Your City Council positions are non- partisan meaning we are not responsible to the Democrats, independents or Republicans. We are answerable to ALL the residents in our community, not just the registered voters. Our City Council tries to listen to the issues and concerns and then does what is the right choice for the residents of our City. In the 22 years that I have been on the council, a very high level of respect and creditability has been main- tained between council members and also with the people we serve. Residents have the right to expect their elected leaders to provide effective leadership through vision, character, focus and perseverance during normal times. During the stressful economic periods that our country is in at present, even more is expected; such as being steady, reliable and responsive to challenging times. Your City Council and staff have prepared for many previous years, through conservative financial planning, the spending of your valuable tax dollars that you have entrusted to us. We have been able to set aside and save for future years (similar to a person's savings account) all available tax dollars needed for providing necessary services for the resi- dents such as police & fire protection, building inspections, roads & street lights, parks & recreation facilities and repairs for stormwater & sewer treatment lines. Our City utilized the growth in tax revenue over the last few years to invest in infrastructure improvements such as repaving City streets and replacing 45 -year old stormwater and sewer pipes. We also increased staffing and purchased new equipment for the Police and Fire Departments. Additionally, we completed landscaping and park projects, keeping our City beautiful. Tough times require trusted leaders who can provide reliable solutions. Your City of Cape Canaveral has that in the elected officials and staff. We are up to the challenge and have a record of providing flexible, responsible solutions whenever they are needed; be it the unexpected 30 inches of rainfall in 24 hours as a result of Tropical Storm Fay or an unexpected underground ruptured sewer force main. Your City will continue to respond to any and all situations, and we will strive to improve service and reduce costs. In addition to providing fire suppression, prevention and rescue services, the Department also has responsibilities in the areas of hazardous materials, special operations (confined space and trench rescue), public education, emergency management, marine services and non -transport advanced life support (licensed Paramedic services). • Responded to 1,926 calls for service in calendar year 2008. 1,328 were in the City. • The average response time in the City was 3 minutes 40 seconds. Emergency Medical Service made up 73.2% of all calls. • Responded 55 times to assist other fire agencies. • Successfully wrote and were awarded two grants from the Department of Homeland Security, one for 3 new personnel and one for 50 sets of new firefighting bunker gear. • Completed 547 annual City inspections. Activities • Completed 98 City permit reviews or inspections. • Recorded 7,097 hours of training for our personnel. • Recertified our personnel as Paramedics and Emer- gency Medical Technicians. • Provided community train- ing or education to 853 persons. • Participated in all City sponsored community events. • The Volunteers logged 1899.25 hours for calls, stand-by and training. • Our two Florida Task Force 4 members re- sponded to Jacksonville to search for mussing victims of a structural collapse. AA o $ Od BREVARD COUNTY SHERIFF'S OFFICE CAPE CANAVERAL PRECINCT The Canaveral Precinct continues to provide law enforcement to the citizens of Cape Canaveral, In 2008, our deputies responded to 19,554 calls for service, affected 639 arrests, issued 406 criminal traffic citations and 1,761 non -criminal citations. Deputies responded to and investigated 187 vehicle crash incidents. In addition to 24-hour Road Patrol, our deputies provide Special Enforcement Opera- tions within the community, targeting: • Underage Drinking and Purchase of Tobacco Products • Probation Sweeps Sex Offender Checks • Beach Patrols Our Traffic Unit provides motorcycle patrol and a spe- cially trained Traffic Homi- cide Investigation Team. Canaveral Precinct's School Resource Office "SRO", Mitch Boshnack, (pictured) provides instruction to 350 plus Cape View Elementary students in the G.R.E.A.T program curriculum, Life Skills, Anti -Bullying strate- gies and bicycle safety. Several community events area coordinated through our Special Operations Unit, including National Night Out and holiday pro- grams to benefit area chil- dren. The Brevard County Sheriffs Office Police Athletic League "PAL" has partnered with the City of Cape Canaveral Recrea- tion Center to provide PAL sponsored youth leadership programs to Canaveral youth including Camp Chance, Camp Canaveral, Basketball and Surf Camp. Canaveral Precinct provides four K-9 teams trained and certi- fied in Patrol, Narcotics Detec- tion and Explosives Detection. Canaveral Handlers and their K 9's are: Deputy Fritz & Blitz Deputy Collura & Koko Deputy McCarty & Murphy Deputy Manley & P.D. (pictured) PUBLIC WORKS DEPARTMENT The Public Works Department is the largest department in City government with responsibility for sanitary sewer, roads, facilities, drainage canals, stormwater management, environmental services, and project planning. Wastewater Division Replaced the sewer force main from Lift Station #I (Washington Ave- nue) to the City's Wastewater Treatment Plant. Project was completed in October—$540,000. New equipment/maintenance building was constructed at the City's Public Works Facility. Project was completed in May—$550,000. Continued program to slip -line, TV monitor, and clean sanitary sewer lines (4,000 linear feet) throughout the City. Project was completed in July—$160,000. Completed renovations (new valve box, valves, etc.) at Lift Station #3 (West Central Boulevard). Project was completed in July—$50,000. Stormwater Division Constructed stormwater improvements (three baffle boxes) to the northern portion of the Central Canal at West Central Boulevard— portion of project funded with a grant from the Florida Department of Environmental Protection. Project was completed in December— $390,000. Obtained approval of the City's National Pollutant Discharge Elimi- nation System, Year 4 Annual Report (stormwater permit) and No- tice of Intent (details the activities by the City for the next five-year period). Permit renewal was received in January—$5,800. Completed a comprehensive inspection of the City's stormwater system after Tropical Storm Fay and cleaned 30 manholes of debris with vacuum truck. Project was completed in December—$3,200. Purchased and installed an emergency stand-by generator for Lift Station #1 (Washington Avenue) for use during power outages. Project was completed in February—$60,000. Replaced 120 linear feet of sewer line under the Central Ditch at West Central Boule- vard. Project was completed in September—$97,000. PUBLIC WORKS DEPARTMENT Streets Division Completed maintenance and repair of the City's Recreation Complex and Youth Center facilities. Worked on the renovation of the City's new Community Development Department Facility located at 7510 N. Atlantic Avenue. Provided maintenance and repair of the City's beach crossovers, as needed. Prepared 1,000 sandbags for future distribution to the public for use during storm season—sandbags currently stored at the City's Public Works Facility. Purchased a beach cleaning machine equally ftmded by the Tourist Development Council, the City of Cocoa Beach and the City of Cape Canaveral. Machine was purchased in April—City's cost share of $27,000. Beautification Installed a new space shuttle model in front of the City Hall Complex. Pro. ject was completed in December— $6,900. Held a volunteer sea oat planting pro- ject (5,000 plants) along the Atlantic beach dune. Project was completed