HomeMy WebLinkAboutMinutes 03-26-1990CITY OF CAPE CANAVERAL ZONING BOARD OF ADJUSTMENT MARCH 26, 1990 A Meeting of the City of Cape Canaveral Zoning Board of Adjustment was held on March 26, 1990 at the City Hall Annex, 111 Polk_ Avenue, Cape Canaveral, Florida. Chairman Lloyd called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT: Russell Lloyd Marilyn Rigerman Robert Laws Nellie Cardinale Chairman Vice Chairman MEMBERS ABSENT: Ronnie Farmer Pat Lee 1st Alternate OTHERS PRESENT: Leo Nicholas Mitch Goldman Jim Morgan Susan Nelson City Manager Deputy City Attorney Building Official Secretary Chairman Lloyd advised that four members must vote in favor of a special exception in order for it to be granted. Mr. Lloyd poled the petitioners and they agreed to have their cases heard, even though only four Board members were in attendance. Mrs. Rigerman moved to approve the minutes of February 16, 1990 as submitted. Mr. Laws seconded the motion. Motion carried unanimously. Mrs. Rigerman moved to approve the minutes of March 5, 1990 as submitted. Mr. Laws seconded the motion. Motion carried unanimously. NEW BUSINESS 1. Mr. Murphy explained the location of the property and that ten units per acre would be constructed on the seven acres of property, in A citizen in attendace, Mr. Warren Blasi, noted a concern of an adjacent propane tank_. Motion carried unanimously. 2. Request No. _90- 03 to Construct Townhouses in a_ C -1 : Zone, _ _ Sec. 14, Twp 24 S_Rge_._37E, West Subdivision, Parcels_ A, B and _C (Located Just Nor o f Southgat Trailer on No rt h Atlantic Ave nue). Petitioner was James W. Murphy for W illia m Bennix Ow ner. March 26, 1990 Page 1 of 3 Mr. Murphy stated that townhomes would be built on the approximately 13 acres of land, in phased construction. Chairman Lloyd asked the City Manager to update the Board on the progress of the Concurrency Management Roadway Study. Mr. Nicholas, stated that the City was under contract for the roadway study which should be completed early April, 1990. Discussion followed. Mrs. Cardinale moved to approve Special Exception No. 90 -3. Mrs. Rigerman seconded the motion. Motion carried unanimously. 3. Mr. Louis Lorie, Vice President of Lorie & Associates, explained that he applied for a special exception to construct apartments in the C -1 Zone portion of the property to preserve oak trees. An owner at Treasure Island Club asked Mr. Lorie if a retaining wall or fence would be installed at the back portion of the property to avoid renters utilizing Treasure Island Club facilities. Mr. Lorie stated that neither a wall nor fence would be installed. Mr. William Jackson, owner of an adjacent townhouse, voiced an objection to the parking area on the southern property line. Mr. Lorie stated that ingress and egress would be on AlA. Discussion followed. The Board members and citizens reviewed the site plan to better understand the layout of the proposed construction. Chairman Lloyd suggested that a landscape plan to screen the southern parking lot be drawn and submitted to the City. Mr. Lorie stated that a landscape plan was submitted to the City and noted that shrubbery was included. Discussion continued. Mrs. Rigerman moved to approve Special Exception No. 90 -4 contingent upon providing landscape visual screen between the parking spaces and the south property line. Mr. Laws seconded the motion. D ecker for Charles D Watt, owner Mr. Robert Decker, the owners representative, advised that he planned to construct a duplex or tri -plex. March 26, 1990 Page 2 of 3 Mr. Gary Jackson, agent for Mr. Swartz, advised that the building would be utilized for tire repair, lube and brake jobs only. He further stated that no vehicles would be stored overnight and all used tires would be stored inside the building. Discussion followed. The Board reviewed the Zoning Ordinance and asked the City Attorney his interpretation of the service station section. Discussion followed. Mrs. Cardinale moved to approve Special Exception No. 90-6.
