Mayor Randels announced to attendees who were present for Item No. 13 that the item
would be tabled until the next scheduled City Council meeting. Mr. Boucher responded to
Mr. Petsos that there was discrepancy over an item that needed staff review.
Mayor Randels noted the passing of Mr. William Bennix a long time City resident and local
developer and builder. He acknowledged Mr. Bennix's contributions to the Cape
Canaveral Volunteer Fire Department and City beautification efforts.
PRESENTATION:
Holiday Beautification Awards
Mayor Randels called on Ms. Mary Jo Laws, Beautification Board Chairperson, to present
the awards. Mayor Randels proposed to take and submit photos to the local newspaper.
Ms. Laws recognized Mr. and Mrs. Pete Nicks in the Single -Family category. The Nicks
were not in attendance and their award will be forwarded. She presented an award to Ms.
Joanne Smally in the Multi -Family category. Ms. Smally acknowledged the efforts of all

families involved in the decorating. Ms. Laws then presented an award to Mr. Ed Laquori
from Tip -A -Few Tavern in the Commercial category. Ms. Laws expressed the Board's
appreciation to the winners.
Mayor Randels acknowledged the gift of a ceramic peacock from Ms. Collette Cannon.
Ms. Cannon stated that she would like to see the peacock as the City of Cape Canaveral
official bird. Mayor Randels presented the gift to the City Manager and then read Ms.
Cannon's letter that expressed her thoughts on the history of peacocks in the community.

Mayor Randels asked if any Council member, staff or interested party desired to remove

A motion was made by Mr. Morgan and seconded by Mr. Petsos to Approve
Consent Agenda Items No. 1 through 8. The vote on the motion carried 5-0 with

Mayor Randels explained the Council's review based on the Planning and Zoning Board's
recommendation. He reviewed all other items in the checklist as: Mr. Todd Peetz noted
for Mr. Ray Osborne that no historical artifacts were found on the site. Mr. Morgan
commented that the 37.5 feet for construction on each lot was spacious. Mr. Osborne
asked what resource was used and in what year the survey took place. Mr. Peetz replied
that the State Historical Resources Master Site File for the County was used. He replied
to Mr. Osborne that the survey might have been performed in the 1950's or `60s. Mr.
Peetz replied that there are resources on historical matters through a liaison in Brevard
County and the State Division of Historical Resources in Tallahassee. He stated that only
shell bins were noted and these are not of historical value.
Mr. Osborne informed that he visited the Bureau of Archeological Review in Tallahassee
and he reviewed the Master File. He stated that a report establishes a large village
compound somewhere in the area is yet unfounded. Mr. Osborne reported that a crystal
necklace and some copper artifacts were found as well as a round circular wall. He
affirmed to Mayor Randels that some of these artifacts were found within the City limits in
the Artesia area and a mound just south of that location. Mr. Morgan stated that these are
noted in the City's Comprehensive Plan.
A motion was made by Mr. Morgan and seconded by Mayor Pro Tem Hoog to
Approve the Final Replat for Chadwick Townhomes. The vote on the motion carried
5-0 with voting as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, For; Mr.
Nicholas, For; Mr. Petsos, For and Mayor Randels, For.
10. Motion to Approve: Preliminary Replat, Beroja Palms, Ron Wallen, Applicant.
Mr. Morgan asked that Item No. 10 be postponed at the request of the applicant.
Mayor Randels returned to Item No. 10 after discussion on Item No. 11. He explained that
the Council's task was to review what the Planning and Zoning Board recommended. He
noted the 14.28 density. Mayor Randels stated that all concurrency was performed. Mr.
Morgan disclosed that he completed a Voting Conflict of Interest Form due to his financial
interest in the project. Mayor Randels established that the project is located on the south
side of Lincoln Avenue and met with the City's standard requirements and staff review.
Mayor Pro Tem Hoog also asked to abstain from voting on the project due to financial
interest.
A motion was made by Mr. Petsos and seconded by Mayor Randels to Approve the
Preliminary Replat for Beroja Palms. The vote on the motion carried 3-0 with voting
as follows: Mayor Pro Tem Hoog, Abstain; Mr. Morgan, Abstain; Mr. Nicholas, For;
Mr. Petsos, For and Mayor Randels, For.

ORDINANCES: Second Public Hearing:
11. Motion to Adopt: Ordinance No. 21-2005; Amending Chapter 102, Article ll.,
Division 2; Providing Land Clearing Criteria for Land that Contains or that will
Contain Single Family, Two -Family or Three Family Residential Dwelling
Units, at second reading.
Mayor Randels read Ordinance No. 21-2005 by title.
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA, AMENDING CHAPTER
102, ARTICLE II, DIVISION 2 OF THE CODE OF ORDINANCES RELATING TO LAND
CLEARING FOR SMALL SCALE EXISTING AND NEW RESIDENTIAL DEVELOPMENTS
SUCH AS SINGLE FAMILY UNITS, DUPLEXES, TRIPLEXES AND SUBDIVISIONS OF
THREE (3) OR FEWER SINGLE FAMILY UNITS; PROVIDING FOR THE REPEAL OF
PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; INCORPORATION INTO
THE CODE; SEVERABILITY; AND AN EFFECTIVE DATE.
Mayor Randels noted that the Ordinance was advertised on December 13, 2005 in the
Florida Today, there was a first reading on December 6th and also on November 15, 2005
and it was approved by the Planning and Zoning Board. Mayor Randels clarified that the
Council was addressing the Vegetation Ordinance, Section 102 of the City Code, Article II
subsequent land clearing and specifically 102.40.5(b)(2) which read "Upon receipt of a
completed application, the building official shall not apply the requirements set forth in
Section 102-40 and shall issue a land clearing permit authorizing the removal or clearing
of any trees located within the footprint of any structure approved by a City development
order.
Mayor Randels explained further that this language in the proposed ordinance required the
Building Official to issue a land -clearing permit regardless of the situation.
This amended ordinance withdrew some of the proposed language and added a new
Section 120.40.5 to address small-scale residential dwelling units, permit requirements,
requirements for the tree located within the footprint, tree survey requirements, tree
replacement guidelines and maintenance requirements. Mayor Randels stated that the
Council's intent in the ordinance is: 1) committed to preserving, enhancing and creating
green area within the City, 2) by assuring the preservation of existing trees on public and
private property and taking steps to require maintenance of existing and installation of new
trees within the City and 3) to provide separate and distinct land clearing regulations for
land which contains small scale existing and new residential developments such as single
family.
Mr. Ray Osborne stated that this was the ordinance in which he was suggesting an
amendment of an archeological addition. He inquired of staffs research regarding
regulations on artifacts. Attorney Garganese replied in response to Mr. Osborne's inquiry
at the previous meeting, research was conducted and Attorney Garganese recommended
that the Council not change this particular ordinance to add additional language regarding