in February—$3,800. Installed turtle lighting protection shields to selected street lights through- out the City to eliminate impacts to sea turtle nesting activities—project was funded with a grant from Brevard County. Project was completed in May—$5,800. Awarded the "Tree City" designation for the 19th consecutive year by the Arbor New Model Space Shuttle 2009 Projects Complete the final design of the Ridgewood Avenue Streetscape Project, with possible construc- tion in the later part of the year. Started the preliminary design concept for the N. Atlantic Avenue Streetscape Project. Final design and construction of stormwater improvements to the south Central Canal area. Installation of bus shelters at various locations. COMMUNITY DEVELOPMENT DEPARTMENT The Community Development Department has the primary functions of Planning, Building Code and Code Enforce- ment. In 2008, this department was relocated to a new City owned building located at 7510 N. Atlantic Avenue. This department services the City and its citizens by coordinating the City's future growth and economic development through the use and interpretation of City codes and ordinances related to comprehensive planning, zoning, building and construction, land use, redevelopment, signage, licenses and permits. City Council, as required by the State of Florida Comprehensive planning laws, adopted the 2008 Evaluation and Ap- praisal Report which will be the basis for updating the 1999 City Comprehensive Plan in 2009. The City approved (1) site plan, (4) special exceptions and (1) final re -plat in 2008. There are (11) projects that had obtained development orders; of those, only (4) remain active. Planning for the Future Cape Canaveral 2050. Our community's vision of its future. In 2009, the City, in partnership with the East Central Florida Regional Planning Council, will embark on an eight month Community Visioning and Strategic Planning process that will seek input from all stakeholders within our community to deter- mine the future of our community. It is anticipated at the end of this process, the City will have a written report detailing the vision statement for future growth and potential redevelopment sites, as deter- mined by the public participation process. 2008 Permit Summary ( 675) permits were is- sued with a valuation of $5,141,101. (1,625) inspections were performed. Certificates of Occupancy were issued for (10) resi. dential units and (3) com- mercial structures A& RECREATION 17mr DEPARTMENT Life Trail at Manatee Sanctuary Park A new Life Trail with ten exercise wellness stations was installed at Manatee Sanctuary Park. Residents can enjoy a cardio workout while walking along the half mile walking trail, making a stop every 200 feet to work out on one of the wellness stations. Each station is designed to work on a particular body part, stretching, toning & strengthening your entire body. Annual Fall Festival, The City of Cape Canaveral celebrated its 45th Anniversary at the Annual Fall Festival held at Manatee Sanctuary Park on October 11th. Everyone at- tending this event received a 45th Anniversary Commemo- rative Frisbee. Free activities at this youth oriented event in- cluded bounce houses, balloon art, face painting, a DJ, games and refreshments. 13th Annual Reindeer Run This year's event raised over $6,000 for the United Way of Brevard County. 395 runners participated in the event and over 30 children ran in the Fun Run, which featured a visit from Santa. Sandpiper Park Has Arrived Canaveral City Park received a new name and all new playground equipment thanks to a $150,000 grant from the State of Flor. ida. This state of the art park, located at the corner of Harrison and Magnolia Ave- nues, features two play areas for 2-5 year olds and 5-12 year olds. Amenities include a picnic pavilion, park benches, shady Oak trees and a passive walking path. The play- ground received its new name of "Sandpiper Park" through an essay contest at Cape View Elementary School. Max the Manatee, Manatee Sanctuary Park Annual Community Annual Holiday Tree Lighting Celebration The Annual Community On December 14th, over 200 residents were treated to a memorable performance from Celebration at Manatee Sanc- the Cape View Rocket Chorus and the Dickens Carolers at the Library. This event also wary Park held on March featured the illumination of the glowing holiday tree and the appearance of Santa Claus. 14th featured the City's first Vendor Expo with over 35 businesses participating. Free Kids Become Aware of Safety youth oriented activities at this event included games, The First Annual Kids Community Awareness Day was held on August 2nd with over balloon art, a DJ, face paint - 200 participants. This back to school event was held to help prepare our kids for school ing and bounce houses. with supplies & safety awareness. Bicycle helmets and backpacks with school supplies were donated. Athletic Leagues RECREATION DEPARTMENT During 2008, the Recreation Department held tennis and racquetball leagues five nights a week for players of various skill levels. Additional, Adult Flag Football Leagues were held on Tuesday nights and Adult Coed Softball Leagues on Thursday nights. Both Ieagues are sanctioned and officiated by certified referees and um- pires. Summer Camp Summer Camp was held at the Nancy Hanson Recrea- tion complex. Children were engaged in daily activities, games, arts & crafts. Wildlife & Reptile Show Trapper Jim Greene brought his wildlife and reptile show to the City in September This free event was enjoyed by over 200 parents and children. The standing room only audience was introduced to various Center Street Neighborhood Park What's Happening in 2009 I If you thought 2008 had a lot to offer, wait until you see what's in store for 2009. • We are planning a full day summer camp from 9 am -3 pm for kids ages 5-9. • An outdoor °Movie in the Park" is set for Manatee Park on March 21st. • The PAL Program is joining forces with the Cape Canaveral Youth Center for Kids ages 10-17. This leadership program will help bring guidance and structure to our teens through projects, speakers & community service work. • A new tennis program for kids ages 5-10 called "Quick Start Tennis", a USTA program designed to teach kids the game of tennis from an instructional approach driving towards game play. • The Recreation Department will be offering basic computer skills courses to adults & children. • New programs at the Recreation Complex include Salsa Dance Lessons, Zumba Exercise Class, Tai Chi strength & balance classes, Senior Social Club, Mini Maestro Music Time for toddlers to age 5 and Body Sculpting Exercise Classes. CITY CLERK'S OFFICE The City Clerk's Office is the central operation for Legislative activities, City Records, Notary Public Service, Hu- man Resources and Risk Management Services. The Clerk's Office also responds to residents' and visitors' ques- tions related to where to find information provided through other City Departments and Brevard County. City Records Managed City records services for all City Departments consistent with State public records laws and reporting requirements. Archived City records in a digital format. Responded to multiple public records re. Risk Management Reviewed and processed insurance claims and restitution tracking with the City's insurance car- rier and worked to receive a safety program insur- ance premium credit. Provided employee Workers' Compensation Claims Processing and Return-taWork Assis- tance, as needed. Other Services Provided extensive coordina- tion in setting up the new City of Cape Canaveral Web site. Legislative Services Prepared (9) proclamations and (39) resolu- tions with related City Council Agenda Pack- ets and acted as the City Council recording secretary. During the 2008 election process, the City Clerk acted as Qualifying Officer for City Council Candidates. Provided orientation information to newly appointed volunteer board members. Human Resources Coordinated