The sewer line is located adjacent to West Central Boulevard — and extends to the west in front of the Builder's Supply property (200 West Central Boulevard). The sewer line services all of the United Space Alliance facilities as well as other businesses along West Central Boulevard. During the re -lining activities, the sewer line collapsed (due to excessive corrosion). Since this was an emergency situation, Atlantic Development, Inc. (Atlantic) of Cocoa, Florida was contacted since they are currently under contract to perform other work for the City of Cape Canaveral. Atlantic mobilized to the site within 24 hours and began corrective actions to replace the sewer line. The work was completed on Tuesday, July 29, 2008. The final cost for the project was $95,246.00. Recommendation: Public Works staff recommends City Council approval of funds ($95,246.00) to Atlantic Development, Inc., for completion of the emergency sewer line repairs. The next time it most likely will not be repairable. This is the third or forth repair in the last several weeks; he has not charged us for two of the calls. Please find attached quotes for replacement unit. New unit will not retrofit to the old stand. Therefore, extensive modifications will have to be performed. Although it appears Easley has the lower cost, they did not do an on site inspection before presenting the roof/hurricane stand portion of their quote. They did not quote a model number consistent with the correct one submitted by the other two contractors. Both of the other contractors have done extensive research into what is available. Easley's quote for "optional roof work... with many exclusions, could lead to added on costs once the job begins. The new unit must have modified a stand and roof repairs/attachment — this is not an option. Easley is also not available for at lease two weeks. Because of the urgency needed to order the new unit and do the install ASAP, I recommend we proceed with Bud Campbell /Space Coast Cooling as our installer. His actual invoice could come in lower on the roof modifications. He has proven his reliability, and will stand behind the work. Please find attached MR for Space Coast Cooling. Pomichter Benjamin Franklin called democracy "two wolves and a lamb voting on what to have for lunch," and many small cities throughout Florida are starting to feel like the sheep. For the past few years, state lawmakers yielding to pressure to lower taxes and streamline government have been launching sweeping and potentially fatal assaults on "Home Rule." Many lawmakers have painted a picture of local governments that more closely resembles the stereotypical "fat cat" icons of Washington, D.C. or many state capitals than actual local government. Despite this mischaracterization, recent ballot initiatives like 2008's controversial but popular Amendment #1, may be serving to erode the abilities of municipal governments to provide services that citizens have demanded, and smaller cities throughout the state are being the hardest hit. Unlike their metropolitan companion many small Florida cities nearly half or more of their annual budgets from ad valorem property taxes, and this money is spent on the basic and essential services that citizen's demand, such as professional police and fire service, or city infrastructure maintenance. "There are times when we get a call about a pot hole in the morning and it's repaired by the afternoon," said city manager Jackie Burns of the City of Indian Harbour Beach in Brevard County. "Our residents have never had any problems with our services and really appreciate what we can do when they ask." State lawmakers say they are only responding to an outcry from citizens, but rather than point the finger of greater accountability at the massive bureaucracy of state government, these lawmakers are taking aim at city councils throughout the state. Home Rule, a term that is synonymous with municipal government, in fact, is a far more direct response to citizen outcry than any of the current trends away from it. It takes a vote of the general electorate of any given area to charter small city, and in most cases such charters are formed on the premise of localizing essential safety and security services. Local police and fire departments with a 2-3 minute response time, whose members are also trained first responders for medical crisis replace over tasked and more distant county agencies. One common misconception about these smaller municipal governments that has fueled the recent actions against them is that they cost tax payers more than if services were consolidated by the state or counties. In fact, residents of many Florida counties who live in unincorporated areas pay higher taxes. Communities that forego home rule by a local government, pay for closer county services through a "Municipal Services Taxing Unit," often referred to as the MSTU, and many times these rates are higher than neighboring municipal millage rates. During the 2008 legislative session, lawmakers once again took aim at Florida's small cities. HJR 949, which passed the house but failed in the senate, proposed to cap millage rates by county to 1.35 %, or 13.5 mills. This capped rate would have included county, school, municipal and special taxing district rates, and would have essentially crippled any local government without alternative revenue sources. Though the measure was defeated in the last days of the legislative session, political insiders say in will resurface in coming sessions. "There isn't likely to be a front door approach to unraveling `home rule,"' said Matt DuPree, a government relations director for Eligere Strategies, LLC, a company that has a plan to fight against such proposals and hopes to build a coalition of the most affected municipal cities and their residents. "Instead, it is far more likely that lawmakers can keep taking revenue sources away from these cities until they simply fold." Mr. Dupree and his company have been watching as the trend toward greater state and county controls has emerged, and have already been reaching out to local leaders to unite cities and town that are likely to the most impacted. Eligere Strategies, LLC has also been monitoring seemingly unrelated legislation that they see as potentially part of the greater agenda. "If we look at initiatives like Amendment 5, we can see how they can impact the home rule debate," said Mr. Dupree about the ballot initiative that would essentially remove school funding from the ad valorem debate by forcing school boards to be funded by an additional sales tax statewide. "This