archeological resources. He reasoned that there are Federal Regulations that address
documenting archeological resources and the Federal regulation was cited as well as the
penalties for violating the Federal law. The State also has regulations to preserve
archeological resources including unmarked burial grounds where human remains exist
which include notifying a Medical Examiner and documentation. Further, the City already
has a Comprehensive Plan policy in the Future Land Use Element which provides that the
City I maintains a list of archeological sites to crosscheck against locations of proposed
development before the City issues development orders. He concluded that there is a fair
amount of Federal, State and local oversite regarding archeological artifacts. He reminded
that the Council could revisit the issue during the upcoming Land Development review
process.
Mr. Nicholas asked if there were any language on the permit application to address this
issue. Mayor Randels asked Mr. Peetz if addressing artifacts were part of the permitting
process. Mr. Peetz affirmed and stated that Majestic Bay was the only development that
came near the triangular icons in the Comprehensive Plan that denote archeological
areas. Mr. Peetz replied to Mayor Randels that the Building Department is aware of any
archeological sites. Mr. Osborne stated that his intent was to encourage developers to set
aside any potential artifacts and photograph them.
Mayor Randels read from the Federal Regulation that, "no such article shall be treated as
an archeological resource unless it is 100 years old." Mayor Randels asked Mr. Osborne
for a plan on how to retain any artifacts. Mr. Morgan suggested that Mr. Osborne post an
informational flyer for developers at City Hall. Mr. Osborne asked Todd Peetz if the
archeological survey could be updated. Mr. Peetz explained that topography maps are
used and shorelines were a part of the survey due to where the Indians would reside;
however he was not sure of the survey's extent. Mr. Osborne informed that he spoke to
Mr. David Dickle in Tallahassee, an archeologist who said that native inhabitants preferred
to live where people currently reside.
Mr. Lamar Russell expressed concern with the City's subsequent action to an
archeological find. He stated that several archeological areas were already identified. Mr.
Morley responded that he did not know what happened up to this point; however, there are
Federal Regulations that apply. Mr. Russell emphasized that the City should know what
has occurred up to this point. Mr. Morgan read from the Federal Regulation that
specifically protects archeological resources. Mr. Russell stated that the City should have
some safeguards in place before the Federal Laws come into play. He stated further that
he was not hearing a definitive response on how the City would proceed if an artifact is
found. Mayor Pro Tem Hoog asked what happens when property is purchased and a
burial mound is found. Mayor Randels read from Florida Statutes 253.07 that provides for
emergency land acquisition by the State on which archeological artifacts are found.
Attorney Garganese replied to Mayor Pro Tem Hoog that when human remains are found,
under Florida Law, a developer must immediately contact Law Enforcement, contact the
State Medical Examiner, have a review by State Archeological representatives, and have

the police cross-check their files for missing persons. Attorney Garganese reiterated that
the State has budgeted funds in order to purchase property where human remains are
found. Mr. Petsos replied to Mayor Randels' questions that Windover Farms was
purchased when skeletal remains were found. Development ceased and the State worked
with the developer and what was not an archeological find continued in development. Mr.
Osborne inquired about an updated archeological survey. Mr. Boucher replied that the
City would update the Comprehensive Plan in the coming year that would include updated
archeological information. Mayor Randels concluded that the City could adopt the State's
updated plan.
A motion was made by Mr. Petsos and seconded by Mayor Pro Tem Hoog to Adopt
Ordinance No. 21-2005 at second reading. The vote on the motion carried 5-0 with

RESOLUTIONS:
12. Motion to Adopt: Resolution No. 2006-04; Florida League of Cities Legislative
Priorities.
Mayor Randels read Resolution No. 2006-04 by title.
A RESOLUTION OF THE CITY OF CAPE CANAVERAL URGING MEMBERS OF THE
FLORIDA LEGISLATURE TO SUPPORT THE FOLLOWING ISSUES DURING THE 2006
LEGISLATIVE SESSION.
Mayor Randels stated that the Florida Legislature support legislation as part of a
comprehensive legislature reform package that: 1) Preserves municipal autonomy and
protects the fundamental right of voluntary self-government, 2) Provides municipalities
alternative funding options for the purpose of responding to impacts of declared disasters;
3) Preserves municipal tools for community redevelopment and urban revitalization, 4)
Provides a dedicated and recurring revenue source for municipal transportation projects,
5) Preserves dedicated funding for local affordable housing programs, 6) Provides for an
equitable distribution of fines and fees from criminal violations such as driving under the
influence of alcohol or other chemical substances, and 7) Provides a comprehensive and
uniform workers' compensation system. Mayor Randels summarized that this resolution
endorses Home Rule for cities.
Mr. Lamar Russell commented on Municipal Home Rule and noted that in the aftermath of
Hurricane Katrina the Governor and Mayor of New Orleans did not appear to understand
the powers of Municipal Home Rule and Federal Funding. Mr. Russell stated that the
Federal Emergency Management Agency [FEMA] and the Federal government have
funds and resources to assist in recovery and he asked if Home Rule would become a
discussion topic, or would the Agency be allowed to enter the City and perform recovery
efforts. He challenged the City to welcome the Federal Government in for recovery efforts.

Mayor Pro Tem Hoog stated that one of the provisions in the Resolution is that the
municipalities are provided alternative funding options for the purpose of responding to
impacts of declared disaster and alternative funding is FEMA assistance.
Mr. Russell shared his concern that the City Council would not engage in an argument
with a federal funding agency and hinder emergency efforts such as was done in the New
Orleans and Louisiana recovery efforts. Mayor Randels replied that Cape Canaveral
responded immediately in a most recent hurricane and the City was reimbursed with
FEMA funding. He explained further that Contingency Funding has been set aside to
assist in emergency situations.
Mr. Russell expressed his confidence in Florida legislators in recovery efforts. Mr. Boucher
explained that in a declared disaster each city submits its request through the Brevard
County Emergency Operations Center and that request is forwarded to Tallahassee for
recovery response. Mr. Russell informed that in an East Texas recovery effort he heard
arguments within chain -of -command; however, the responses he heard to his concerns
from staff and the Council were acceptable. Mayor Pro Tem Hoog concluded that the
priorities list is a summation and is derived from the cities around the State and some of
the items would not apply to all cities. The list is a supportive effort among the cities.
Mayor Randels provided Mr. Ray Osborne a copy of the list.
A motion was made by Mayor Pro Tem Hoog and seconded by Mr. Petsos to Adopt
Resolution No. 2006-04. The vote on the motion carried 5-0 with voting as follows:

SITE PLANS:
13. Motion to Approve: Canaveral Bulk Storage Site Plan, Randy May, Applicant.
This item will be tabled until the City Council meeting of January 17, 2005.
14. Motion to Approve: Site Plan for Sea Shell Cay Townhomes, James Morgan,
Applicant.
Mayor Randels stated that the Planning and Zoning Board approved the Site Plan with the
following four conditions: 1) to add an easement to the final plat for access to Lot 3 to
North Atlantic Avenue, 2) to meet the condition of the public works director for sewer
connection, 3) to provide a St. John's River Water Management District permit/exemption
for drainage and 4) for the City Engineer to review stormwater calculations provided by the
applicant. Mr. Morgan disclosed that he completed a Voting Conflict of Interest Form with
the State due to his ownership of the property.
Mayor Randels acknowledged a letter dated on December 19th from All Shores
Development to request permission to remove a specimen tree along with City Council's

review of the Site Plan. Mayor Randels explained that any trees larger than 24 -inches
depth/ breast diameter must be discussed with the Council before removal. Mr. Petsos
asked if there was any discussion with the Planning and Zoning Board to move the
building within the setback. Mr. Morgan replied that discussion occurred with the Building
Official. Some discussion followed on moving the building. Ms. Bea McNeeley, Planning
and Zoning Board Chairperson, replied that the Board did not address moving the building
within the footprint.
A resident stated that there is a 20 -foot public easement that traverses north to south
between the first and second lot and the tree is on the easement. Mr. Gardulski replied to
Mayor Randels that he was not aware of a public easement. Mr. Morley stated that he
also was unaware of any easements. Mr. Morgan requested to see the easement. Mr.
Lamar Russell stated that since new knowledge was before the Council, would the Council
consider returning the item to the Planning and Zoning Board for further review. Mr.
Morgan stated that he preferred to research for a public easement through County
records. Attorney Garganese requested to table the item and to have the City ownership
and encumbrance report. Mayor Randels requested that the resident contending the
public easement submit that information to the City and the City would also order the
encumbrance report.
Ms. Martha Carroll reminded the Council to return to address the specimen tree removal
first discussed. She stated that the ordinance addressed tree protection and she desired
to see the ordinance used and trees preserved. Mr. Morgan concluded that the building
was designed prior to the ordinance's development.
A motion was made by Mr. Nicholas and seconded by Mr. Petsos to Table the Site
Plan for Sea Shell Cay Townhomes. The vote on the motion carried 4-0 with voting
as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, Abstain; Mr. Nicholas, For; Mr.
Petsos, For and Mayor Randels, For.
DISCUSSION:
15. C-1 Low Density Commercial District.
Mayor Randels stated that he initiated this item for discussion. He acknowledged a new
Ron Jon's Resort at the City's entrance and noted the number of surf shops in the Cocoa
Beach area. Mayor Randels asked if there were any interest in setting limitations on retail
shops. He read from the City Code Section 110-334 that establishes where service
stations and vehicle rental facilities shall be located. Mayor Randels expressed his
concern with a proliferation of surf shops. Mr. Petsos also expressed concern with a
growing number of tourists and t -shirt shops. The Building Official stated that the City
allows for Special Exceptions in commercial districts. Mayor Pro Tem Hoog said that he
did not desire to see additional retail surf shops along the State Road A1A corridor. Mayor
Randels noted seven within a three -block area in Cocoa Beach. Attorney Garganese
stated that data, analysis and rationale were needed to establish municipal purpose.

Ms. Kathy Reakes questioned limiting the distance on retail stores which might create a
monopoly for Ron Jon's. Mayor Randels replied that the City was successful in limiting the
distance requirements. Mr. Osborne asked if commercial districts were higher in impact
fee revenues that would benefit the City infrastructure. Mayor Randels replied that a
former Council decided on a minimum of 150 units on a five -acre parcel. He stated that the
success of the distance requirement is that it is uniformly applied. Mr. Petsos asked if this
item could proceed to the Planning and Zoning Board for further review. Mr. Nicholas
questioned the effect of the new Cape Caribe construction in Port Canaveral and inquired
about the mechanism to address concurrency issues. Mr. Petsos stated that there are no
currency requirements in the Port and he suggested that the issue proceed to the
Legislative Delegation.
Mayor Randels explained to a resident with a question on growth on North Atlantic Avenue
that each developer who applies for a building permit must meet concurrency
management standards. Mr. Ray Osborne pointed out that emergency management
issues presented evacuation problems that affect transportation. Mayor Randels replied
that evacuation is noticed with enough time to leave. Mayor Randels replied to questioning
that the City could only widen North Atlantic Avenue on land that it owns.
Further discussion brought out the need for a regional study and a presentation from the
Port.Mr. Peetz said that Brevard County, Cocoa Beach and the State Legislators should
be included in any future discussion. Mayor Randels replied to Ms. McNeeley that the
State of Florida approved the Foreign Trade Zone as a Special Taxing District. Mr. Peetz
stated that a request could be made to the Florida Department of Community Affairs to
determine capacity due to regional impact. Mr. Boucher referred to the main issue of
discussion and reminded Council on the City's mission of a residential community that
would change proportionally with tourist related industries.

January 17th prior to the Regular Meeting.
• Mr. Boucher informed that the Planning and Zoning Board requested a Joint
Workshop Meeting with City Council to discuss the City Planner's density study
as well as the C-1 Moratorium on State Road Al A.
• Mr. Boucher reported that the Florida League of Cities conducts City Board
Member seminars. He would schedule a seminar in February.

AUDIENCE TO BE HEARD:
• Mr. Todd Peetz replied to Mr. Ray Osborne's concerns on an upcoming Special
Exception for the Board of Adjustment. Mr. Osborne stated that the letter
outlined his concerns that the plan was not compliant with the City Comprehensive
Plan, public safety concerns and it did not address affordable housing or smart
growth initiatives. Attorney Garganese explained that a person could not appeal a
recommendation to the Planning and Zoning Board. Any appeals could be
presented to the Board of Adjustment. Mayor Randels stated that Mr. Osborne's
letter would be attached to the Board of Adjustment packets for their upcoming
meeting.
• A resident questioned the peak hours for North Atlantic Avenue. Mr. Peetz
replied that 7:30 A.M. to 9:30 A.M. are the morning hours and 4:30 P.M. to 6:30
P.M. are the evening hours. He replied to Ms. Reakes that the Florida Department
of Transportation sets peak hours. Mr. Peetz replied that North Atlantic Avenue is a
County road that meets the State standards for Level of Service. Mr. Boucher
stated that the City receives a quarterly concurrency management report for all new
development. Residents in attendance expressed concern that the North Atlantic
corridor is being overbuilt. Mr. Boucher replied that widening the road and limiting
curb accesses were some traffic assessment results.
• Mr. Niko Valestrieri and his mother expressed concern that the school bus
destined for Cocoa Beach High School is late due to traffic congestion on
North Atlantic Avenue. Mayor Randels replied to Mr. Valestrieri that the most
recent traffic survey was performed in July 2005. Mr. Lamar Russell informed that
15 years ago the Planning and Zoning Board discussed traffic concurrency levels
on North Atlantic Avenue. He stated that with foresight the Board reasoned that as
development progressed the traffic levels would increase and Level E became the
accepted Level of Service.
• Mr. Ray Osborne invited all to the History of Cape Canaveral Seminar on
January 21" from 1:00 to 3:00 P.M. at the Cape Canaveral Library. Speakers
include: Mr. Ralph Kennedy, Mr. Roger Dobson, Mr. Chuck Reid, Mr. Sonny Witt
and the Vice President and Chief Financial Officer of Cape Canaveral's Hospital to
talk about its history.
• Ms. Valestrieri expressed that she was concerned with special exceptions for town
houses and her concern with the townhomes proposed on Sea Shell Lane.

