County, Florida; Establishing a "Complete Streets" Policy.

Summary: Staff has been attending seminars/workshops coordinated by the Space
Coast Transportation Planning Organization (SCTPO) concerning "Complete Streets"
projects, which are defined as follows:
• A "Complete Street" is a transportation facility that accommodates the mobility
needs of all potential users in a safe, integrated, holistic, mutually -supportive
manner. A "Complete Street" treats a roadway as mobility space and provides
the means by which users and modes can share the mobility space. Corridor
treatment(s) may vary based on the age, destination and modal choices of the
facility's users. In an urban area, pedestrian, transit, auto and bicycle treatment
suitable for a range of ages may be appropriate. In a rural area, transit, for
example, may be less critical while consideration of equestrian usage may be
necessary.
Recognizing the importance and popularity of "Complete Streets", the SCTPO
requested that municipalities in Brevard County submit information on potential
"Complete Streets" projects for possible funding assistance from the SCTPO.
According to the SCTPO, up to $3 million may be available in FY 2011/2012 for
assistance on "Complete Streets" projects on non -state roadways (up to $14 million
through FY201412015). In May 2011, Staff submitted two potential "Complete Streets"
projects to the SCTPO for consideration. The proposed City projects are as follows:
• Central Boulevard Streetscape Project - Thurm Boulevard to Ridgewood
Avenue; and
• North Atlantic Avenue Streetscape Project — SR Al A to Port Canaveral.
To be eligible for potential SCTPO "Complete Streets" funding assistance, a number
of criteria must be met by each municipality. One of the main criteria is the adoption of
a resolution establishing a "Complete Streets" Policy (see Attachment A). Therefore,
this Resolution is submitted for consideration and adoption by the City Council to meet
the SCTPO criteria. Information on the two proposed "Complete Streets" projects
submitted to the SCTPO by the City is included as Attachment B.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA; APPROVING AND ADOPTING A COMPLETE
STREETS POLICY.
WHEREAS, increasing walking, biking and transit use offers the potential for
healthier citizenry, cleaner air, reduced traffic congestion, more livable neighborhoods,
less reliance on fossil fuels and imported sources of energy, and more efficient use of
road space and resources; and
WHEREAS, a Complete Street can accomplish greater public benefits, improve
safety, increase transportation options, and support more livable and sustainable
communities; and
WHEREAS, it is in the best interest of the citizens of the City of Cape Canaveral
that the City Council approves and adopts this Complete Streets Policy.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CAPE CANAVERAL, FLORIDA that it does hereby approve and adopt this
"Complete Streets Policy" as set forth below:
SECTION 1. Streets, pedestrian ways, and transit stops within the City of Cape
Canaveral should be planned, designed, constructed, operated, and maintained so that
pedestrians, bicyclists, transit riders, motorists of all ages and abilities can travel safely
and independently.
SECTION 2. A "Complete Street" addresses the needs of all users. Pedestrians,
bicyclists, transit users and motorists of all ages and abilities can be safely
accommodated within the overall street network. Planning for this diverse user group
requires consideration of the following elements:
1. Sidewalk space for pedestrians;
2. Bike lanes or bike routes;
3. Appropriately sized travel lanes for cars, trucks, and delivery/emergency service
vehicles;
4. Transit vehicles, facilities and routes;
5. On -street parking where applicable;
6. Median use for traffic flow, safety, and pedestrian refuge;
7. Adequate buffer areas for pedestrian safety, utility placement, drainage, and
possible landscaping;
8. Landscaping or hardscaping adding pedestrian protection; and
9. The existing and anticipated future land use context of a roadway or corridor.
SECTION 3. Future streets within the City of Cape Canaveral will be designed to
balance user needs and incorporate those elements that match the land use context.
While some corridors may be oriented to vehicle mobility, they should always safely
accommodate bicyclists and pedestrians.
SECTION 4. The City of Cape Canaveral will continue to work with our partnering
agencies, including but not limited to the Space Coast Transportation Planning
Organization, the Florida Department of Transportation, Brevard County, Canaveral Port
Authority, and the City of Cocoa Beach to create attractive Complete Streets that meet
the needs of the traveling public and support the future vision of the corridor.
SECTION 5. This Resolution shall take effect immediately upon its adoption.

