HomeMy WebLinkAboutOrdinance No. 02-2002 ORDINANCE 02 -2002 AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AMENDING THE OFFICIAL ZONING MAP AS DESCRIBED IN SECTION 110 -246, CODE OF ORDINANCES BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM THE CLASSIFICATION OF R -2 RESIDENTIAL TO C -1 COMMERCIAL ON 5.375 ACRES; AS DESCRIBED IN EXHIBIT A; PROVIDING FOR THE REPEAL OF PRIOR AND INCONSISTENT ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board of the City of Cape Canaveral, Florida sitting in its dual capacity as the Planning and Zoning Board and as the Local Planning Agency has held public hearings on changes to the zoning classification of the property indicated below; and WHEREAS, the Planning and Zoning Board has issued a written report regarding its recommendation to the City Council; and WHEREAS, the public was heard at a regular meeting of the City Council on the petition requesting changes indicated below and, after full discussion, the Council having found that the best interest for the City of Cape Canaveral and its citizens would be served by granting the petition to change the zoning C ri classification; and WHEREAS, the City Council, based on the reasons and findings stated in the analysis and recommendation of the staff, has found that the proposed zoning amendment is consistent with the provisions of the City of Cape Canaveral Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of ¢` Cape Canaveral, Florida, as follows: SECTION 1. That the Official Zoning Map of the City of Cape Canaveral, Florida, as described in Section 110 -246, Code of Ordinances is hereby amended to include a change of classification from R -2 (Residential) to C -1 (Commercial) on 5.375 acres for property legally described as (See Attached Exhibit "A ") SECTION 2. This ordinance repeals all prior ordinances and resolutions in conflict herewith. SECTION 3. This ordinance shall become effective after the amendment has been duly recorded upon the official zoning map of the City of Cape Canaveral.