Mr. Nicholas
Mr. Nicholas referred to the monies in the Library and Beautification Funds.
Mr. Boucher affirmed that the funds are carryovers from previous years. He would
make the Boards aware of the available funds.
• Mr. Nicholas informed that at a previous Beautification Board meeting a Son of the
American Legion member requested that a tree be planted in memorial;
however, he stated that they are asking the City to pay for the tree. He stated that
he did not choose to see the City pay for the tree and he requested that the City
Manager not authorize the payment. He informed that the VFW could pay for the
memorial and he would bring the matter up at their next meeting.
• Mr. Nicholas informed that he received a call from Mr. Roger Dobson regarding a
partial Certificate of Occupancy for his hotel units. The Building Official stated
that the issue was resolved. He met with Mr. Dobson, Mr. Hermansen and the Fire
Department and explained that the Certificate of Occupancy could be issued based
on the established criteria of completed units. Mr. Morgan and Mayor Pro Tem
Hoog informed that they had also received telephone calls from Mr. Dobson.
Mr. Petsos
• Mr. Petsos inquired about any funds received from the County. He said that the
letter the City received displays the lack of accountability in County budgeting. Mr.
Petsos reported on the County's information of the City's 1.9 percent of the
population and 2.9 percent of the County budget. Mr. Boucher reported that he is
seeking an Auditor General Opinion letter on the County's budgeting standards.
Mr. Petsos replied to Mayor Randels that the Florida Constitution does not allow the
City to be a donor to the County budget. Mr. Petsos's intent is to identify what
funding is returned to the City.
• Mr. Petsos inquired about fireworks discharge. Mr. Boucher will check with
Commander Scragg.
• Mr. Petsos inquired about the sidewalk next to the Radisson property. Mr.
Gardulski would address project status.
• Mr. Petsos requested information on beach re -nourishment as well as the
Federal, State, County and the Port's intentions. Mayor Randels replied that Ms.
Virginia Barker of the Department of Natural Resources is preparing a status letter
for the City Manager.
Mr. Morgan
• Mr. Morgan stated that he agreed with Mr. Petsos' efforts on the seeing the City
tax funding sent to the County returned.
• Mr. Morgan referred to the 3.98 rate on the State Board of Administrators
investment statement and a 3.6 return from RBC Centura. He suggested a short-
term Certificate of Deposit investment in the 4 percent range. Mr. Boucher
stated that this could be done if the banking institution could collateralize the
investment.

transponder bracelets for those with Alzheimer's disease.
• Mayor Randels shared a newspaper article where a Building Inspector from
another city went on an inspection without a ladder.
• Mayor Randels asked about the status of the sidewalk project on Poinsetta
Avenue. Mr. Gardulski replied that the project is near completion.
• Mayor Randels informed that the Friends of the Library collected $3,235. He
asked if the City could partner with the Friends of the Library to purchase a
CD/DVD holder. Council discussion concluded that the Friends of the Library have
funds to pay for needed library equipment.

This is an Amendment to the Contract between the Florida Department of Corrections
("Department") and City of Cape Canaveral ("Contractor") to provide for the use of inmate labor in
work programs.
This Amendment:
• renews the Contract for one (1) year pursuant to Section I., B., Contract Renewal;
• revises the end date of the Contract referenced in Section I., A., Contract Term; and
• replaces Addendum A with Revised Addendum A to update costs associated with the
work squad.
Original contract period: March 12, 2004 through March 11, 2005
Amendment 1: March 12, 2005 through March 11, 2006
In accordance with Section V., Contract Modifications; the following changes are hereby made:
1. Section I., A., Contract Term, is hereby revised to read:
A. This Contract began March 12, 2004 and shall end at midnight on March 11, 2007,
This Contract is in its final renewal year.
2. Pursuant to Section III., Compensation, A., 5, the rate of compensation is amended to reflect the

Center Street Paving Agreement with Benko Construction, Inc.
As part of the Construction Staging and License Agreement between Benko
Construction, Inc. (Berko) and the City of Cape Canaveral (City), Benko has agreed to
pay the City one-third of the cost for the repaving of Center Street — the City will pay
two-thirds of the cost. This ratio was determined by the total linear footage of roadway
that was damaged by Benko during utility construction activities along Center Street.
Staff recommends that the entire roadway be paved and minor repairs be completed to the
roadway.
A low cost estimate of $35,605.70 (see attachment) was received from APAC —
Southeast, Inc. (APAC). Costs quoted by APAC to the City are costs included in APAC's
contract with Brevard County (Bid# 3-06-07), which was awarded to APAC on October
20, 2005. Maath Bennett was in agreement with Benko's one-third cost share of
$12,105.70.
Recommend approval of the Amendment to the Benko Agreement to repave Center
Street and awarding the contract to APAC in the amount of $35,605.70. City share:
$23,500.00 — Benko share: $12,105.70.

UNTIL MARCH 31, 2006; PROVIDING FOR REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Council enacted Ordinance 19-2005 on November 1, 2005 imposing
a 90 -day moratorium on accepting applications and issuing special exceptions under section 110-
334(10) of the City Code regarding residential uses within the C-1 Commercial Zoning District; and
WHEREAS, since the adoption of the moratorium, the Planning and Zoning Board has been
reviewing the appropriateness of residential uses in the C-1 Commercial Zoning District; and
WHEREAS, additional time is required in order to complete the City's review of the
appropriateness of residential uses in the C-1 Commercial Zoning District; and
WHEREAS, pursuant to Section 3 of Ordinance 19-2005, the City may extend the expiration
date of the moratorium 60 days by a majority vote of the City Council at a duly held Council
meeting; and
WHEREAS, the City Council deems that this Resolution is in the best interests of the public
health, safety, and welfare of the citizens of Cape Canaveral.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, THAT:
Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and
correct and hereby fully incorporated herein by reference.
Section 2. Extension of Expiration Date. The expiration date of the moratorium
enacted pursuant to Ordinance 19-2005 is hereby extended for 60 days. The moratorium shall expire
on March 31, 2006.
Section 3. Severability. If any section, subsection, sentence, clause, phrase, word, or

portion of this resolution is for any reason held invalid or unconstitutional by a court of competent
jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate,

Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 5. Effective Date. This Resolution shall become effective immediately upon
its adoption by the City Council of the City of Cape Canaveral, Florida.