funding consideration by the Space Coast Transportation Planning Organization
(SCTPO). The phased Central Boulevard Streetscape Project is combined as requested.
The proposed projects are:

The projects meet the criteria established by the SCTPO for "qualified candidate
corridors" for "complete streets" projects. These SCTPO criteria include the following:
• The City is currently in the process of adopting a "Complete Streets" Policy;
• The proposed roadways are collector or arterial roadways;
• Proposed improvements to the roadways address more than one mode of
transportation;
• Public support for the projects is demonstrated through the City's Vision
Statement and support for the recently completed Ridgewood Avenue Streetscape
Project; and
• The City is certified through the Local Agency Planning (LAP) process.

The Central Boulevard Streetscape Project is consistent with the Local Government
Comprehensive Plan — specific to requirements of the Land Use, Traffic Circulation, and
Recreation and Open Space Elements. In addition, this Project meets a critical portion of the
City's Vision Statement: "We envision ... ...... as a "complete street" with a native -landscaped
and tree -lined median with traffic calming elements and dark -sky street lighting. "Complete

streets" amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings
that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and
adjacent communities. Our unproved "complete streets" will allow us to calmly travel to
intimate waterfront destinations and a walk -able downtown core. Multi -use paths lined with
shade trees should be wide enough for bikes and pedestrians and lighted so anyone can walk or
bicycle safely anywhere in town, day or night. " The City's Vision Statement was developed as a
result of six public workshops conducted in 2009. The visioning process was coordinated with
the East Central Florida Regional Planning Council and was directed by Mr. Phil Laurien,
AICP. The Vision Statement developed during the visioning process has been adopted by the City
Council. A Narrative Addendum for the Project and the City's complete Vision Statement are
included as Attachment ##2.

(a) If it is proposed that the project be administered by a governmental entity other than the FDOT,
document that this entity has the fiscal, managerial, environmental and engineering capabilities

to manage the project consistent with federal requirements and has been certified by the MOT
to perform the work under the Local Agency Program (LAP) process.
The City of Cape Canaveral is LAP -certified, The City recently completed the Ridgewood
Avenue Streetscape Project through the LAP Process. The Project also included the acquisition
and expenditure of Federal stimulus funds through FDOT under the American Recovery and
Reinvestment Act. The City's consulting engineer will assist in the design of the Project -
construction work for the "complete streets" amenities will be publicly bid to local general
contractors.
(b) Can public or private support of the project be demonstrated? (Examples include: written
endorsement, resolution, financial donations or other appropriate means).
Although the Central Boulevard Streetscape Project has not been specifically approved by the
City Council, the Project is in accordance with the adopted goals and objectives of the City
Council as well as the City's Vision Statement. The project will be presented to the City Council
at a future date for approval and the formal appropriation of City funds.
(c) Describe any special characteristics or features of the project.
A 288 bed Assisted Living Facility (ALF) is in the planning stages for construction along the
northern side of West Central Boulevard west of SR AIA. Completion is anticipated in 2013. As
part of an Agreement with the City, the developer of the ALF will provide significant financial
support to complete a number of "complete streets" tasks along West Central Boulevard west of
SR AIA —primarily along the northern side of the roadway. Some of these tasks to be completed
by the ALF developer include the following:
• Construct an 8 -foot wide pedway along the northern side of the roadway;
• Install solar powered lighting along the pedway;
• Plant native vegetation "islands" along the pedway;
• Install pedestrian benches along the pedway;
• Construct a transit bench or shelter adjacent to the ALF for Route 9 of the Space Coast
Area Transit Authority (SCAT) system;
• Replace the concrete curbing along both sides of the roadway; and
• Mill and resurface the entire roadway from SR AIA to Thurm Boulevard — stripe
roadway to include a bicycle lane.
This proposed Central Boulevard Streetscape Project does not include the completion of
"complete streets" tasks along the portion of West Central Boulevard to be improved by the ALF
developer — the northern portion of West Central Boulevard from Thurm Boulevard eastward to
SR AIA. This proposed Central Boulevard Streetscape Project does include "complete streets"
tasks to be completed in the following areas:
• The southern side of the roadway (1, 700 feet in length) from Thurm Boulevard eastward
to SR AIA; and
• Both sides of the roadway (5,100 feet in length) from SR AIA eastward to Ridgewood
Avenue.