annual open enrollment for City employee benefit pro- grams. Worked on liability prevention and reduction issues. Implemented a computerized personnel records management system. BarryBrown Fire Chief, CCVFD David Sargeant PRESENTATIONS: 2008 Reindeer Run Proceeds Check to United Way of Brevard County and Sponsorship Recognition Robert Lefever, Recreation Director, began by acknowledging his Co -Race Director, Ms. Fran Norman. Mr. Lefever stated that the 2008 Annual Reindeer Run was a big success with 360 participants and 30 children who participated in the Fun Run. Mr. Lefever presented a check for $6,067.25 toward the 2009 campaign to Ms. Alicia McCoy representing United Way of Brevard. On behalf of the United Way, Ms. McCoy expressed thanks to the City of Cape Canaveral, Mr. Lefever and Ms. Norman and stated that this money will be the first contribution for their 2009 campaign. The money will go to support health and human City of Cape Canaveral, Florida City Council Regular Meeting Agenda January 20, 2009 Page 2 of 10 service agencies in Brevard County; 98 different programs at 50 agencies that help children, families, seniors and individuals with disabilities. Keys to the City for Sponsors of the 2008 Reindeer Run Mr. Lefever proceeded by thanking the United Way Staff, the City's Parks and Recreation Department Staff, the City's Streets Department Staff, the Cape Canaveral/Port Canaveral Kiwanis Club and the Space Coast Runners Club. Keys to the City for Boeing Christmas Contribution Mayor Randels acknowledged employees of The Boeing Company, Titusville, FL for purchasing and assembling 98 new bicycles for the Cape Canaveral Volunteer Fire Department, the Brevard County Sheriff's Department and the Cape Canaveral/Port Canaveral Kiwanis Club to deliver to children in the City of Cape Canaveral for Christmas. Mayor Randels presented a Key to the City to Boeing employees Mr. Kevin Hoshstrasser, Site Director, Florida Operations/Space Exploration and Ms. Sandy Klotz. Ms. Klotz presented a poster with photography showing the efforts of everyone involved. Mayor Randels asked volunteers Joyce Hamilton, Kiwanis Club and Fire Chief, Dave Sargeant to speak. Ms. Hamilton noted that no child, that she was aware of, went without having their Christmas wishes met in Cape Canaveral this year. Fire Chief, Dave Sargeant informed that Mr. and Mrs. Klotz have been long time volunteers in the City of Cape Canaveral. Corporal Doug McCarty, Brevard County Sheriff's Office, spoke on behalf of Sheriff Jack Parker, Commander Doug Scragg and Deputy Mike Biecker by reading a letter of appreciation to the Employees of The Boeing Company for their generous support in the Brevard County Sheriffs Office, Cape Canaveral Precinct Christmas Wish Project this year. City of Cape Canaveral, Florida City Council Regular Meeting Agenda January 20, 2009 Page 3 of 10 Mr. Petsos recognized The Boeing Company and personally thanked Mr. and Mrs. Klotz for everything they've done over the years for the City of Cape Canaveral. Parks and Recreation Presentation to the Cape Canaveral l Port Canaveral Kiwanis Club Mr. Lefever acknowledged the continued support and volunteer efforts of the Cape Canaveral/Port Canaveral Kiwanis Club. He presented a Key to the City to Tom Mesmer, President of the Kiwanis Club. BOARD INTERVIEW: Linda Brown — Library Board Mayor Randels called Linda Brown to the podium. Ms. Brown affirmed that all of the information on her application was true and correct to the best of her knowledge. Ms. Brown explained that she was invited by Isabel Escapa, Library Director, to attend a Library Board meeting and was impressed by the dedication of the board members. She agreed with Mr. Petsos that everyone should give back to their community. Ms. Brown stated she's always volunteered and described now she started a Food Bank for the students of an aviation college in Denver, Colorado when she lived there. In conclusion, Mayor Randels stated that a Resolution to appoint her to the Board would appear on the February 3, 2009, City Council Meeting Agenda. REPORTS - City Manager • Mr. Boucher distributed.the Public Works Projects Status Report to Council. Mr. Boucher stated the New Stormwater Inlets project at the 300 Block of Harbor Drive and Coral Drive in the Harbor Heights subdivision is completed and is an example of what the new stormwater inlets around town will look like. • Mr. Boucher informed that Florida Power and Light wants to conduct FPL Home Energy Makeovers in the City on St. Patrick's Day, Tuesday, March 17, 2009. He explained that FPL can outfit volunteers in green t -shirts and to go around to fifty needy families and give their homes energy makeovers. He said teams normally run from lam to 4pm and it is an all day event. Mr. Boucher clarified for Mayor Randels that FPL will want community volunteers to work with their team members. Mr. Petsos agreed that St. Patrick's Day is a good date because it ties in with the "green" community idea. Mr. Boucher explained further that FPL will do all the legwork as far as following up on applications for interested candidates. Council members agreed on March 17, 2009 as the date so FPL can kick off their campaign. • Mr. Boucher announced that he and Mayor Randels would be meeting with Brevard County Commissioner, Chuck Nelson and the Cape Canaveral Library Director, Isabel Escapa to discuss the Cape Canaveral Library Meeting Room the next day, Wednesday, January 21. He stated that the County does not want the room to City of Cape Canaveral, Florida City Council Regular Meeting Agenda January 20, 2009 Page 4 of 10 be a "permanent use" by the City. Mr. Boucher emphasized he will be telling them that it is the City's building and the City's land. Mr. Boucher added that Ms. Andrea Bowers, City Treasurer provided information that in the 2008/2009 fiscal year, Brevard County is estimated to take $594,000 from the community in Property Taxes and the budget for the Library is approximately $448,000. The Library is netting approximately $145,000. Mr. Petsos requested that Mr. Boucher ask about the County's rumored plan to shut down libraries. Mr. Petsos also requested that Mr. Boucher make sure that the County considers the fact that the City not only funds their own library, but they also contribute to the County. • Mr. Boucher informed Council that the City Attorney is working on a clean draft of the Sign Code and that once he receives a copy of the draft, a workshop meeting will be scheduled. • Mr. Boucher stated that Barry Brown, Planning and Development Director, met with Ms. Shelly Lawton about Community Visioning and they are setting up the criteria for the Steering Committee Members and working on the dates for the Community Meetings. He added those dates will be provided at the next City Council meeting if not before. • Mr. Boucher announced the City of Cape Canaveral's new web site is up and running and the new web address is www.city6fcapecanaveral.org. He explained that each City Department is responsible foi'their own content and refining the site is an evolving process. Mayor Randels specified the new items the City is projecting in new equipment as being Drainage/Stormwater Baffle Boxes of $503,000 in 2008-2009 FY, with the money coming from the Stormwater Enterprise Fund. He continued that under Transportation are two items: the first item being $573,000 in 2008-2009 FY, with monies coming from County Impact Fees, to widen lanes; add turn lanes; lower intersection; install mast arm signal; and add sidewalks at N. Atlantic and Central Boulevards. The second item: being at N. Atlantic Avenue and Shorewood Avenue, for $146,000 in 2008-2009 FY, with monies contributed by developers, to add tum lanes and deceleration lanes. Mr. Brown replied to Mayor Randels that the reason the City is doing this is simply because the State of Florida requires it. Mr. Brown explained this is merely an administrative exercise and is not a policy setting document. Mayor Randels and Mr. Boucher