ISSUING SPECIAL EXCEPTIONS UNDER SECTION 110-
334(10) OF THE CITY CODE REGARDING RESIDENTIAL
USES WITHIN THE C-1 COMMERCIAL ZONING
DISTRICT; INSTRUCTING THE PLANNING AND ZONING
BOARD TO REVIEW THE APPROPRIATENESS OF
APPROVING FUTURE CITY PERMITS AUTHORIZING
RESIDENTIAL USES IN THE C-1 ZONING DISTRICT AND
TO MAKE A RECOMMENDATION TO THE CITY COUNCIL
ON SAID ISSUE; AUTHORIZING ONE SIXTY (60) DAY
EXTENSION OF THE MORATORIUM TO THE EXTENT
NECESSARY; PROVIDING FOR THE REPEAL OF PRIOR

WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, section 110-334(10) of the City Code currently allows by special exception
single family dwellings, two family dwellings, townhouses, and multiple -family dwellings in the C-1
commercial zoning districts subject to certain restrictions; and
WHEREAS, the City has recently experienced an upsurge in land development pressure
including commercial development along the Al corridor; and
WHEREAS, the City's C-1 zoning districts are primarily located along the AIA corridor;
and
WHEREAS, on September 20, 2005, the City Council was presented preliminary data and
evidence from the City Planner evidencing that numerous special exceptions have been previously
granted by the Board of Adjustment which have authorized residential uses within the C-1 zoning
districts; and
WHEREAS, as a result of this significant residential encroachment into the C-1 commercial
districts, the City Council directed, at the September 20, 2005 council meeting, that a moratorium
be imposed forthwith because the Council has serious concerns regarding the appropriateness of

continuing to allow residential uses within the City's C-1 zoning districts; and
WHEREAS, residential special exceptions may be eroding the City's C-1 commercial
districts and negatively depleting commercial land use opportunities within the City; and
WHEREAS, such residential special exceptions may also be creating incompatible land uses
within the City; and
WHEREAS, the City Council believes that imposing a moratorium on the issuance of
residential special exceptions within the C-1 zoning districts will further the City's goal ofprotecting
its commercial zoning areas while engaging in a comprehensive review of Section 110-334(10) and
its impact on the overall Cape Canaveral community; and
WHEREAS, the City Council has directed the Planning and Zoning Board to conduct a
comprehensive review of Section 110-334(10) of the City Code and to recommend revisions to the
City Council upon completion of this review to the extent necessary; and
WHEREAS, the United States Supreme Court has found that the issuance of temporary
moratoria in order to preserve the status quo while studying the impact that certain development
activities have on an area does not constitute a taking per se; See Tahoe -Sierra Preservation Council,
Inc. v. Tahoe Reg. Planning Agency, 535 U.S. 302 (2002); and
r WHEREAS, it is in the best interests of the City of Cape Canaveral to institute a temporary
moratorium in order to study alternative methods of regulation and mitigation of land clearing within
the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, HEREBY ORDAINS, AS FOLLOWS:
Section 1. Moratorium Established. That the above recitals are adopted as Findings of Fact
which clearly justify the imposition of a ninety (90) day moratorium on accepting applications and
issuing special exceptions in accordance with Section 110-334(10) of the City Code, for any single
family dwellings, two family dwellings, townhouses, and multiple -family dwellings in the C-1
commercial zoning districts along the AIA Highway corridor only. The moratorium enacted
hereunder shall not apply to any application for a special exception under Section 110-334(10) of
the City Code that was filed with the City prior to October 18, 2005.
Section 2. Action to be Taken. During the period of this moratorium, the City of Cape
Canaveral Planning and Zoning Board will review section 110-334(10), and other related provisions
of the code, and will propose new legislation to the City Council to the extent necessary to protect
the C-1 zoning districts for their intended commercial purpose, to promote compatible land uses
within the City, and to preserve and protect the health, safety and welfare of the citizens of the City

of Cape Canaveral.
Section 3. Expiration Date. This ordinance shall expire ninety (90) days after its effective date.
The expiration date of this ordinance may be extended for sixty (60) days by majority vote of the

Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent
ordinances and resolutions adopted by the City Council, or parts of ordinances and resolutions in
conflict herewith, are hereby repealed to the extent of the conflict.
Section 5. Not Incorporated Into Code/Posting . This ordinance shall not be incorporated
into the Cape Canaveral City Code. A copy of this ordinance shall be conspicuously posted at the
front desk at City Hall, and at other public places deemed appropriate by the City Manager.
Section 6. Severability. Ifany section, subsection, sentence, clause, phrase, word or provision
of this ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed
a separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portions of this ordinance.
Section 7. Effective Date. This Ordinance shall become effective immediately upon adoption
by the City Council of the City of Cape Canaveral, Florida.

IDENTIFICATION OF ANNEXATION AREAS
PROJECT PURPOSE: To promote intergovernmental coordination by having
Cities identify areas where annexation may occur and be promoted by the City in
the next ten years.
PROJECT DESCRIPTION: Develop plans and programs to anticipate future
municipal boundaries, City assigned land uses, provisions of services in
annexation areas, and identify any possible land use compatibility or service
delivery issues following municipal annexation.
STRATEGIES:
(1) Identify anticipated future annexation areas
(2) Identify anticipated future land uses in those annexation areas
(3) Assess needed facilities and services to serve the land uses in those annexation
areas
(4) Evaluate land use compatibility issues in anticipated annexation areas
(5) Develop mechanism/process to identify and address land use incompatibility
issues
(6) Develop mechanism/process for public presentation and community
involvement in annexation area proposals
ACTIONS:
➢ By April 2006 - Cities will identify anticipated annexation areas within a ten
year planning horizon, i.e. expected municipal boundaries as of 2016.
➢ May of 2006 - Coalition will identify any conflicts or overlap of annexation
areas. Identify possible need for interlocal agreements between jurisdictions
to resolve these conflicts.
➢ May/June of 2006 - Cities to identify future land uses in the anticipated
annexation areas or provide policies/procedures for assignment of future land
uses.
➢ May/June of 2006 — Coalition to develop a mechanism/procedure to address
and resolve any identified land use compatibility conflicts.
➢ July/August of 2006 — County and/or Coalition to identify any possible land
use compatibility issues following delivery of City anticipated land
uses/policies.
➢ May/June of 2006 — Coalition to develop a mechanism/procedure to address

consider adoption of this at the February 7 meeting.

