AN ORDINANCE AMENDING ORDINANCE NO. 81-64
AS AMENDED RELATING TO THE CREATION OF A
NEW ZONING DISTRICT }:NOWN AS M-3;
REGULATING THE USE OF LANDS IN SAID DISTRICT;
ESTABLISHING THE BOUNDARIES OF THE SAID M-3 t c
DISTRICT; PROVIDING AN EFFECTIVE DATE I

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAFE t.
CANAVERAL, FLORIDA, AS FOLLOWS:
; SECTION 1. Ordinance No 81-64 as amended is hereby
amended by the addition of a new sub-section to be entitled

8A immediately following the section of Article 5 of said
Ordinance known as sub-section 8-M-2 Industrial District
which new sub-section shall read as follows:
"8A M-3 PETROLEUM STORAGE INDUSTRIAL DISTRICT

The lands in this district are used by a variety
of commercial, storage and industrial operations. The purpose
of this district is to permit the normal operation of the
majority of industrial uses under such conditions of operation
as will protect the abutting residential and commercial uses.
USES PERMITTED -

(1) Within any M-3 Industrial District no Building,

structure, land or water shall be used except for one or more
of the following uses:
A. Any use permitted in the M-2 Industrial District.
B. Storage of petroleum products.
C. Asphalt emulsion plants.

CONDITIONAL USES -
! Manufacturing, processing, fabrication, repair and

servicing of any commodity or product that does not create
possible dangerous, smoky, odorous or other .objectionable
3 ' conditions may be granted a conditional use when after review
of an application and plans appurtenant thereto and public
hearing thereon, the Planning and Zoning Board finds as a fact
that the proposed use or uses are consistent with the zoning
plan, the public interest and the spirit of this ordinance the
Board of Adjustment may permit such conditional uses.

. Acid Celluloid Products Fish Cannery
Animal Reduction Chlorine Gas Glue
Plants Coal Tar Products Guncotton
Bleaching Powder Creosote Commercial Incineration
By-products of Fish Slaughter House of refuse
By-products of Wood Soap Manufacturing, Explosives
Distillation All Types Livestock Yards
Calcium Carbide Fertilizer Products of Compound of
Large Scale Sewage Smelting Hydrocyanic Acid
Disposal PlantsWood Pulping Proxyllin Plastic
Matches Paper and Pulp Mills Refuse Disposal Plants
Oil Refinery Phenol
Oil Wells Potash
Size or Gelatine i
SPECIAL REQUIREMENTS -
(1) No establishment or industrial use permitted
in this Section, however, shall be located within one hundred
(100) feet of any single or multiple residential district,
except after a public hearing.
(2) At all manufacturing establishments, or
rebuilding or repair places permitted in any industrial district,
all materials and products shall be stored and all manufacturing
or rebuilding, repairing or renovating operations carried on
entirely within substantial buildings or completely enclosed •
within substantial approved walls or fences, excepting only
Shipyards, Dry Docks, Boat Slips and the like, where necessary
frontage on the water may be open.
(3) The premises used by gasoline, oil and
petroleum storage tanks shall be surrounded by an unpierced
fire wall or dyke of such height and dimensions as to contain
the maximum capacity of aforesaid tanks with twenty (20%) per
cent margin of safety. All storage tanks and adjacent structures
shall meet the requirement of the National Board of Fire Under-
writers as issued for 1938 or later.
(4) The foregoing paragraph requiring an un-
pierced fire wall or dyke shall not apply to storage tanks con-
taining liquified petroleum, commonly known as bottled gas;
such tanks may be erected without said wall and dyke.

FRONT, REAR AND SIDE YARD REGULATIONS - (None)
SECTION 2. Paragraph 9 of Section 2 of Article V of
Ordinance No. 81-64, as amended, is hereby amended by the
addition of a new zoning district which shall immediately
follow the M-2 Industrial District and immediately precede

the G-C General Classification District and shall be designated
as follows:
"M-3 PETROLEUM STORAGE INDUSTRIAL DISTRICT"
SECTION 3. Paragraph 1, Article V of Ordinance No. 81-64
as amended, is hereby amended by the addition of a new zoning
district which shall immediately follow the M-2 Industrial
District and immediately precede the G-C General Classification
District and shall read as follows:

"M-3 PETROLEUM STORAGE INDUSTRIAL DISTRICT" I
SECTION 4. The following described particular parcel of
land is hereby rezoned from n-2 Classification to an M-3 -
Classification:
The Southerly boundary of said M-3 District shall
be 510 feet North of the Northerly boundary of that t
certain platted Subdivision known as Harbor Heights; t
the Westerly boundary of said parcel of land is a
line lying 200 feet East of the center line of State
Road S--401; the North boundary of said parcel of land
shall be a line described as the Northern City Limits
of the. City of Cape Canaveral; the Easterly boundary
of said parcel of land being the West line of the
present C-1 District which lies immediately East of
this M-3 District,except that property for which title.
is recorded in the name of A. F. Bickelhaupt, 1319 ;r
Seminole Drive, Fort Lauderdale, Florida, and which E.
property is described upon the tax rolls of the Tax
Assessor of Brevard County, Florida, as follows:
"Section Fourteen (14) , Township Twenty Four

j (24) , Range 'Thirty Seven (37) , Parcel Eighteen
(18) , part of Lot Three (3) as described in
Deed Book 177, Page 118, of the Public Records
of Brevard County, Florida. "
The proper City Officials are hereby authorized and directed
1 to amend the Official Zoning hap to conform with the provisions
of this section.

SECTION 5. All Ordinances, or parts of Ordinances, in
conflict herewith are hereby repealed.
SECTION 6. This Ordinance shall take effect immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, on the 5th day of July 1967 .
