ATTORNEY- CLIENT SESSION CAPE CANAVERAL PRECINCT TRAINING ROOM 1 111 POLK AVENUE CAPE CANAVERAL, FLORIDA I I 1 1 1 1 I. CALL TO ORDER The Attorney - Client Session shall commence at an open meeting. The City Attorney shall advise the City Council that he desires the advice of the City Council concerning the litigation set forth below. The person chairing the meeting shall announce the commencement and estimated length of the Attorney - Client Session and the names of the 1 persons attending. The Attorney - Client portion of the meeting will be closed to the public and the Attorney - Client Session will commence. At the conclusion of the 1 Attorney - Client Session, the meeting shall be reopened, and the person chairing the meeting shall announce the termination of the Attorney - Client Session. I II. ATTORNEY- CLIENT SESSION Pursuant to Section 286.011(8), Florida Statutes, the City Attorney will be seeking the advice of the City Council regarding settlement negotiations and/or strategy related to litigation expenditures concerning the pending litigation in and for Brevard County, Florida: 1 Royal Mansions Condominium Association, Inc. v. City of Cape Canaveral Case No.: 05- 2008 -CA -16342 1 and : Cape Winds Condominium Association, Inc. v. City of Cape Canaveral 1 Case no.: 05- 2011 -CA- 032802 The persons scheduled to be in attendance are Mayor Rocky Randels, Mayor Pro Tem Betty Walsh, Council Members John Bond, Bob Hoog and Buzz Petsos, City Manager David Greene, City Attorney's Office (Anthony A. Garganese and Debra Babb - Nutcher), and a Court Reporter. III. ACTION (IF NECESSARY) 1 IV. Persons with disabilities needing assistance to participate in any of these proceedings should contact the City of Cape Canaveral at (321) 868 -1230 "at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority" - per Section 286.26 Florida Statutes. "If a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based" - per Section 286.0105 Florida Statutes. g k •