Coastal Management Element
Objective CM -4:
The City shall develop measures for protection of beaches and dunes, establish construction standards
which minimize the impacts of man-made structures on beach and dune systems, and work toward
restoration of altered beaches and dunes. The measurement of this Objective is the development of such
measures and the extent to which beaches and dunes are protected and/or restored and the development of
standards to minimize the impacts of man-made structures on the beach and dune systems plus the degree
to which the following Policies are implemented.
Policy CM -4.1:
The City shall closely monitor beachfront development to insure to the greatest extent possible that the
dune system is preserved as a natural buffer to storm surge.
Policy CM -4.2:
In areas where beaches and dunes are being eroded, the City shall encourage and support a multi -
jurisdictional approach to stabilization and restoration projects, preferably utilizing native vegetation as the
stabilizing medium.
Policy CM -4.3:
The City shall continue to enforce the coastal construction control line law and shall assure that projects
within its area of jurisdiction abide by the setback requirements, except for existing proiects
incompliance with existing city regulations and as permitted by the Florida Department of
Environmental Protection. The following additional criterion shall apply for structures built
eastward of the Coastal Construction control line.
A) New, redeveloped or repaired structures shall meet or exceed Florida Building Code
wind speed may, as amended.
B) The density for redeveloped or repaired structures shall not exceed pre -
development.
C) The gross square footage for a redeveloped or repaired structures shall not be
increased by more than 25% of original structure and consistent with the land development
regulations.
D) For new and redeveloped structures should be located on the west building setback
line or as far to the west as possible to limit potential exposure.
Policy CM -4.4:
No new construction shall be allowed that threatens the stability of either the dune systems or the beach
itself. Land development projects in beach areas east of S.R.- AlA should provide for dune stabilization
and preservation. In all cases, existing dune vegetation should be preserved to the maximum extent
feasible.
Policy CM -4.5:
The City shall continue to prohibit motorized vehicles from operating on the dune system except in
emergency situations.
Policy CM -4.6:
The City should continue to work with the Canaveral Port Authority actively mitigate impacts of Port
operations on the City's beaches.

The Department has completed its review of the proposed Comprehensive Plan
Amendment for the City of Cape Canaveral, (DCA 05-1), which was received on September 6,
2005. Based on Chapter 163, Florida Statutes, we have prepared the attached report, which
outlines our findings concerning the amendment. It is particularly important that the City
address the objections set forth in our review report so--that-these-issues-can-be successfully - -
resolved prior to adoption. We have also included a copy of local, regional and state agency
comments for your consideration. Within the next 60 days, the City should act by choosing to
adopt, adopt with changes or not adopt the proposed amendment. For your assistance, our report
outlines procedures for final adoption and transmittal.
The City's proposed Amendment 05-1 consists of one text amendment to the Coastal
Management Element to amend Policy,CM-4.3 to allow rebuilding and additional construction
on existing projects seaward of the coastal construction control line (CCCL) jurisdiction that are
in compliance with city regulations and permitted by Florida Department of Environmental
Protection as well as allow for new development within the same area that meets the same
criteria.- The Department identified potential objections to the proposed amendment based on -
the lack of minimizing impacts to development within the Coastal High Hazard Area, and an
internal inconsistency with Objective CM -4 of the Coastal Management Element which requires
the City to develop measures for protection of beaches and dunes, establish construction
standards which minimize the impacts of man-made structures on beach and dune systems, and
work towards restoration of altered beaches and dunes.

163.3184, Florida Statutes, and Rule 9J-11.011, Florida Administrative Code.
Within ten working days of the date of adoption, the City must submit the following to
the Department:
Three copies of the adopted comprehensive plan amendment;
A copy of the adoption ordinance;
A listing of additional changes not previously reviewed;
A listing of findings by the local governing body, if any, which were not included in the
ordinance; and
A statement indicating the relationship of the additional changes to the Department's
Objections,_Recommendations and Comments Report.--- - ---
The above amendment and documentation are required for the Department to conduct a
compliance review, make a compliance determination and issue the appropriate notice of intent.
In order to expedite the regional planning council's review of the amendment, and
pursuant to Rule 9J-11.011(5), F.A.C., please provide a copy of the adopted amendment directly
to Mr. Jeff Jones, Acting Director of the East Central Florida Regional Planning Council.
Please be advised that the Florida legislature amended Section 163.3184(8)(b), F.S.,
requiring the Department to provide a courtesy information statement regarding the
Department's Notice of Intent to citizens who furnish their names and addresses at the local
government's plan amendment transmittal (proposed) or adoption hearings. In order to provide
this courtesy information statement, local governments are required by the law to furnish to the

I. CONSISTENCY WITH CHAPTER 163, PART II, F.S., AND RULE 9J-5, F.A.C.
The City's proposed Amendment 05-1 consists of one text amendment to the Coastal
Management Element. The Department raises the following objections to proposed Amendment
05-1:
1. Objection: The proposed amendment does not address minimizing impacts to private
property in the Coastal High Hazard Area (CHHA) and fails to address opportunities to direct
residential development away from the CHHA.
The proposed amendment is not consistent with the following requirements: Rules 9J-
5-.005(2 and
J-
_5:005(2-and 5); 9J-5.012(3)(b)7.,-and.(c)L.,_F.A.C_; and _Sections.163.31-77(6)(h)1:and 2;__-
163.3177(8)(1), F.S.
Recommendation: Do not adopt the proposed amendment. Alternatively, revise the text
amendment to include further direction in the policy that will result in redevelopment, where
possible, to be located as far landward as the development parcel would allow. Redevelopment
should be designed so that any additional development of the property such as pools, driveways
or garages are directed seaward to put the residence as fat as possible out of harm from storm
damage and to design the, redevelopment to minimize the impacts of man-made structures on the
beach and dune systema
2. Objection: The proposed amendment is internally inconsistent with Objective CM -4 of the
Coastal Management Element which requires that the City develop measures for protection of
beaches and dunes, establishing construction standards which minimize the impacts of man-
made structures on beach and dune systems.
The proposed amendment is not consistent with the following requirements: Rules
9J-5.005(2 and 5); 9J-5.015(3)(b)l.,(3)(c), F.A.C.; and Section 163.3177(6)(h)l and 2, F.S.
Recommendation: Do not adopt the amendment. Alternatively, revise the proposed amendment
consistent with Objective CM -4 of the Coastal Management Element as stated in the first
recommendation.
II. CONSISTENCY WITH STATE COMPREHENSIVE PLAN
Objection: The proposed Comprehensive Plan TEXT Amendment is not consistent with and do -
not further the following provisions of the State Comprehensive Plan (Chapter 187, Florida
Statutes) for the reasons noted in the objections raised above in Section I:
(a) Goal (6), Public Safety, Policy (b)23;
(b) Goal (8), Coastal and Marine Resources, Policy (b)4, 6, and 9; and
(c) Goal (25), Plan Implementation Policy (b)7.
Recommendation: Revise the plan amendment as recommended for the objections raised above.