The "complete streets " tasks for the proposed Central Boulevard Streetscape Project include the
following:
• Complete 6 -foot sidewalks;
• Install solar powered lighting (solar) along the sidewalks;
• Plant native vegetation "islands " along the sidewalks;
• Stripe the roadway for bicycle lanes; and
• Install pedestrian benches along the sidewalks.
With the financial assistance of the developer of the ALF for the northern side of the roadway for
a portion of West Central Boulevard and funds provided by the CitylSpace Coast Transportation
Planning Organization for the remaining portion of the Central Boulevard corridor, this
"complete streets " project will extend from Thurm Boulevard across SR AIA to Ridgewood
Avenue. A Narrative Addendum with additional information is included as Attachment #.2.
(d) If this is a non -State Road or bridge, or a bicycle or pedestrian path to be located outside of State
Right -of -Way, include a letter of support from the City and/or County Mayor/Chairman,
indicating the local government's commitment for a local match and maintenance of the project,
once the project is complete. Also indicate whether sufficient right-of-way for the project is
currently owned by the local government entity.
A letter from the City's Mayor is included as Attachment #3. Maintenance of the streetscape area
will be performed by the City ,s Streets Department. There may not be sufficient right-of-way to
complete the streetscape project as envisioned - additional right-of-way may be required.
(c) If this project is off the State Highway System and is to be produced by Department staff,
include a letter (or executed agreement) indicating the local government's commitment to
execute an agreement to cooperate with the Department staff in eminent domain, utility and/or
any other matters necessary for efficient completion of the project.

Central Boulevard Streetscape Project
City of Cape Canaveral
A 288 bed Assisted Living Facility (ALF) is in the planning stages for construction along
the northern side of West Central Boulevard west of SR AIA. It is expected to be
complete for occupancy in 2013. As part of the Developer's Agreement with the City,
the developer of the ALF has agreed to provide significant financial support to complete
a number of "complete streets" tasks along West Central Boulevard west of SR AIA —
primarily along the northern side of the roadway. Some tasks to be completed by the
developer include the following:
• Construct an 8 -foot wide pedway along the northern side of the roadway;
• Install solar -powered Iighting along the pedway;
• Plant native vegetation "islands" along the pedway;
• Install pedestrian benches along the pedway;
• Construct a transit bench or shelter adjacent to the ALF for Route 9 of the Space
Coast Area Transit Authority (SCAT) system;
• RepIace the concrete curbing along both sides of the roadway; and
+ Mill and resurface the roadway from SR AIA to Thurm Boulevard — stripe
roadway to include a bicycle lane.
This proposed Central Boulevard Streetscape Project does not include the completion of

Scope of Work. This proposed Central Boulevard Streetscape Project includes "complete
streets" tasks to be completed in the following areas:
The southern side of the roadway (1,700 feet in length) from Thurm Boulevard
eastward to SR AIA; and
Both sides of the roadway (5,100 feet in length) from SR AlA eastward to
Ridgewood Avenue.
The proposed "complete streets" tasks to be completed as part of the Central Boulevard
Streetscape Project include the following:

• Install solar -powered lighting (solar) along the sidewalks;
• Plant native vegetation "islands" along the sidewalks;
• Remove existing trees from the City's rights-of-way;
• Stripe the roadway for bicycle Ianes; and
• Install pedestrian benches along the sidewalks.
With the financial assistance of the ALF developer for the northern side of the roadway
for a portion of West Central Boulevard and funds provided by the City/Space Coast
Transportation PIanning Organization (SCTPO) for the remaining portion of the Central
Boulevard corridor, this "complete streets" Project will extend from Thurm Boulevard
across SR AIA to Ridgewood Avenue.
Community Benefits. The proposed Central Boulevard Streetscape Project is part of a
comprehensive "complete streets" program developed by the City. The Ridgewood
Avenue Streetscape Project was recently completed along the City's beachfront
neighborhood. The "complete streets" project includes many amenities including: a
pedway, new sidewalks, traffic calming devices, solar -powered lighting, native
vegetation "islands', etc. This proposed Central Boulevard Streetscape Project is in
addition to another proposed "complete streets" project that has been submitted to the
SCTPO for possible funding assistance — the North Atlantic Avenue Streetscape Project.
The estimated construction time to complete the "complete streets" tasks along Central
Boulevard from Thurm Boulevard eastward to Ridgewood Avenue is eighteen (18)
months.
Completion of this additional "complete streets" project will allow City residents
(pedestrians, bicyclists, and vehicular traffic) to easily travel to (1) the City's oceanfront
neighborhood (Atlantic Ocean beach), (2) recreational facilities at two City parks
(Manatee Park and Banana River Park) along the Banana River Aquatic Preserve, and (3)
the many amenities of Port Canaveral and Cocoa Beach. Completion of this "complete
streets" project will also meet several major objectives of the City's Vision Statement
including that the City will be a "bike -able and walk -able ...... and sustainable coastal
community that embraces the beach and riverside as its main amenities."
Land Use. Land use in the western portion of the proposed project area (west of SR
AIA) is residential. Large residential developments (Bayside Townhomes/
Condominiums and Puerto del Rio Condominiums) and a large resort hotel (Radisson
Resort at the Port) are present. Two City parks are also located along the Banana River
Aquatic Preserve to the southwest and northwest of the proposed project. Land use in the
central portion of the proposed project area (between SR AlA and North Atlantic
Avenue) is residential, industrial and commercial. Industrial and commercial facilities are
located along both sides of the roadway — residential properties and vacant lots are
located near North Central Boulevard. One of the residential areas -- the Oak Manor
Trailer Park — is the future location of Cape Canaveral's Town Center. Land use in the
eastern portion of the project area (east of North Atlantic Avenue) is primarily residential
consisting of single-family residences.
Previous Studies. Several studies have been completed in the proposed project area. The
City's contractor, Ardaman and Associates, Inc., has performed a geotechnical
investigation of subsurface roadway conditions on West Central Boulevard west of SR
AIA. Results of this investigation have been used to develop a scope of work for road
repairs for West Central Boulevard, which will be partially funded by the ALF developer.
Other studies conducted along the Central Boulevard corridor include (1) a traffic study
to estimate traffic flow after construction of the ALF and (2) a sanitary sewer study to
estimate sewer flows after construction of the ALF. Only preliminary planning and
design studies have been completed for the proposed Central Boulevard Streetscape
Project,
Project Coordination. The proposed project will be coordinated with St. Johns River
Water Management District (SJRWMD) to investigate the possibility of constructing
stormwater improvements on Central Boulevard. Improvements would possibly include
new stormwater inlets, installation of exfiltration pipes, etc. Opportunities to coordinate
with or augment other community improvement initiatives will be investigated during the
detailed planning and design process.
Benefits of Modal Improvements. The proposed project includes numerous modal
improvements including the following:
• Possible extension of public bus service (Route #9 operated by SCAT) to the
Central Boulevard corridor — Route #9 services Cape Canaveral and Cocoa Beach
and is one of SCAT's most popular ridership routes;
• Improved access for bicyclists to City parks located along the Banana River
Aquatic Preserve and the Atlantic Ocean beach by the construction of bike lanes
along Central Boulevard;
• Improved pedestrian access to City parks located along the Banana River Aquatic
Preserve and the Atlantic Ocean beach by the construction of a pedway and new
sidewalks;
• Improved access to exercise facilities for the residents of the proposed ALF ---
Manatee Park contains a fitness trail with exercise stations;
• Improved lighting conditions (safety) for pedestrians and bicyclists along the
entire Central Boulevard corridor; and
• Construction of significant roadway improvements, which will be partially funded
by the developer of the ALF, will benefit vehicular traffic.
Coordination with Adjacent Jurisdictions. The City will work closely with Florida
Department of Transportation (FDOT) since this project will connect with State Road
AIA. No other jurisdictions are located within the proposed project area — West/East
Central Boulevard, North Atlantic Avenue and Thurm Boulevard are City -owned
roadways.
Other Significant Information - Cape Canaveral Vision Statement:
We envision: A bike -able and walk -able Cape Canaveral that retains and enhances its
residential feel, characterized by low-rise buildings not more than four stories in height.
This residential and business friendly atmosphere is one of a live -able, attractive, safe,
secure, and sustainable coastal community that embraces the beach and riverside as the
main amenities, and supports local culture and education.
We envision: A 1 A as a "complete street" with a native -landscaped and tree -lined median
with traffic calming elements and dark -sky street lighting. "Complete street" amenities
include bicycle facilities, covered transit stops, and safe pedestrian crossings that invite