affirmed for Ms. Walsh that Exhibit A will reflect the amended category amounts before the new document is sent to the State of Florida Mr. Petsos made note of e-mails he received from citizen David Shirtzinger referencing the City's 5 -Year Plan and comparing it to other models he found on the internet. Mr. Petsos expressed the need for more data and definition and explained this would help during the budgeting process, workshops and also help citizens understand the 5 -Year Plan when they open it up. Mayor Randels explained the ordinance puts guidelines on the applicant and time frames on the City to process applications avoiding delays or having permits staying open for years. Mayor Pro Tem Hoog questioned the (1) 30 -day extension with "good cause" since plan review is done in-house now and whether that would work for the City. Mr. Brown clarified that this is not for in-house pian review but addresses additional information that is needed from the applicant. Mr. Brown explained they would send the applicant written notification giving 30 extra days within which to respond. He explained further this does not address the plans distributed to the Fire Department or the City Engineer. Attorney Latorre affirmed that this 30 day period is for when the applicant, for example, submits a special exception and a major piece of data is missing and that would cause Mr. Brown or the Fire Department to not be able to complete their analysis and make a recommendation on whether the application should be approved or denied. The Staff would then turn to the applicant for this missing information, to move the process along, giving them 30 -days in which to respond and then another 30 -day extension period if needed. She noted, in the past, some applications had been delayed for an unreasonable amount of time. Attorney Latorre corrected that Staff is not limited to a specific period of time to complete their review until they have gotten everything and that there is a requirement that the item be put on the next available meeting agenda. Attorney Latorre stated that we want to impose some sort of responsibility on an applicant to come forward with an application when they are ready to go instead of letting the application linger. Mayor Pro Tem Haag expressed the need to address the process of special exceptions and time frames associated with them. Discussion continued on the issue. Mr. Brown responded to Mayor Randels question about the reason for the one -day turnaround request to review this Final Replat when the original Preliminary Replat was approved back on March 7, 2006. Mr. Brown explained that the applicant, David Welsh, submitted his request before Christmas. Mr. Brown stated he was unable to get the item on the agenda prior to that. Mr. Brown explained that, considering Mr. Welsh had a sale pending, he wanted to demonstrate that the Community Development Department can hustle things up so they made it happen. Mr. Boucher responded that the Beach Rake is here and was servicing the community last week. He specified that the Beach Rake starts at Johnson Avenue and goes as far north as it can without interfering with the vegetation and will be doing so a couple of times a week until March 1, 2009. Mr. Tom Garboski, resident, responded to Mr. Petsos invitation to view the Beach Rake, by suggesting a demonstration during the Annual Sea Oats Planting. Council agreed that was a good idea. • Mr. Petsos announced the Annual Sea Oats Planting will be on Saturday, February 7, 2009 at 9 a.m. and stated they have 7,500 sea oats to plant at this point. He said hopefully, with help from Mr. Boucher and Mr. Ratliff, they will be getting a permit to install some sand fencing shortly. Mr. Petsos added Mr. Kevin Bodge may be able to help, if needed. • Mr. Petsos asked Mayor Randels if he was still serving on the Florida Municipal Insurance Trust Fund Board. Mayor Randels answered that'he was not. Mr. Petsos asked Council to consider nominating him. Council agreed. • Mr. Petsos urged everyone to pay close attention to the Brevard County School Board Meeting tonight because of talk about reducing and cutting schools. Mr. Petsos stated Cape View Elementary School is ok right now but stressed the City needs to take a proactive stance in talking to school board members to make sure Cape View stays Cape View. Mayor Pro Tem Bob Hoog • Mayor Pro Tem Hoog stated he attended the Space Coast League of Cities Dinner Meeting and turned in Resolution No. 2008-39; Supporting Amendments to the Florida Statutes to Increase Mortgage Holders Responsibility for Delinquent Condominium, Co -Operative and Homeowners Association Fees on Foreclosed Units to the league. He informed that no action was taken, but that legal opinion should come from the Space Coast League of Cities Attorney, Paul R. Gougelman sometime next month. Mayor Pro Tem Hoog noted the N. Atlantic Avenue project is moving fast and will hopefully be finished shortly.. Mayor Pro Tem Hoog informed that he took the whole day on Sunday, January 18, to drive around Central Florida looking at redeveloped CRA (Community Redevelopment Area) areas. He travelled to the Cities of Sanford, Lake Mary, Winter Garden, Winter Springs and Winter Park. He pointed out the nice job that the City of Sanford did on the walk along Lake Monroe. Mayor Pro Tem Hoog noted Winter Park Village with 5 or 6 blocks of redeveloped areas and a massive outside lounge. He stated he took pictures and will bring them in to share. Mayor Randels clarified that the City of Cape Canaveral is in the middle of a Visioning Process and there is a real potential opportunity to redevelop some of the homes here. Mayor Randels stated, as a result, the City is encouraging people to go throughout the State of Florida and bring back ideas. Mayor Rocky Randels City of Cape Canaveral, Florida City Council Regular Meeting Agenda January 20, 2009 Page 9 of 10 • Mayor Randels announced that Ms. Mary Shaffer is the new CVB Director of the Cocoa Beach Area Chamber of Commerce in the City located at 8501 Astronaut Boulevard. • Mayor Randels informed that he met Brig Gen Edward Bolten, 45th Space Wing Commander at the 2009 Florida National Defense Space Award Luncheon on Tuesday, January 13, hosted by the National Space Club Florida Committee. • Mayor Randels announced that he may travel to Washington D.C. to talk to the House Appropriations Committee regarding the Brevard County Beach Re -nourishment proposal which is paid for by the Army Corps of Engineers. • Mayor Randels informed that he presented a plague to the New Center Director of Kennedy Space Center, Mr. Robert D. ' Cabana, at the Economic Development Commission's Community Welcome Reception on Friday, January 9. • Mayor Randels mentioned articles in The Star-Advocate/The Press -Tribune newspapers about the progress of "Computers for Kids" project at Cape View Elementary School. He explained the children are learning to breakdown, rebuild and keep the computers afterwards. • Mayor Randels stated he received the Economic Recovery Bill and many of the items listed are things the City can apply for on a local city level, some having to do with environmental restoration, flood protection and wastewater treatment systems upgrades among them. Mayor Randels added he thinks some of these items will probably get some action in Congress. • Mayor Randels mentioned the City of Tavares write up in the Florida League of Cities magazine "Quality Cities". It recognized the City of Tavares Wooten Park project, which Phil Laurien helped build and he presented to the City of Cape Canaveral,as an example for the Visioning. • Mayor Randels recognized Florida League of Cities, Employee of the Year, Sherry Hilley. Ms. Hilley is a consulting manager for the Technology Services Department at the Florida League of Cities and she helped City Staff implement www.ebetterplace.com on the City website. • Mayor Randels noted that with the help of the Florida League of Cities, the City of Cape