According to this agency's responsibilities under sections 163.3177 and 163.3178, Florida
Statutes, and Chapter 9J-5, Florida Administrative Code, we reviewed the above document to
determine if data regarding historic resources have been given sufficient consideration in the
request to amend the Cape Canaveral Comprehensive Plan.
We reviewed one proposed text amendment to the Coastal Management Element to consider the
potential effects of this action on historic resources. While our cursory review suggests that the
proposed change may have no adverse effects on historic resources, it is the city's responsibility
to ensure that the proposed revision will not have an adverse effect on significant archaeological
or historic resources in the Cape Canaveral.

2. Discussion Re: Department of Community Affairs - Obiectives, Policies, and
Comments Report Dated November 21, 2005 - Todd Peetz, City Planner.
Todd Peetz, City Planner, gave on overview of the objections and recommendations
from the Department of Community Affairs. He explained that the State of Florida does
not want to increase density or intensity in the Cape Canaveral area. Following
discussion, the Board members agreed that the policy should be clarified to meet the
city's intent. Discussion was held regarding adopting more stringent building code
standards, and consider decreasing density and/or square footage than what is currently
allowed. Todd Peetz, City Planner, advised that the next meeting will be scheduled on
January 11, 2006 for recommendation to City Council. He advised that he would
prepare a response that would clarify the policy and provide those changes to both the
Local Planning Agency and City Council at the same time. He advised that the policy
would need to be adopted by the city no later than January 20, 2006 to meet statutory
deadline.

The following report is a summary of the Building Department's activities,
accomplishments and on-going projects for the months of October - December,
2005.
Building Department - Overview:
Bob Haley, Building Inspector/Plans Examiner, changed from Full-time to Part-
time status and is working three days per week.
Mike Richart, Building Inspector/Plans Examiner (recently transferred from
Public Works department to Building Department):
• Received two (2) provisional licenses.
• Completed the probationary period as a Building Inspector/Plans
Examiner.
• Attended a one -day training course in Cocoa regarding mobile home set-
up regulations.

proposed ordinance (Land clearing for three residential units or less); elected a
new Vice Chairperson; Interviewed a prospective board member (Harry
Pearson). The Board held discussion regarding: short-term rentals; overview of
2005 Brevard County Growth Management legislation; an ordinance regarding a

trucks or other large vehicles two get in out of two of the spots in particular. We are frustrated with the ongoing
situations involving this residence.The parking issue,lawn care,garbage overflow, and constant noise at all hours

And they told the elderly man it is not there job to pick up yard waste if it is not in plastic bags or a trash can. And
FEMA would pick the yard waste that wasn't in such contaniers. Well if you come down tit street you will still see
yard waste sitting in Trash cans and bags and in little small piles and they still won't pick it up.

STREETS AND BEAUTIFICATION
1. N. Atlantic and Central Blvd Turn Lane. Staff is working with the County in regards to
the design and construction of the left turn lane on Atlantic to Central Blvd. Brevard
County has contracted the engineering design task. The project preliminary design is
complete. The County is securing the needed easements along the west side of North
Atlantic Avenue.
2. Holiday Decorations. Staff installation of the holiday decorations and will remain up
until after All Kings Day.
Adopt A Beach Crossover. Staff is accepting applications from citizens and business
groups that wish to adopt a City of Cape Canaveral Beach Crossover. As of this date the
City received the following twelve (16) sponsorships.
4. Decorative lighting. The Beautification Board has been working on a project to add
decorative lighting around the City Hall complex. Staff has developed site locations and
has a concern about lighting spillover to residential areas. Hence, staff selected a lower
level lamppost with a 70 watt MH lamp. The Project is pending Florida Power Design.
Sidewalks Projects. J&S Curb is in the final construction of the sidewalk along the
Eastside of Poinsettta Avenue. Contract delays are due to rain and scheduling.
6. Sea Oats Planting. Staff ordered 40 Flats of Sea Oats. On October I' the City of Cape
Canaveral Volunteer team, spearheaded by Councilman Buss Petsos, planted the sea oats
between the newly installed Sand Fence. (96 plants per Flat for a total of 3,840 plants).
7. Landscaping RFP. The City advertised for a Landscape and Maintenance Contractor.
The Short list was approved by City Council on September 206'. Green Blades of Central
Florida contract was approved by City Council December 6d'2005.
8. Center Street Park Benko construction installed irrigation and landscape along Center
street and constructed a new Riverside Park. The park is complete except for the turf
blocks for the parking area.
9. Hurricane Wilma. The N.E.G. grant has been extended and migrant workers were sent
to Cape Canaveral to assist in the aftermath. Currently, the City has twelve NEG workers.
10. Reindeer Run. Preparations by Street Division staff for the annual Reindeer Run.
11. Poinsettia Planting. 1,300 poinsettias were planted throughout the City for the Holidays.
Many compliments were given this year for the City looking great!
12. Ridgewood Ave. City Staff is working with the Green Blades of Florida and their
Architect in the development of concepts design of Ridgewood Avenue. A meeting is
scheduled with staff on January 11th 2006. A City Council Discussion Item will be
scheduled after Staffs review.
13. Capital Purchases. Staff is seeking a replacement bucket truck. Scheduled for City
Council approval in February.
14. Concrete Services. Staff has advertised for continuing concrete services to be awarded
by City Council in March.
15. South City Sign (Yogi's). Staff has ordered a larger City sign as requested by the
Beautification Board. More so, the Board requested that a planter box be added to the sign
area.

1. Animal Control. This office processed 20 citizen requests for animal traps for the months of
October, November, December 2005 and was notified that a total of 19 animals were trapped
as follows:

2. Education/Training.
• All Streets Division and WWTP employees viewed a 30 -minute tape from October 12 to
October 18 on "Confronting Drugs in the Workplace".
• New employees from our Public Works and Street Department received their certification
for CPR/Defib after attending a 4 -hour training session given by Cape Canaveral Fire
Department.
• Rita Skrocki received her BS in Biology in December.
• Michael Swingler attended a one -day conference in Orlando for Cartegraph GIS training.
• Lab personnel attended a two-day training session held by FSEA for NELAC updates.
• Kay McKee attended classes in Poisonous Plants and Bugs and Growing Herbs, earning
her 4 CEUs toward her Professional Horticultural License.
• Jeffery Ratliff, Larry McCormack, Raymond Fox and Ed Boes attended a 4 -hour training
session and received certification on Trenching and Shoring.
3. New Employees for our Street Division of Public Works Department:
Jose Castillo, Richard Parman and Frederick Geddes have joined our Street Department as
Maintenance Workers. Welcome aboard.

