HomeMy WebLinkAboutResolution 2003-03 RESOLUTION NO. 2003-03 A RESOLUTION VACATING A 10 -FOOT REAR LINE UTILITY EASEMENT IN THE HARBOR HEIGHTS SUBDIVISION PLAT SECOND ADDITION, LOT 21, WITHIN THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Gaspar and Sara Fernandez have requested that the City of Cape Canaveral abandon and vacate that certain 10 -Foot Wide Utility Easement located within the South 10 Feet of Lot 21, Harbor Heights, Second Addition, as recorded in Plat Book 15, Page 80, Public Records of Brevard County, Florida; and WHEREAS, the Public Works Director recommends the vacation of the original 10 -foot easement in the Harbor Heights Subdivision Plat, Second Addition for the above - stated lot; and WHEREAS, the Planning and Zoning Board members voted by majority and recommended approval to the City Council of the above - referenced vacation of easement request; and WHEREAS, the City Council of the City of Cape Canaveral, Florida has determined that it is in the best interest of the City to vacate said easement. NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1. The City of Cape Canaveral, Brevard County, Florida, hereby vacates the 10 -foot Wide Rear Line Utility Easement in the Harbor Heights Subdivision Plat Second Addition, Lot 21 described as follows: Lot 21, HARBOR HEIGHTS, SECOND ADDITION, according to the Plat thereof, as recorded in Plat Book 15, Page 80, Public Records of Brevard County, Florida; together with the property described in official Records Book 1908, Page 638, said property being more particularly described as follows: That portion of the following described parcel of land lying South of and adjacent to Lot 21 and bounded by the Southerly extension of East and West lines threof of HARBOR HEIGHTS, SECOND ADDITION, according to the Plat thereof, as recorded in Plat Book 15, Page 80, Public Records of Brevard County, Florida, as said lot is physically occupied and monumented: A portion of Section 14, Township 24 South, Range 37 East, Brevard County, Florida, more particularly described as follows: Begin at the Southwest corner of Lot 1, HARBOR HEIGHTS, according to the Plat thereof, as recorded in Plat Book 13, page 99, Public Records of Brevard County, Florida, said point also being on the East line of that parcel of land C e described in Official Records Book 146, pgae 116, Public Records of Brevard \\ Cape- nt \cityclerk \CityClk \Resolutions \VACATE \Harbor Heights Rear Line Utility Easement doc City of Cape Canaveral, Florida Resolution No. 2003 -03 Page 2 County, Florida, as said corner and line are physically occupied andmonumented; thence South 89 ° 52'18" East, along the south line of said Harbor Heights and the South line of Harbor Heights, Second Addition, and Harbor Heights, Third Addition, according to the plats thereof recorded in Plat Book 15, Pages 80 and 81, respectively, of the Public Records of Brevard County, Florida, as said South line is physically occupied and monumented, for a distance of 2363.17 feet to the Southeast corner of Lot 31 of said Harbor Heights, Third Addition; thence South 00 07'42" West, for a distance of 20.00 feet; thence North 89 52'18" West, along a line 20.00 feet South of as measured at right angles to and parallel with the South line of said Harbor Heights, Harbor Heights, Second Addition, and Harbor Heights, Third Addition, as said South line is physically occupied and monumented, for a distance of 2362.28 feet to the East line of that parcel of land as described in said Official Records Book 146, Page 116, as said East Iineis physically occupied and monumented for a distance of 20.02 feet to the point of beginning. SECTION 2. This Resolution shall become effective immediately upon its adoption.