City's Vision Statement: "We envision ... ... ... as a "complete street" with a native -landscaped
and tree -lined median with traffic calming elements and dark -sky street lighting. "Complete
street" amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings
that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and
adjacent communities. Our improved "complete streets" will allow us to calmly travel to
intimate waterfront destinations and a walk -able downtown core. Multi -use paths lined with
shade trees should be wide enough for bikes and pedestrians and lighted so anyone can walk or
bicycle safely anywhere in town, day or night. " The City's Vision Statement was developed as a
result of six public workshops conducted in 2009. The visioning process was coordinated with
the East Central Florida Regional Planning Council and was directed by Mr. Phil Laurien,
MCP, The Vision Statement developed during the visioning process has been adopted by the City
Council. A Narrative Addendum for the Project and the City's complete Vision Statement are
included as Attachment 92.

The City of Cape Canaveral is LAP -certified. The City recently completed the Ridgewood
Avenue Streetscape Project through the LAP Process. The Project also included the acquisition
and expenditure of Federal stimulus funds through FDOT tinder the American Recovery and
Reinvestment Act. The City's consulting engineer will assist in the design of the Project -
construction work for the "complete streets" amenities will be publicly hid to local general
contractors.

Although the North Atlantic Avenue Streetscape Project has not been specifically approved by
the City Council, the Project is in accordance with the adopted goals and objectives of the City
Council as well as the City's Vision Statement. The Project will be presented to the City Council
at a future date for approval and the formal appropriation of City funds.
(c) Describe any special characteristics or features of the project.
The proposed North Atlantic Avenue Streetscape Project is a "complete streets" project for a
major north -south corridor through the City. The project extends from SR AIA northward to
near George King Boulevard in Port Canaveral. This proposed project specifically involves
work per formed along both sides of North Atlantic Avenue (6,500 feet in length). Some of these
tasks include the following:
• Construct an 8 -foot wide pedway along the western side of the roadway;
• Construct a 5 -foot wide sidewalk on the eastern side of the roadway;
• Construct a stormwater system (exfiltration piping) beneath the pedway for the
northern 75% of the roadway;
• Install solar powered lighting along both sides of the roadway (improved safety);
• Plant native vegetation "islands " along the roadway; and
• Install pedestrian benches along the sidewalks.
With funds provided by the City/Space Coast Transportation Planning Organization, this
"complete streets" project will extend from SR A]A to Port Canaveral and will connect with
another "complete streets " project (Central Boulevard Streetscape Project). A Narrative
Addendum with additional information is included as Attachment #2.
(d) If this is a non -State Road or bridge, or a bicycle or pedestrian path to be located outside of State
Right -of -Way, include a letter of support from the City and/or County Mayor/Chairman,

