardous storage container.
Discussion was held regarding the conditions placed on the existing special exception
No. 94 -10. Mr. Dixon agreed to the same conditions being placed on this special
exception request.
Motion by Mr. Laws, seconded by Mr. Lee to approved Special Exception Request No.
94 -07 as follows:
Findings of Fact M. Craig Dixon, Representative for Rockwell International was
the designated agent of the real property described in the Petition. The
property was located in the M -1 zoning classification and was subject to the
Land Development Regulations pertaining to said district. The granting of this
special exception would not adversely affect the public interest. This special
exception was consistent with the goals, objectives and policies of the
Comprehensive Plan; was consistent with the intent of the M -1 zoning district;
this request did not create any adverse impacts to adjacent property through
the creation of noise, light, vibration, traffic, utility requirements, or stormwater
runoff that would not have been created had the property been developed for
a principal use permitted in the M -1 zoning district; no unusual police, fire or
emergency services would be required; all the requirements of the zoning
district were met with the special exception.
Conclusion of Law That the Zoning Board of Adjustment had lawful power and
authority to grant Special Exceptions under special conditions and
circumstances as set forth in Section 637.51, Paragraph H of the Cape
Canaveral Code of Ordinances. The petitioner had met the minimum
requirements for the requested special exception and had demonstrated
entitlement to the special exception which would not adversely affect the
public interest.

Order Rockwell International was granted the special exception subject to all
applicable limitations, restrictions and conditions including the following special
condition(s):
1. Hazardous waste and other assorted chemical product storage not to
exceed 1,000 gallons.
2. MSDS Knox -Box must be provided.
3. Day to day inventory must be provided.
4. Quantities to be limited as per NFPA -30.
5. Rockwell International would provide proper containment to meet the
Building Department and Fire Department requirements.
6. Said special exception shall expire when Rockwell International
discontinued use of the facility.
Should there be a violation to any part of this Order, the Special Exception may
be revoked in accordance with applicable laws and the City Code.
Motion carried with members voting as follows: Mr. Farmer, for; Mr. Laws, for; Mr.
Lee, for; Mr. Lloyd, for; Mrs. Thurm, for.
There being no further business the meeting was adjourned at 8:10 P.M.
