The Recording Secretary called the roll. ROLL CALL: Council Members Present: Bob Hoog Jim Morgan Mayor Pro Tem Buzz Petsos Mayor Rocky Randels Richard Treverton Air Others Present: Bennett Boucher, City Manager Anthony Garganese, City Attorney Virginia Haas, Recording Secretary Todd Morley, Building Official Ed Gardulski, Public Works Director Walter Bandish, Assistant Public Works Director Andrea Bowers, Finance Director Dave Sargeant, Fire Chief Lt. Gary Young, Canaveral Precinct DISCUSSION: 1. City Code Review — Continuing with Code Chapter 62 through Chapter 77. Chapter 62 — Solid Waste Section 62 -1 Definitions Ken Rivera, District Manager, Waste Management questioned the definition of "Industrial" and suggested that chemicals be stricken from definition. Council agreed to strike chemicals, oils and grease, and place them under the "hazardous materials" definition. Council tasked Mr. Boucher to inquire with the county about hazardous waste disposal services. Mr. Rivera asked about the "solid waste" City of Cape Canaveral, Florida City Council Code Review Workshop July 1, 2003 Page 2 of 3 definition containing "gaseous material resulting from domestic, industrial commercial, mining, agricultural or governmental operations ". Council agreed to delete the remainder of the sentence following the word "sludge ". Mr. River further questioned the "special container" definition and whether that referred to recycling bins. Council requested from Waste Management an estimate regarding an automated garbage service pilot program. Mr. Rivera questioned if the definition of "special material" included land clearing and if "yard waste" should include "in land- clearing operation. Council agreed to strike the remainder of the sentence after the word "yards ". Sections 62 -2 through 62 -7 No changes Section 62 -8. Containers Required Discussion ensued regarding sunken containers and requested that Waste Management make a presentation to Atlantic Gardens Association on alternatives to the current sunken containers. Mayor Randels mentioned the areas where dumpsters are overfilled and require more frequent pickups. Council asked Attorney Garganese to review the construction and demolition roll off container services being exclusive to Waste Management. Wh Attorney Garganese stated that he would review Chapter 403 Florida Statutes and Y 9 P compare to the definitions provided in our code. Mayor Randels requested that Chief Dave Sargeant address the Council at this time Chief Sargeant responded to Council's concerns regarding fireworks on the beach. He explained that North of Canaveral Sands to Adams Avenue would be patrolled as a "designated family viewing area" which was chosen due to the Cherie Down Park area containing facilities. On staff will be four deputies and five firefighters. Chief Sargeant further explained that signs designating the strict enforcement area would be installed. Council agreed to initiate the designated family viewing area following Attorney Garganese had reviewed the proposed wording.