Canaveral received $450 from insurance companies throughout the United States that did purchase a business license to sell insurance in the City of Cape Canaveral. Council Member Betty Walsh • Ms. Walsh brought out that the Beach Rake can only go so far north on the beach. She lives in that area and feels it is important for people to know. Mr. Boucher agreed that the area north of Ocean Woods is difficult because of the natural topography of the land, the vegetation meanders towards the shoreline and the beach is not built-up with sand like the areas further south. Mr. Boucher stated it may be possible that, depending on the tides, the rake may still be able to get up there. City of Cape Canaveral, Florida City Council Regular Meeting Agenda January20, 2009 Page 10 of 10 Ms. Walsh mentioned she spoke with Kim McIntire, Executive Assistant to the City Manager, who provided her with a name and phone number of someone who is willing to come and get some of the peacocks. Ms. Walsh said she realizes the City received a lot of resistance in the past but also said she thinks that if one area of the City tries to move them, they will eventually jump over fences and come back. Ms. Walsh stressed the need for this to be more of a city-wide effort if it is something the City wants to do. Mr. Boucher stated there are well over 100 peacocks with flocks in Ocean Woods, Harbor Heights, Villages of Seaport, Shore Drive, Ocean Gardens, Oak Lane and parts of Solana. Mayor Randels said he feels there is support for this if the birds can be taken care of and given to a good home. WHEREAS, the City is granted the authority under Section 2(b), ArticIe VIII, of the State Constitution to exercise any power for municipal purposes, exceptwhen expressly prohibited by law; and WHEREAS, over the course of many months, the City Council and the Planning & Zoning Board have comprehensively reviewed Chapter 94 of the City Code regarding the permitting and regulation of signs; and WHEREAS, during a sign workshop meeting held on January 31, 2008, the City Council and Planning & Zoning Board reviewed the Chapter 94 regulations applicable to on -premises temporary signs; and WHEREAS, the City Council has previously temporarily suspended the 30 -day display time periods and permitting fees applicable to temporary on -premises signs as set forth in Chapter 94 through the adoption of Resolutions 2008-04 and 2008-17; and WHEREAS, given the continued downturn in the nation's economy, the City Council desires to reauthorize the temporary suspension of the 30 -day display time periods and any permitting fees applicable to temporary on -premises signs set forth in Chapter 94; and WHEREAS, the City Council believes that relaxing these provisions of the City Code regarding temporary on -premises signs is in the best interest of the citizens and business owners of Cape Canaveral while the City continues to review and update its sign regulations; and WHEREAS, the City Council of the City of Cape Canaveral deems that this Resolution is City of Cape Canaveral Resolution No. 2009-05 Page 1 of 3 in the best interests of the public health, safety, and welfare of the citizens of Cape Canaveral. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Temporary Suspension of Certain Sign Regulations. The Cape Canaveral City Council hereby approves temporarily suspending enforcement ofthe following City Code provisions as follows: A. Section 94-76. Temporary on premises signs. The 30 -day time periods imposed by section 94-76 with regard to how many days prior to and following the opening of a new business temporary signs and banners may be erected are hereby suspended for a period of six (6) months from the effective date of this Resolution. All other provisions of section 94- 76 shall remain in full force and effect. B. Section 94-35. Fees. Any permit fees set forth in section 94-35 applicable to on - premises temporary signs shall be suspended for a period of six (6) months from the effective date of this Resolution. Any other fee imposed by section 94-35 shall remain in full force and effect. Section 3. Extension of Suspension Period. The six (6) month suspension period set forth in Section 2 of this Resolution may be extended for one (I) additional six (6) month period by a majority vote of the City Council at a duly held City Council meeting. Section 4. Termination of Suspension Period. Notwithstanding any other provision of this Resolution, the City Council reserves the right to terminate, at any time, the six (6) month suspension period set forth in Section 2 herein. Any such termination shall by majority vote of the City Council at a duly held City Council meeting. Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Council of the City of Cape Canaveral, Florida. The purpose of the Citizens' Visioning Committee is to oversee the visioning process and create a true citizens' ownership of the visioning and its results. The Citizens' Visioning Committee is a group of 7 to 12 Cape Canaveral volunteers who have demonstrated an interest in the City's future. The Committee will be comprised of business, civic and government leaders, as well as other interested parties who will champion the process and elicit participation and support from the community. The Committee will host meetings, communicate the results of the meetings to the City Council, and encourage the implementation of the visioning results. The Committee should as best as possible represent the major stakeholder groups within the City. Committee members should be persons who live, own property, or operate businesses within the City. They should also have a standing in the Community that will lend credibility to the visioning. The primary responsibilities of the Citizens' Visioning Committee include: • Assist in identifying the Community's key stakeholders • Invite participation of these Stakeholders in the Visioning Process • Host and Participate in all Visioning Workshops • Identify with City Staff the key outcomes of each Visioning Workshop • Communicate the results of the Visioning Workshops to the City Council • Monitor the implementation of the Community Vision. The Business and Cultural Development Board will serve as the core of the Committee. Several other members will be added with an emphasis on providing the greatest representation of the various stakeholder groups. Recommendations from the City Council and the public will be submitted to City staff. Staff will make selections and after prospective candidates have been vetted and contacted, the final committee membership will be ratified by the City Council. See the attached sheet for recommendations to the Citizens' Visioning Committee. Please submit your recommendations by Monday February 91h. Flag Football & Coed Softball Leagues have completed their 2008 seasons & will resume play in January 2009. Mary Jane Binney was hired as the new Recreation Leader at the Youth Center. Activity at the Youth Center remains very positive. Kids are working on various projects & activities ranging from sewing, crafts & independent studies. October 650 (average per day 26) November 750 (average per day 36) December 725 (average per day 29) -- extended Christmas Vacation hours The Annual Fall Festival took place on Saturday, October 11t"` from 11:00 am to 4:00 pm at Manatee Park. This years' event celebrated the City's 45th anniversary. Everyone in attendance received a commemorative frisbee. Some wet areas, do to the rain, had us doing some re -configuring for parking & staging areas, but in the end it was all a success, even with a passing shower an hour into the event. Activities included a bounce house, giant slide, obstacle course, rummage sale, bake sale, games, balloon art, face painting, refreshments, BSO & CCVFD. Over 500 people attended the event. The Annual Monster Mash Halloween Street Dance took place on Thursday, October 30th from 6:30 pm to 8:00 pm at the Annex parking lot. Activities included a DJ, along with dance, limbo & hula