CALL TO ORDER:
A meeting of the City of Cape Canaveral City Council was held on May 6, 2003 at 500 p.m. in the
City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The Recording Secretary called the
I roll.

DISCUSSION:
i 1. City Code Review — Continuing with Code Chapter 34-151 through Chapter 54.

I Chapter 34-153
1 Mr. Morley explained that there have been some noise problems at Angel Isles. Mr.
1 Morley also explained that a petition might be submitted from Canaveral Sands
I regarding a noisy pool pump causing sleeping disturbances.

I Chapter 34-176
Council questioned the definition for Public Property, "except paved portions of rights-
! of-way. " Council requested Attorney Garganese research this definition.

i Mr. Morgan noted that previous attorneys have stressed that there should be no entry

1 upon private property. Attorney Garganese stated there is a Supreme Court case that
calls for officials to obtain an administrative warrant unless there is the threat of eminent

danger. Council agreed that this section would need to be reviewed and revised. Mr.
Boucher suggested a warrant procedure be added to this section.

Chapter 34 -187
Mr. Morgan questioned whether the sale is absolute or is there a certain time period to
redeem property. Attorney Garganese stated that he would conduct a follow -up
regarding the redemption time period.
Chapter 40 -27 & 40 -29
Council requested that Attorney Garganese review this section to include the reason
behind section 40 -27 and review of the exemptions in section 40 -29.

Chapter 42 -26
Mayor Randels noted that there might be duplicate or missing text in this section.
Council requested that one of the "Aid in the enforcement of order;" be stricken and the
numbers reordered.

Chapter 46 -27
3 Mayor Randels questioned 46 -27 (b) the Library board having exclusive control over all
monies? Attorney Garganese stated that this could be handled with the Uniform Board
Ordinance.
Chapter 46 -32
Mayor Randels questioned whether a library report had been issued in the past couple

Mayor Randels noted that the Next code review would begin with Chapter 50.