Waste Water Treatment Plant - Capital Improvements
1. The Waste Water Treatment Facility Improvements. Brown and Caldwell was
awarded the study to review the Waste Water Treatment Facility's equipment to
establish a replacement schedule.
2. Sewer Force Main Replacement. Brown and Caldwell Engineering is preparing to
Bid Force Main form Lift Station # 1.
3. Equipment and Maintenance Building. Brown & Caldwell is working on site plans
for Maintenance Building, also equipment assessment for plant replacement.
4. I & I Program. Staff is preparing this year project. Reviewing inflow issues
resulting from Hurricane Wilma.
5. Easement Agreements. Staff has mailed out 23 Easement request and Vacations for
Phase I and Phase 3 of the Harbor Heights Subdivision.

STORMWATER
1. Maintenance. City staff routinely removes floatable items and performs inspections of all
baffle boxes (6) after heavy rainstorms or an accumulation of 1" of rain within 24 hours.
Extensive cleaning of the baffle boxes has been budgeted for FY2005-2006.
2. Inspections. Construction site inspections are completed at the commencement of land
clearing and after every rainfall event. Inspection of all new construction sites for state
mandated regulations in regards to erosion and sediment control is routinely performed.
3. Baffle Box Stormwater Grant. City staff is currently performing water quality monitoring
of the three new baffle boxes (Holman Avenue, Center Street, and West Central Boulevard)
installed in the 4t" quarter of FY2004-2005.
4. FEMA Grant. The City previously submitted a grant application through the FEMA
Hazard Mitigation Grant Program. If awarded, the grant funds will be used for drainage
improvements to the Buchanan/Orange Avenue intersection. Revisions to the grant
application were submitted in December 2005 - the City is requesting funding of
approximately $66,500. Notification of the award of the grant funds is anticipated in the 2nd
or 3rd quarter of FY2005-2006.
5. CDBG Grant. The City was previously awarded a Community Development Block Grant
(CDBG) in the amount of $100,000 for drainage improvements to the Buchanan/Orange
Avenue intersection. Funds should be available in the 2nd or 3rd quarter of FY2005-2006.
6. North Central Ditch Project. The City was awarded a Section 319(h) grant from the
FDEP ($314,770) and a Stormwater Cost -Sharing grant from the SJRWMD ($75,000) for
stormwater improvements for the northern portion of the Central Ditch. The FDEP contract
should be received in January 2006 - initial project activities are currently being completed.
7. South Central Ditch Project. The City was awarded a Section 319(h) grant ($286,000)
from the FDEP for stormwater improvements to the southern portion of the Central Ditch.
A SJRWMD grant application will be submitted in FY2005-2006 in the amount of
$115,000.
8. Monitoring. Water quality monitoring continues at the City's baffle boxes (6).
9. NPDES Permit. The City's NPDES Year 2 Annual Report was approved by the FDEP in
December 2005. The Year 3 Annual Report is due by December 31, 2006.
10. Stormwater Inventory. City staff is currently investigating the most cost-effective method
for completion of the stormwater system inventory, which is required for the NPDES
Permit.
11. Vehicle. The City received a new truck in the 1St quarter to be utilized for all stormwater-
related activities.
12. Utilities. City staff is now marking all stormwater structures at construction sites as
required.

ECHNOLOGYIMPROVEMENTS:
1. Network and PC Security: The network has the newest McAfee virus protection which updates
II Windows XP and 2000 PCs every night. The 9 Windows 98 computers were recently protected with
free virus scan software downloaded at no cost from the internet. Prior to this installation the PW
erver had received over 300 notifications of virus problems from these computers. This saved the
city about $500 in new VirusScan software.
2. Additionally, the 9 Windows 98 computers are protected for the first time from anyone walking in
and hitting the ESC key and logging into our server and internet. Everyone has a login and password
o log into their computer and all login/passwords were recently changed. This investment of $90
saved the city about $2000 in upgrading to Win 2000 or XP.
3. A training database was developed this quarter with over 488 training entries from 1988 to
present entered encompassing the entire career of each employee.
. We have researched GIS equipment for 3 months. With the help of CarteGraph programmers
located in Orlando, we have prepared a packed of equipment and software needed to start
IS locating in the city and developing layered maps to provide a visual representation of all
tormwater, streets signs etc within Cape Canaveral.
. We have the monitor for the front gate working inside the Administration building for the first
time in 1.5 years. While the camera is working, it does need to be replaced because it does not
zoom and the picture it provides is too far away from the front gate to provide any usable security
information.
RECREATION DEPARTMENT QUARTERLY REPORT
OCTOBER - DECEMBER 2005
The Brevard County Traveling Skate Park was in the Annex Parking lot on
October 1St and 2"d. Attendance was low, only 27 skaters on Saturday and
Sunday combined.
The Monster Mash Halloween Street Dance was held in the Annex Parking Lot
On October 28th. A report is attached.
The 30th Anniversary Racquetball Tournament, commemorating the 30th year the
Recreation Complex has been open was held on November 4th 5th & 6th. There
were 90 participants in this year's tournament. A tournament report is attached.
Information regarding the Recreation Complex which may be of interest. A
Building Committee was formed in early 1974 to work with Allen Engineering on
the design & construction of the Complex. The vacant block of land the Complex
sets on was County property and was deeded to the City; John Hurdle was the
District II County Commissioner at the time. Frank McClay was the Mayor and
Leo Nicholas and Ann Thune were serving on City Council. Building committee
members who are still residing in the area are Lamar Russell, Bob Laws, Nancy
Hanson, Harry Rhame, John Butler and Dan Keane. The dedication ceremony
was held
on December 20, 1975.
The annual Community Health Fair was held on November 9th. A report is
attached.
Girl Scout Troop 440 had their investiture/luncheon at the Recreation Center on
December 10tH
Standing room only at the Holiday Tree Lighting Program held in the Community
Room at the library. Thanks to Mayor Randels for m.c.ing the event and to Santa
Bob. Communications Concepts donates the labor to set up, and the use
of, a sound system every year. The Cape View Elementary School Chorus did a
fantastic job. Thanks to Isabelle for coming in on Sunday to accommodate the
program.
Manatee Sanctuary Park was rented by Coastal Fuels on December 10th for an
employee picnic, the Kiwanis Club Pancake Breakfast was held there on October
29th and our Public Works Department employees had a Thanksgiving luncheon
at the park on November 17tH

Re: Fourth Quarter 2005 Report
Dear Mr. Boucher:
Waste Management provided a total of 26 garbage collections, 13 green waste and 13 recycle collections to
the single-family residents. This equates to approximately 146,120 collections. In addition, service was
provided to approximately 6447 multi -family units, 56 commercial can customers, 111 commercial
customers and 9 permanent rolloff accounts. A total of 45 documented concerns were received by the City
during this time period and the breakdown is as follows: 19 garbage complaints, 5 recycle complaints, 15
green waste and 6 general /dumpster complaints.