hoop contests. At the end of the night we had a costume contest & all the kids received trick or treat goodie bags filled with candy, toys & a coupon for a free game of mini golf, compliments of Funntasia Fantasy Golf. All other contest winners received coupons for free food or services donated by local businesses & restaurants. Over 250 people attended the event. On Saturday, November 1, 2008 from 11:00 am to 5:00 pm the Recreation Department & the Kiwanis Club had a fund raiser that took place at Funntasia Fantasy Golf & Games. The objective for the event was to raise money to purchase tumbling mats for the Youth of Cape Canaveral. Tickets for the event were $10.00 & each participant received a round of miniature golf, hot dog, soda & a raffle ticket. Prizes were donated by local businesses & included bikes, DVD's & gift certificates. The event was a big success raising close to $3,000.00. Sponsors for the event were; Funntasia Fantasy Golf & Games, Kiwanis Club, Blue Note Publication & Porter World Trade, Inc. The 33`d Anniversary Racquetball Tournament took place on the weekend of November 7t — 9th 2008. The tournament had a record number of sponsors at 21 & a record high number of players at 130. This event funds itself raising $2,485.12 after expenses. $1,863.84 (75%) went to Tournament Directors Mike D'Amico & Paul Owens & $621.28 (25%) went to the Recreation Department. The Community Health Fair took place on Wednesday, November 12, 2008 from 8:00 am to 11:00 am. Flu shots & pneumonia injections were available by the Brevard County Department of Health, along with a variety of health screenings, checks, consultations & give-aways. Approximately 200 people attended this years' event, but staff felt as if participation was down, due in large part to the increase of Health Fairs around the area & the large availability of flu shots to the public. The Tennis Jamboree took place on Friday, November 14, 2008 from 6:00 pm to 8:00 pm. The event was sponsored & funded by the United States Tennis Association. The jamboree was a kick start to our newest tennis program called "Quick Start" which teaches kids ages 5 —10 the game of tennis from an instructional component using specialized equipment geared towards the skill levels of each child. The new program will begin on January 8, 2009. There were over 35 kids at the jamboree participating in games, lessons, receiving prizes & pizza. The PAL Kick -Off Party was held on Saturday, November 15, 2008 from 12:00 pm to 5:00 pm at the Youth Center. The event was a big success with over 150 kids & adults present. Activities included the Traveling Skate Park, a DJ, an obstacle course, a giant slide, finger printing by BSO, the BSO Command Center, a K-9 demonstration & free hot dogs, chips & drinks. The purpose of the party was to introduce the public to the PAL Program & educate the teens (14- 17) about what was offered through the leadership program. The party was funded by the PAL organization. Refreshment services were provided by the Kiwanis Club. The 13th Annual Reindeer Run was held on Saturday, December 13, 2008 at Cherie Down Park. 360 runners participated in the race & 30 kids ran in the Fun Run. Estimated figures show the department raising close to $6,000.00 for the United Way. The Annual Tree Lighting Program was held on Sunday, December 14, 2008 at the Cape Canaveral Library. 175 people attended the event, making this the largest turn out in the history of the Tree Lighting. The Recreation Department provided letters from "Santa" for kids of all ages. Parents replied to the department by completing a questionnaire about their kids & their Christmas list wishes. We sent out 20 letters to kids in decorative envelopes from the North Pole. Canaveral City Park Playground Update: The playground is100% complete & staff is in the process of closing out the FRDAP Grant. 12 oak trees have been planted along with 3 inches of new engineered wood fiber chips topping off the playground surface. Poly Cap fence guards were installed on the east fence bordering the ball field & the playground. Wear mats were installed under the wood fiber chips at the youth swings & the tire swing. 2 new trash cans with dome lids were installed at the pavilion. The park naming essay contest is over & the name for the park is "Sandpiper Park'. The winner & finalists of the contest will be recognized at a dedication ceremony which will be scheduled during our Annual Egg Hunt. One of the toddler swing seats was vandalized, damage replacement was $125.00. We have no leads as to who may have committed the damage. Maintenance. The City's inmate crew routinely removes floatable items and performs inspections of all baffle boxes (6) after heavy rainstorms — floatabie items are removed on a less frequent basis during drought periods. Several National Emergency Grant (NEG) personnel performed an inspection of the City's entire stormwater system after Tropical Storm Fay. Results of the inspection were used to identify and clean (vacuum truck) 30 manholes throughout the City. Thirty cubic yards of debris were removed and properly disposed. 2. Construction Site Inspections. Construction site inspections are completed at the commencement of land clearing, after every rainfall event, and weekly. Inspection of all new construction sites for state mandated regulations in regards to erosion and sediment control is routinely performed. These activities are requirements of the City's National Pollutant Discharge Elimination System (NPDES) stormwater permit. 3. Baffle Box Stormwater Grant. City staff is currently performing water quality monitoring of the three new baffle boxes (Holman Avenue, Center Street, and West Central Boulevard) in accordance with the grant requirements. 4. Baffle Box Cleaning. The City's baffle boxes (6) were cleaned of sediment and debris in January 2008 — approximately four to five cubic yards of sediment were removed from each of the boxes. The next cleaning event will be conducted in January 2009. 5. Street Sweeping. Street sweeping is performed on all City streets on a monthly basis. An annual contract was recently approved with USA Services for another year of street sweeping services. 6. North Central Ditch Project. The City was awarded a Section 319(h) grant from the Florida Department of Environmental Protection (FDEP - $314,770) for stormwater improvements for the northern portion of the Central Ditch. The project has been completed — final invoices and grant paperwork are currently being processed. 7. South Central Ditch Project. The City was awarded a St. Johns River Water Management District (SJRWMD) grant for the project in the amount of $115,000. Final engineering drawings are currently being developed. The project should be completed in mid -2009. NPDES Permit. The City's NPDES Year 4 Annual Report (stormwater permit) was approved by the FDEP in December 2007. A Notice -of -Intent document detailing the City's proposed stormwater improvement efforts over the next five years was approved by the FDEP in January 2008. The City is currently implementing the requirements of the permit. 9. Utilities. City staff is now marking all stormwater structures at construction sites as required (City over 10,000 in population). 10. Concrete Construction Contractor. City staff is working with the concrete contractor to repair/replace Stormwater basins/sidewalks/streets/medians located throughout the City. 11. Turtle Lighting — Pollution Reduction Project. An additional list of lights requiring corrections was forwarded by the County to FPL — the County has funds remaining from last year to pay for the corrections. The County is currently moving forward with the project. 12. Estuary Grant Application. A grant was awarded to the City by the US Army Corps of Engineers (USACOE) to remove pepper trees from the City property located on Long Point Road. The USACOE conducted a site visit in March 2008 — currently waiting on cost estimates from the USACOE for completion of the project. 