HomeMy WebLinkAboutMinutes 10-30-1989CITY OF CAPE CANAVERAL ZONIPIG BOARD OF ADJUSTMENT REGULAR MEETING OCTOBER 30, 1989 A Meeting of the City of Cape Canaveral Zoning Board of Adjust- ment was held on October 30, 1989, at City Hall Annex_, 111 Polk Avenue, Cape Canaveral, Florida. Chairman Lloyd called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT: Russell Lloyd Marilyn Rigerman Nellie Cardinale Robert Laws Ronnie Farmer MEMBERS ABSENT: Patrick Lee OTHERS PRESENT: Kohn Bennett Leo Nicholas Jim Morgan Susan Nelson Chairman Vice Chairman 1st Alternate 2nd Alternate Deputy City Attorney City Manager Building Official Secretary Mrs. Cardinale moved to approve the minutes of the June 5, 1989 meeting. Mrs. Riq_erman seconded motion. Motion carried unanimously. NEW - __BUSINESS 1. Request _No - . 89 -6 Special Exception for Carwash, Parcel 262, ( 8905 _ Astronaut _ Boulevard). _ was Covincgton__for Daletech of___Florida, ,Inc Mr. Redman from Allen Engineering, explained to the Board the operation and location of the proposed carwash. He further explained that the water would be re- claimed and stored in underground water tanks. Chairman Lloyd noted that the Planning and Zoning Board could find no reason to disapprove the Special Exception Request as long as the applicant adhered to Section 641.43 to provide adequate buffering from the adjoining residential area. Mr. Redman stated that screening would be installed between the two properties and shrubbery planted to decrease noise and night lighting since the carwash would be open 24 hours. He also explained that noise would only be from vacuums which were to be installed on the A1A side of the property. Discussion followed. Mrs. Cardinale moved to approve Request No. 89 -6. City Attorney, Kohn Bennett, read to the Board a portion of the Court Order file (First Interstate vs. The City) that stated the subject property was zoned C -1 and that First Interstate had used the acreage of that property in calculating zoning density for Ocean Woods and would only use that property for commercial development. Mr. Murphy stated that he already closed on the property and had never seen the Court Order. Attorney Bennett suggested that this item be tabled so that Mr. Murphy could review the Court Order. Discussion followed. Mrs. Cardinale moved to table Request No. 89 -7. Mr. Laws seconded the motion. Motion carried unanimously. 3. Request No. 89-8 Special Exception to construct Apartments in a C-1 _ Parcel 520, ( South of Atlantic Gardens Apartments,,AIA__to North Atlantic Avenue). Petitioners were William cx Geier Frank Hardaway, Owners. Mr. Geiger explained that the apartments would be located on the East side of the property and 210 feet of the property would remain r_ -1. He further explained that the apartments would be two stories, two bedroom rentals and buffering would be provided by existing fence. Mr. Laws moved to approve Request No. 89 -8. Mrs. Cardinale seconded the motion. Motion carried unanimously. 4. Motion Re: Election of Officer Mrs. Rigerman nominated Russell Lloyd as Chairman for another term. Mrs. Cardinale seconded the nomination. Mrs. Rigerman moved to close the nominations. Mrs. Cardinale seconded the motion. Motion carried unanimously. Mrs. Cardinale nominated Marilyn Rigerman as Vice Chairman for another term. Mr. Farmer seconded the nomination. Mr. Laws moved to close the nominations. Mr. Farmer seconded the motion. Motion carried unanimously. There being no further business the meeting was adjourned at 8:05 P.M.