North Atlantic Avenue Streetscape Project

Scope of Work. The proposed scope of work includes the completion of "complete
streets" tasks along North Atlantic Avenue from SR AIA northward to Port Canaveral
(near George King Boulevard). This proposed project specifically involves work
performed along both sides of North Atlantic Avenue (6,500 feet in Iength). Some of
these tasks include the following:
Construct an 8 -foot wide pedway along the western side of the roadway;
• Construct a 5 -foot wide sidewalk on the eastern side of the roadway;
• Construct a stormwater system (exfiltration piping) beneath the pedway for the
northern 75% of the roadway;
• Install solar -powered lighting along both sides of the roadway (improved safety);
• Plant native vegetation "islands" along the roadway; and
• Install pedestrian benches along the sidewalks.
North Atlantic Avenue was recently paved; therefore, no pavement improvements are
required. New curbing and a stormwater system may be constructed, but should not cause
any disruption to the existing pavement. This "complete streets" project will extend from
SR AIA to Port Canaveral and will connect with another proposed "complete streets"
project (Central Boulevard Streetscape Project).
Community Benefits. The proposed North Atlantic Avenue Streetscape Project is part of
a comprehensive "complete streets" program developed by the City. The Ridgewood
Avenue Streetscape Project was recently completed along the City's beachfront
neighborhood. The project includes many "complete streets" amenities including: a
pedway, new sidewalks, traffic calming devices, solar -powered lighting, native
vegetation "islands", etc. This proposed North Atlantic Avenue Streetscape Project is in
addition to another proposed "complete streets" project that has been submitted to the
Space Coast Transportation Planning Organization (SCTPO) for possible funding
assistance — the Central Boulevard Streetscape Project.
The estimated construction time to complete the "complete streets" tasks along both sides
of North Atlantic Avenue is eighteen (1 S) months.
Completion of these additional "complete streets" projects will allow residents
(pedestrians, bicyclists, and vehicular traffic) to easily travel to (1) the City's oceanfront
neighborhood (Atlantic Ocean beach), (2) recreational facilities at two City parks
(Manatee Park and Banana River Park) along the Banana River Aquatic Preserve, and (3)
the many amenities of Port Canaveral and Cocoa Beach. Completion of these "complete
streets" projects will also meet several major objectives of the City's Vision Statement
including that the City will be a "bike -able and walk -able ...... and sustainable coastal
community that embraces the beach and riverside as its main amenities."
Land Use. Land use in the area is a mix of residential and commercial. The southern
portion of the streetscape project area consists mainly of commercial facilities (i.e., auto
mechanic shops, strip malls, etc.). The northern portion of the project area consists
mainly of large, multi -family buildings (i.e., condominiums and townhomes). North
Atlantic Avenue is a heavily -travelled roadway with significant truck and automobile
traffic. With the exception of State Road AIA, North Atlantic Avenue is the most -
travelled north -south roadway within the City. Therefore, the construction of traffic -
calming devices to minimize speeding and improve traffic flow is a key portion of the
proposed streetscape project scope of work. In addition, completion of the North Atlantic
Streetscape Project will greatly improve access to the many amenities of Port Canaveral
for pedestrians, bicyclists, and vehicular traffic.
Previous Studies. Conceptual planning and design studies for the streetscape project
have been completed by the City's landscape architect, Brad Smith & Associates. A
public workshop was also conducted to obtain input from the local community.
Comments from the public during the workshop have been included in a series of
conceptual drawings for the project. These conceptual drawings will be used by the
City's engineering firm to develop construction drawings and specifications for the
project construction work.
Project Coordination. The proposed project will be coordinated with St. Johns River
Water Management District (SJRWMD) since the scope of work includes the
construction of a stormwater management system beneath the proposed pedway. In
addition, a grant application will be submitted to Florida Department of Enviromnental
Protection (FDEP) to solicit funds from the EPA 319(h) Program (stormwater
management grants program). Other possible stormwater improvements on North
Atlantic Avenue include new stormwater inlets, installation of additional exfiltration
pipes, etc. Opportunities to coordinate with or augment other community improvement
initiatives will be investigated during the detailed planning and design process.
Benefits of Modal Improvements. The proposed project includes numerous modal
improvements including the following:
• Improved access for bicyclists and pedestrians to Port Canaveral by the
construction of a pedway along the western side of the roadway and a new
sidewalk on the eastern side of the roadway;
• Improved connection with Port Canaveral's bike lanes, pedways, and sidewalks;
• Improved access for bicyclists and pedestrians to Central Boulevard and the
Atlantic Ocean beach as well as the future City Center by the construction of a
pedway along the western side of the
eastern side of the roadway;
Improved lighting conditions (safety)