13. Stormwater Master Plan. A revised Stormwater Master Plan (updating the 2000 plan) has been prepared and submitted to City Hall for review. 14. Tropical Storm Fay Issues. City staff is currently working with the PortBenko Construction/residents in the northeastern portion of the City concerning recent flooding issues. A portion of the Central Ditch was also excavated after the storm to increase flow through the Central Ditch. 15. Stormwater Inlets — Harbor Heights. The City Council has approved funds for the retrofitting of four stormwater inlets in Harbor Heights. If successful, these new style stormwater inlets will be used elsewhere in the City. 16. NEG Workers. Four, NEG workers are currently cuttingtremoving vegetation from the northern portion of the Central Ditch. Removal of this debris should increase surface water flow in the ditch and improve water quality. Public Works Quarterly Report: October, November, and December DATE: January 5, 2009 STREETS AND BEAUTIFICATION Streets Department: 1. Tree Maintenance. Staff continues to perform pruning of all oak trees at City complexes and along various City streets. 2. Inspections. Staff continues to coordinate with the Building Department for tree inspections and reports. 3. Fields Maintenance. Staff continues to maintain the Little League and softball fields for league practices and games. 4. Sand Fences. The Florida Department of Environmental Protection (FDEP) and the Florida Fish and Wildlife Conservation Commission (FWC) denied the City a permit to install sand fences. The City will petition the FDEP and the FWC for a permit to install sand fences at limited areas only. 5. Mowing/Chemical Contractors. Streets Department staff re -bid these two City contracts in mid -2008. Black's Spray Service, Inc. (former contractor) was awarded the chemical spraying/fertilization contract and Professional Diversified Services, Inc., was awarded the mowing/landscaping contract. These contractors are currently performing work for the City. 6. Irrigation Maintenance. City staff continues to maintain existing irrigation systems (over 50) throughout the City. 7. Bus Shelters. The City has been awarded funds to construct bus shelters/benches throughout the City. The City is currently waiting on ridership information from SCAT and attorney approval of an Interlocal Agreement. A presentation was made to the Beautification Board on December 19. 8. Beach Rake. Training for the use of the beach rake was completed in November. However, a recall was issued for the John Deere tractor — the City of Cocoa Beach will make the repairs. 9. NEG Worker. A National Emergency Grant (NEG) worker is currently repairing beach crossovers and performing other carpentry work throughout the City. Beautification: 1. Flower Planting. Poinsettias have been planted at selected locations throughout the City. 2. Flagpoles. Flagpoles and solar lighting have been ordered by the City's contractor for installation at the City signs along SR A1A. 3. Ridgewood Avenue Redevelopment Project. Waste Water Treatment Plant and Citywide Capital Improvements 1. Capital Improvements. All have been completed for this FY 2008-2009. 2. Regional Residual Dryer System. This ongoing project approved by City Council on October 21, 2003 is a study for a Regional Biosolids Treatment Facility for Brevard County and participating municipalities within Brevard County. Wastewater Treatment Facility Permit. The City has received a new Florida Department of Environmental Protection (FDEP) Domestic Wastewater Facility Permit (FL0020541-004-DWIP) - expiration date of February 28, 2012. The City has authorized Brown and Caldwell to proceed with work on the FDEP Permit Compliance Administrative Order (AO). This work is ongoing until the AO is completed - the City is currently waiting on a reply from FDEP as to the progress of the AO. The City has completed the 3rd Semi -Annual Progress Report and is waiting on a response from the FDEP. 4. Port Canaveral ASR System. The Canaveral Port Authority was issued a permit for the Aquifer Storage and Recovery (ASR) system. The City has discussed the potential benefits with Port personnel that the ASR would have for all parties involved. Testing of the Port's ASR system continues - this project is ongoing with City Staff and the Port. 5. Roof — Belt Press Room. City staff is currently reviewing bids to install a new roof for the Belt Press Room at the Public Works Facility. 6. Maintenance Program. Sargeant, Fire Chief 27 January 2009 YEAR END SUMMARY - 2008 Last year our Department responded to 1,926 calls for service. This is a decrease of 37 calls from last year. In the City there were 1,328 calls, the average response time was 3 minutes 40 seconds and the average time spent on a call was 20 minutes 52 seconds. In the Port there were 423 calls, the average response time was 4 minutes 10 seconds, and the average time spent on a call was 38 minutes, 31 seconds. 120 calls were in Avon by the Sea (county area) and 55 were giving mutual auto aid to others departments. Average response time is measured from the receipt of the call until we arrive on scene_ 182 of these incidents over lapped each other. The overall average response time for the Department was 4 minutes 3 seconds which includes all calls. Sundays were our busiest days, 1 pm was our busiest time, and August was our busiest month. EMS represented 73.29% of all calls. We successfully wrote and received two Department of Homeland Security Grants. The first provides partial funding for three personnel for 5 years. The second is providing 50 sets of new firefighting gear to meet the new Standards. The Department of Homeland Security awarded us $392,009.00 for these two projects. We recorded 7,097 hours of personnel in house training and 606 hours of outside training. The volunteers contributed 1899.25 hours with the majority of these hours dedicated to training, special events, and public education. We performed 98 permit reviews or inspections in the City and 48 in the Port. We conducted 547 annual inspections in the City and 220 in the Port. Food was collected and meals were provided for 32 families in the City of Cape Canaveral. ■ Deputy Biecker, with assistance from the Cape Canaveral Fire Department, collected toys from numerous area businesses and the U.S. Marine Corps `Toys for Tots". The toys were wrapped and distributed to 54 families throughout the Cape Canaveral area. Numerous volunteers participated in this project. ■ Deputy Boshnack and Deputy Webster provided demonstrations for the students at Cape View Elementary School for Red Ribbon Week. OTHER ACTIVITIES ■ Deputy Biecker completed quarterly inspections of all the specialty vehicles. ■ Deputy Biecker conducted monthly mileage and maintenance checks on the pool vehicles. ■ Deputy Boshnack was selected as the employee of the year at Cape View Elementary School. The selection was based upon his devotion to the employees and students at the school. ■ Deputy Webster provided assistance with traffic control and vehicle escort services for several funeral processions that passed through the City of Cape Canaveral. ■ Deputy Webster assisted with vehicle escorts through the City of Cape Canaveral for Presidential Candidate, Senator John McCain and Vice Presidential Candidate Joe Biden. CRIME PREVENTION: ■ Deputy Biecker and Deputy Webster conducted directed patrol targeting traffic, parking and beach issues during the months of October, November, and December. The patrols were conducted on various days and evenings throughout the quarter. ■ Deputy Biecker and Deputy Webster conducted traffic enforcement involving people disregarding school bus lights. This enforcement continues to take place daily while school is in session. ■ Deputies consistently work/patrol the beach access areas of Cape Canaveral to deter drinking, fireworks, dogs on the beach and homeless problems. ■ ATV and Bike patrols were conducted throughout the quarter. J. R. "Jack" Parker, Sheriff OPS 16 0112007 ■ Deputy Biecker conducted several targeted burglary patrols, completing multiple field interviews and identifying local juveniles. A total of eight (8) citizen complaints were forwarded to Deputy Biecker during this reporting period. 