MINUTES
CALL TO ORDER:
A meeting of the City of Cape Canaveral City Council was held on September 2, 2003 at
5:00 p.m. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The
Recording Secretary called the roll.

DISCUSSION:
1. City Code Review — Zoning Code Section 110 -469 and continuing with Code
Chapter 62 -9 through 66.
ZONING CODE SECTION 110 -469
Mr. Morgan stated it would be a mistake adding anything new and feels that this code
section still needs work. Mayor Randels displayed a diagram illustrating the 25ft
triangle area. Mr. Morgan questioned vested rights. Attorney Garganese replied that
the City could set up an amortization schedule. Mayor Pro Tem Petsos agreed that
there are many visibility problem areas. Mayor Randels suggested keeping the
ordinance as is as long as the City had time to enforce it.
Duree Alexander, Code Enforcement Officer introduced recent photos illustrating the
visibility problems at intersections.

Mr. Morgan requested "no fences" in the 25ft diagonal area. Mr. Treverton agreed with
"no fences" and the amortization plan. Council agreed to conduct a survey on the
existing fences near intersections in the 25ft diagonal area. Council would like to delete
"and open chain Zink or wire fence" per safety and health issues.
Mr. Hoog stated he would like to see nothing allowed in the 25ft diagonal area. Mr.
Morgan stated that he would like to visit the sites that Code Enforcement Officer
Alexander presented.
Council agreed to delete "and open chain link or wire fence" and enforce those areas
presently out of code.
Attorney Garganese raised two questions: 1) Regarding sidewalks not allowed in the
area (add sidewalks to wording) and 2) What if the unpaved portion is 25ft before you
get to the private area? Mr. Morley suggested changing the wording to reflect
measurement from the edge of the paved road.
Council requested Attorney Garganese to delete "fences" and add "sidewalks" in its
place. Following some discussion Council agreed to add "ground cover not to exceed 1
foot ".
CHAPTER 62 SOLID WASTE (Continued from last code review meeting)
SECTION 62 -9 (Residential Solid waste pickup conditiona.
Council agreed to delete the first sentence in 62 -9(b) for clarity purposes.
Council agreed to delete "and the owner, resident or occupant of such premises shall be
prosecuted for noncompliance" in section 62 -10.
62 -11 (d) Change "water" to "waste" in last sentence.
62 -11 (e) Delete "sandbed" insert "beaches ".
62 -12 — no changes.
CHAPTERS 63 -65 RESERVED
CHAPTER 66, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES
Section 66 -1. Franchise agreements and right -of -way use agreements.
66 -1 (c) Subparagraph (3) Council requested that the application fee of $2,000 be
reviewed.

Attorney Garganese was asked to review section 66 (g) Franchise fee.
Mayor Randels noted that the next code meeting would begin at Section 66 -36
Authority.
ADJOURNMENT:
Mayor Randels adjourned the meeting at 6:45 P.M.
