HomeMy WebLinkAboutMinutes 10-07-2003 Workshop CITY COUNCIL CODE REVIEW WORKSHOP F CITY HALL ANNEX 111 Polk Avenue, Cape Canaveral, Florida TUESDAY { October 7, 2003 5:00 PM �tt MINUTES CALL TO ORDER: A meeting of the City of Cape Canaveral City Council was held on October 7, 2003 at 5:00 p.m. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The Recording Secretary called the roll. ROLL CALL: Council Members Present: Bob Hoog Jim Morgan Mayor Pro Tem Buzz Petsos Mayor Rocky Randels Richard Treverton c e Others Present: Bennett Boucher, City Manager Anthony Garganese, City Attorney Jeff Buak, Assistant City Attorney, (6:15 pm) Virginia Haas, Recording Secretary Todd Morley, Building Official Susan Stills, City Clerk Andrea Bowers, Finance Director Todd Peetz, City Planner DISCUSSION: 1. City Code Review — Continuing with Code Chapter 6 -36 through 74. Chapter 66 -36: Abandonment. Council requested Attorney Garganese to combine the 66 -36 subsections (1), (2) and (3) into one paragraph to avoid being repetitive. Mr. Boucher questioned petitions for abandonment of city streets by adjacent property owners and Attorney Garganese interjected that a citizen may wish to purchase city property as well. Attorney Garganese was tasked with researching whether the City may sell property. 66 -38. Petition Procedure. City Clerk Susan Stills noted that the checklist indicates that the petition is directed to the City Clerk when in fact it should be forwarded first to the Building Department. Council agreed petitions should be filed with the Building Official, then reviewed by the Planning and Zoning board then forwarded to the City Clerk. Mr. Boucher stated that there should be notification to the property owners added to section (B) that contains identical notification of special exceptions and adjusting the current paragraph (B) to (C). 66-39. Ordinance Required. Council requested that Attorney Garganese eliminate section 66 -39 and place a revised paragraph in one of the above sections. 66-64. Authority of City. Council questioned subparagraph (4). Attorney Garganese stated that section 66 -64 says very little to him and the City has a lot of authority. He also recommended "The dirt storage should be off - street ". 66-65. Method of Installation. Council requested deleting 66 -65 "if possible" and inserting "as approved by the City Manager or his designee ". Mr. Morley questioned whether other types of debris, like aggregate, should be added. 66-66. Engineering Details. Council questioned the engineering detail for pavement replacement. Mr. Boucher responded that this detail is attached to the application. Attorney Garganese recommended adopting the engineering details and inserting them into the code. Mr. Morgan recommended FDOT specifications. Example: "Apply with all Jack and bore specifications" as per city code. Mr. Boucher will meet with Attorney Garganese to establish a new section containing the engineering details and specifications. Mr. Boucher questioned if this section was legal and further stated that a NOTICE section should be added. Mr. Boucher also suggested deleting "if it deems advisable and insert "the City Manager, or designee ... ". 66-82. Application. Council requested "may" be changed to "shall require plans and drawings ". 66-83. Cash Deposits. Council suggested striking the word "Cash" and adding "proof of insurance ". Attorney Garganese will review Franchise Agreements with the City. Attorney Garganese will also review 66- 84(b). CHAPTER 70; PUBLIC SERVICE TAX 70 -26. Definitions. Council requested deleting "telecommunications" and updating this section as referenced by F.S. 203.012 (due to new telecommunications tax). Attomey Garganese will review 70 -26 through 70-45 and revise to reflect the new Florida Statutes. OCCUPTATIONAL LICENSE TAX 70-66 through 78-89 Ms. Bowers stated this section requires a revision and an ordinance is needed to enforce mobile vending. Attomey Garganese and Ms. Bowers will review sections 70-66 through 78 -89 on this. The next code review will begin with Chapter 74 Traffic and Vehicles.
