AN ORDINANCE AMENDING ORDINANCE 12 - 71 WHICH AMENDS
SECTION IV. 1 THEREOF AS TO THE ZONING DISTRICT
CLASSIFICA'T'ION CHANGING FROM M- 2 AND M-3 CLASSIFICA-
'PION TO C-1 CLASSIFICATION A STRIP OF PROPI'.RTY 400
FEET WIDE ALONG TIME EAST SIDE OF HIGHWAY AlA FROM
THE NORTTI CITY LIMITS TO THE SECTION LINE ; AND
AMENDING SECTION VIII BY REDEFINING RESIDENTIAL
PLANNED DEVELOPMENT THEREIN; AND AMENDING
SECTION XVIII . l AS TO NOTICE REQUIREMENTS TO
PROPERTY OWNERS WHERE A CHANGE OF ZONING CLASSIFI -
CATION IS BEING CONTEMPLATED; PROVIDING AN EFFECTIVE
DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CAPE CANAVERAL , FLORIDA, AS FOLLOI';S :
SECTION 1 . That Section IV. 1 of the City of Cape Canaveral I,
Ordinance 12-71 is hereby amended to reflect on the Official Zoning Map ' i
and Official Zoning District of the City of Cape - '

cation of C-1 for a strip of land 400 feet wide abutting the east side
of Highway AlA extending from the north City Limits south to the inter-
:
section of Highway AlA and the Section Line between Sections 14 and 15 ,
Township 24S, Range 37 E . The Official Zoning Map shall be changed I I.
accordingly and said Official Zoning Map , as amended, is hereby adopted
by reference and declared to be part of this Ordinance .

SECTION 2 . That Section VIII is hereby amended as to the
definition of residential planned unit development and shall read as
follows :

RPUD : Defined :
. For the purpose of this zoning ordinance an RPUD is defined as
any residential use except mobile home developments and including the
group of residential uses and town house developments for which- a mini-
mum of 100 , 000 square feet for town house developments , or a minimum of
four (4) acres for all other types of development if intended to be
developed simultaneously . 1

. SECTION 3 . That Section XVIII . l is amended by the addition of r
paragraph (g) which shall read as follows :

(g) When the City Council proposes a change in zoning classi-
fication of a single parcel or a group of not more than five hundred (500)i
t
parcels of any property within its jurisdiction, it shall be the duty of
said Council to give notice by mail to each property owner whose zoning 1

classification is proposed to be changed . Such notice shall be mailed
to the owner ' s current address of record , as maintained by the assessor
of taxes for the jurisdiction proposing the change and be postmarked no
later than ten (10) days prior to the first scheduled hearing concerning
the proposed change . The notice shall contain the legal description o :-
the affected property, the existing zoning classification, the proposed
zoning classification, and the time and place of any scheduled hearing
I concerning the proposed zoning change . Prior to the effective date o'
any zoning classification change , the City Council shall cause an aff av
to be filed with the City Clerk certifying that said Council has complied
with the provisions of this section. The filing of said affidavit shall
be prima facie proof of compliance with the requirements of this Section.
A failure to give notice shall not affect the validity of zoning except
as to the property of the complaining owner .
SECTION 4 . All ordinances in conflict herewith are hereby
repealed .
SECTION 5 . This Ordinance shall become effective immediately
upon its adoption .
ADOPTED by the City Council of the City of Cape Canaveral ,
Florida , . on this 19th day of Octobe 1971 .