has two problems that I see immediately." Mr. DuPree said the first problem he sees is that by binding school revenue to consumer spending, it will force state lawmakers in economically tough times like those that have typically followed hurricanes and terrorist attack and even in recessive economies, to constitutionally prioritize school funding ahead of other state, and particularly local needs. "The more immediate and possibly larger threat comes from it's implication," said Mr. DuPree. `By taking schools, teachers and parent groups out of the ad valorem debate, lawmakers will essentially remove an obstacle to proposals like HJR 949 and eliminate small city allies." In the wake of recent legislative and special interest initiatives, it is easy to see the trend toward grater and greater state and county government control. This trend has given state lawmakers a platform from which to appear tough on government without ever addressing the state bureaucracy that has been the driving force behind citizen complaints against government spending and in the past. Instead the movement has targeted small municipalities, whose elected officials and employees are closest to the people they serve and are more closely monitored than their more politically savvy siblings. "We are going to bind these cities and towns together with the citizens that formed them and stop the erosion of the fundamental right of the people to govern themselves," said Mr. DuPree. "That is our mission, and once people see what is happening I know we will be successful." Work with legislators and the Florida DOT to obtain approval for and the placement of a traffic signal on state Rte. 50 in Wedgefield 3. Since the City of Cape Canaveral permit fee structure hasn't been adjusted since 1998, we have not been keeping up with the times. For years, salaries of public employees have generally increased at the rate of 5% per year. Ten years of salary increases (departmental expenses) at 5% per year amounts to 63%. Generally speaking, costs have risen approximately 63% and our building permit fees may have been undervalued by as much as 63%. Illustration: 100 increased by 5% each year (compounded) nets an increase of approximatel 63%, Ten years of5%compounded increments on a base of $100 nets an increase from $100 to $162.90. Todd Morley, Building Official It is a forgone conclusion that the bulk of the department should be funded by the `contracting public' because the general public doesn't benefit (directly) from the department's efforts. However, we should remain aware that the building department is often required to perform unfunded work (i.e. inspection of municipal buildings, Code Enforcement inspections, Damage Assessment, Flood Plain Management Administration, fieldwork supporting other departmental functions, etc.). This portion of the departmental budget, difficult though it may be to quantify, could be said to fall under the category of `General Fund -supported'. Note that the building department was 74% funded through permit fees in the year immediately after the adoption of Ordinance 98-28. The City of West Melbourne adopted ordinance No. 2008-35 (see attached). This ordinance contains provisions for some new building -related policies for that City. One of those provisions is for the imposition of a $100 fee for failure to obtain an approved final inspection. This would be helpful for the City of Cape Canaveral for the following reasons: • This ordinance will help prevent expired permits. Some contractors do not regularly close-out their permits. This ordinance would prevent a contractor from being issued a new permit until they have paid the $100 fee for an old un -closed permit. The fee can't be paid until the old permit is closed. The permit will not be closed until it achieves an approved final inspection. • This ordinance will help protect property owners from Code Enforcement. Although we make diligent efforts to keep up with expired (and expiring) permits, some contractors do not make the effort to close their permits. This often results in no inspection being made until the code enforcement process compels compliance. The process requires the owner of the property to bring about compliance. This puts the incentive for compliance in the contractor's hands. • This ordinance will reduce the volume of Code Enforcement cases. The most common code enforcement violation is work without a permit. (Expired permits equate to work without a permit). • This ordinance will help avoid State disciplinary proceedings. We have reported this activity to the State Licensing Board for disciplinary measures, but his can take months or years. The enactment of this ordinance will achieve quick results as contractors will want to continue to obtain permits. (b) Amendment of permit. An amendment to a permit shall not be approved or issued unless and until any additional fees or evidence with respect to additional fees, if any, required by subsections (a)(1) through (4) of this section, as the result of the additional work described in the permit amendment, have been paid or provided to the city. (c) Accounts. The finance director shall keep a permanent and accurate account of all fees and other monies collected. (d) Refund No refund of any fees paid to the city shall be allowed after the expiration of 30 calendar days from the date of issuance as stated on such permit. Administrative and plan review fees shall not be subject to refund under any condition. (e) Schedules. Fees for permits shall be in accordance with those adopted by resolution and on file in the city clerk's office and as may be required by other city ordinance or resolution. Such fees shall be assessed by the building official and collected by the finance director. (f) Expiration. If no work is performed under the permit for a continuous period of six (6) months, then the permit shall be deemed to have expired. Further construction activity under the permit is prohibited. (g) Final Inspection. Failure to obtain a final approved inspection for a permit before it expires will result in a $100.00 fine being levied against the permit applicant. No further permits may be issued to any contractor or permit applicant with an outstanding fine or to any contractor with an expired permit due to failure to obtain a final inspection. Chapter 82. We will use the Library Community Room for our City -related meetings, and the Sheriff will be able to use the Annex. Based on these assumptions, my top three priorities for this next year are: 1. New Fire Department; 2. Ridgewood Avenue Streetscape; 3.
