AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, AMENDING SUBSECTION (A) OF SECTION
253.02, LIBRARY BOARD OF THE CODE OF ORDINANCES OF THE
CITY OF CAPE CANAVERAL TO PROVIDE THAT EACH MEMBER OF THE
LIBRARY BOARD SHALL BE A REGISTERED VOTER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING
ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. Section 253.02, Library Board Subsection (A) , of
the Code of Ordinances of the City of Cape Canaveral is hereby
amended to read as follows:
Sec. 253.02. Library Board
(A) There is hereby created a Library Board to consist
of five (5) members and two (2) alternate members. Such
membership shall serve at the pleasure of the City Council and
shall be appointed for two (2) year terms by the City Council.
The terms shall expire in the month of October of each year.
The Board shall hold an organizational meeting at their
November meeting each year and from their permanent membership
elect a chairman who shall hold office for a period of one
year. Each Board member shall be a resident of the City for
at least twelve (12) months immediately preceding appointment.
Each Board member shall be a registered voter.
SECTION 2 . Severability. If any section, paragraph, phrase,
or word of this Ordinance is held to be unconstitutional or
invalid, such portion shall not affect the remaining portions
hereof and it shall be construed to have been a legislative intent
to pass this Ordinance without such unconstitutional or invalid
part.
SECTION 3. Conflicting Provisions. Any ordinance, or parts
of an ordinance, in conflict herewith are repealed.

SECTION 4. Effective Date. This ordinance shall take effect
immediately upon its adoption.
ADOPTED BY the City of Cape Canaveral, Brevard County,
Florida, this 4th day of January 1994.