roadway and a new sidewalk along the

the City to Port Canaveral.
Coordination with Adjacent Jurisdictions. The City will work closely with the
Canaveral Port Authority since this project will connect with Port property (near George
King Boulevard). The City will also work closely with Florida Department of
Transportation (FDOT) since this project will connect with State Road AIA. No other
jurisdictions are located within the project area — North Atlantic Avenue and numerous
side streets are City -owned streets.
Other Significant Information - Cape Canaveral Vision Statement:
We envision: A bike -able and walk -able Cape Canaveral that retains and enhances its
residential feel, characterized by low-rise buildings not more than four stories in height.
This residential and business friendly atmosphere is one of a live -able, attractive, safe,
secure, and sustainable coastal community that embraces the beach and riverside as the
main amenities, and supports local culture and education.
We envision: AIA as a "complete street" with a native-Iandscaped and tree -lined median

Summary: Staff and the P&Z Board have consistently interpreted the City Code to
allow for the provision of parking spaces within the building setback. This is evidenced
by the numerous residential and commercial projects that have been approved and
constructed with parking in the setback. However, during the May 4, 2011 P&Z Board
meeting, Staff was made aware of a section of the Code that appears to conflict with the
way it has traditionally been interpreted and applied. Therefore, Staff is proposing
Ordinance No. 04-2011 which revises the Code to reflect how it has been interpreted in
the past and clarify that parking spaces, access drives and aisles, and dumpster areas
are permitted within setbacks. The P&Z Board reviewed the proposed Ordinance at its
May 25, 2011 meeting and recommended approval.
Planning and Zoning Board Recommendation: The Board heard the request on May
25, 2011 and recommended approval to the City Council.
Staff Recommendation: Staff recommends adopting Ordinance No. 04-2011 to clarify
that parking spaces, access drives and aisles, and dumpster areas are allowed within
the building setback as has been the interpretation of Staff and the P&Z Board for many
years.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, FLORIDA, AMENDING CHAPTER 110 ZONING,
RELATED TO SETBACKS; PROVIDING FOR THE REPEAL OF PRIOR

WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the
State Constitution, to exercise any power for municipal purposes, except when expressly
prohibited by law; and
WHEREAS, Florida Statutes Chapter 163, Local Government Comprehensive Planning
and Land Development Regulation Act provides for the ability of the City of Cape Canaveral to
plan for its future development and growth and provide necessary regulations for same; and
WHEREAS, the City Council finds a need to modify the City Code to permit parking
spaces, access drives and aisles, and dumpsters within setbacks; and
WHEREAS, the City of Cape Canaveral Planning and Zoning Board has reviewed the

Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent
ordinances and resolutions adopted by the City Council, or parts of prior ordinances and
resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Cape
Canaveral City Code and any section or paragraph, number or letter, and any heading may be
changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and
like errors may be corrected and additions, alterations, and omissions, not affecting the
construction or meaning of this ordinance and the City Code may be freely made.

Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision
of this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be
deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section b. Effective Date. This Ordinance shall become effective immediately upon adoption
by the City Council of the City of Cape Canaveral, Florida.