1 . Three of the complaints involved noise disturbance; two from 236 Chandler and one near the Circle K Store on N. Atlantic and Oak Lane. 2. Three of the complaints involved Homeless persons; two involved persons sleeping or spending time in the gazebo at William Bennix Park and the third related to four homeless men occupying the crosswalk at Harrison Avenue beach access. 3. One complaint referenced stolen street signs 4. One complaint referenced illegal drugs on Lincoln Avenue. The majority of the issues have been addressed through increased patrol of the listed areas, which will continue to deter further incidents. NEW PROGRAMS Deputy Boshnack is working with the PAL program in setting up activities for the youth of Cape Canaveral. ■ Recruiting efforts continue for the COP program. TRAINING: ■ Deputy Biecker attended bi-monthly EOD training. Deputy Webster attended monthly Motor Training at the Brevard Community College driving range at the Palm Bay campus. ■ Deputy Webster attended 30 hours of dive training during the quarter. J R. On 10121108, the vehicle was recovered unoccupied at the beach access of Madison Avenue, Cape Canaveral, and returned to the victim undamaged. Investigation is pending lab results from prints lifted from the vehicle. CR# 08-302713: Robbery With Deadly Weapon I False Imprisonment - 8104 N. Atlantic Avenue, Cape Canaveral, Florida. On 10/14108, Suspects Joshua Hobbs and John Cormier invited victim to their residence and robbed him at knifepoint, blocking him from escape. Victim resisted, fled from the residence and called 911. Both suspects were arrested. Suspect Daniel R. Thacker violated the terms and conditions of his felony probation when he fled from the Vera Courthouse to avoid jail. Agents located suspect at his residence, where he turned himself in. Mr. Thacker smelled of alcohol and admitted to drinking alcohol prior to his arrest, which violates the terms of his probation. CR# 08-330650: Battery - 8125 Canaveral Blvd, Cape Canaveral, Florida. On 11108108, Suspects Cory Phast Lane and Michael Jordan intentionally punched and kicked victim in the face, head and body in retaliation for theft of shoes from Michael Jordan's residence. Victim denied theft of shoes; both suspects were arrested. CR# 08-307920: Grand Theft Auto — Beach Access of Harrison Avenue, Cape Canaveral, Florida. On 11/12108, person(s) unknown stole victim's 2003 Pontiac Sunfire from Harrison Avenue beach access, while he was on the beach for approximately two hours. Case remains pending further leads. CR# 08-322634: Armed burglary! Aggravated Assault! Theft! and Use of a Firearm in the Commission of a Felony - 8525 Canaveral Blvd, Cape Canaveral, Florida. On 11106108, victim went to his garage to investigate noise and found suspect John McGhee III attempting to steal his bicycle. When confronted by the victim, Mr. McGhee pulled a gun from his waistband and pointed it at the victim. Victim grabbed the gun attempting to remove it from the suspect's grasp. During the struggle, the gun went off. Deputies arrived, secured the gun and arrested John McGhee. J. Based on complaints, an undercover operation was initiated resulting in the arrest of Danny Lee Weigle_ Suspect has been trespassed from the Park. CR# 08-325054: Exploitation of an Elderly Person/ Grand Theft - 8701 Banyan Way, Cape Canaveral, Florida. Suspect Brian Roderick was hired and paid by elderly female victim to complete home repairs, however the repairs were never done. Capias Request completed; suspect's whereabouts unknown. NOVEMBER ACTIVITY: 11-04-2008 GCU meeting 11-11-2008 GCU meeting 11-12-2008 Business Watch meeting 11-13-2008 Milo training for GCU. 11-18-2008 Undercover operation in Cherie Down Park. The operation resulted in the arrest of a white male suspect for offering a sexual act to an undercover deputy. 11-19-2008 Fraud training 11-20-2008 Firearms training for GCU. 11-20-2008 Probation operation. The operation checked 20 people currently on felony probation. One white male was arrested and two white males were violated reference curfew checks. 11-21-2008 The Canaveral GCU conducted an underage tobacco operation. 16 local businesses were checked; none sold tobacco to the underage Cl. 11-22-2008 The Canaveral GCU conducted Operation "Peeping Tom" on Caroline Street. No person(s) were located matching the composite. 11-25-2008 GCU meeting SIGNIFICANT DECEMBER CASES: CR# 08-331175: Felony Battery/ False Imprisonmentl On-site VOP - 630 Adams Avenue, Cape Canaveral, Florida. Suspect Curtis James Holt battered male victim, who was trying to protect his girlfriend. Suspect kicked male victim in the upper body, breaking his ribs. Suspect then forced both male and female victims into the female's residence where they were held against their will for approximately forty minutes. Suspect fled the area and was later located and. arrested. CR# 08-335687: Tampering With a Witness/ Possession of a Controlled Substance - 306 Johnson Avenue, Cape Canaveral, Florida. Suspect Ronald King was caught on tape attempting to influence the testimony of a state witness in a robbery case. At the time of arrest, Mr. King was found to be in possession of a controlled substance. CR# 08-335799: Scheme to Defraud -106 Lincoln Avenue, Cape Canaveral, Florida. On 11/13108, Suspect Gilbert Nieves purchased $700.00 worth of tools at Stan's Hardware on his company's line of credit without consent or permission. Mr. Nieves I R "Jack" Parker, Sheriff OPS 16 0112007 then pawned the tools at Beach Pawn Shop. Stan's Hardware signed a non -prosecution affidavit after suspect purchased the tools back from the pawnshop and retumed them to the store. CR# 08-341050: Grand Theft Auto - 402 Adams Avenue, Cape Canaveral, Florida. On 11118108, victim parked his 1992 Ford Explorer in the parking lot area of his apartment complex. When he returned, the vehicle was gone. The vehicle was entered into NCIC/FCIC and remains stolen at this time. CR# 08-302797: Burglary, Theft - 7822 North Atlantic Avenue, Cape Canaveral, Florida. Security footage revealed that suspect John Cormier entered and remained in victim's vehicle, removing several items. Charges pending. CR# 08362906: Dealing in stolen property/ False Verification of Ownership - 202 Pierce Avenue, Cape Canaveral, Florida. On 12109108, suspect Jeremy Lo Cicero stole several items from his father's residence, and then pawned the items at Gold Coast Pawn shop. The property was recovered and returned to the victim. Mr. Lo Cicero was arrested on 12124108. CR# 08-366409: Burglary, Theft - 7128 Marbella Court #504, Cape Canaveral, Florida. Suspect Charles Brown was identified from a latent fingerprint, lifted from the crime scene. Mr. Brown works for a cleaning service that services the condominiums where the victim lives. Arrest is forthcoming. CR# 08-377115: Robbery (Home Invasion) - 306 Johnson Avenue, Cape Canaveral, Florida. On 12122/08, Suspects Andrew Purvenas and Christopher Theders entered victim's residence through a locked window and beat her, demanding money owed to them by her husband. Victim had no knowledge of money owed or the whereabouts of her husband. Suspects fled, however deputies caught them attempting to leave the City and they were arrested. CR# 08381552: Failed to Return Rental Property/ and Dealing in Stolen Property - 6301 N. Atlantic Avenue, Cape Canaveral, Florida. Suspects Austin Houghes and James Ellis rented a TV from Rent A Center and pawned the TV less than three weeks later at the Gold Mine in Merritt Island. A Capias Request was filed on Mr. Ellis for failure to return rental property, and a Capias Request was filed on Mr. Houghes for dealing in stolen property. The TV was recovered from Gold Mine and returned to Rent - A Center.
