Staff informed applicant of the 45 -day requirement and the required fees. Applicant requested that City Council waive all fees for this not-for-profit organization. Staff informed applicant that City Council's next regular meeting will be after the event date. Applicant requested relief. After discussion between building official and city clerk, it was determined to ask City Council if a special meeting could be held to address the fee waiver. Notes: • The American Legion Cmdr. has been made aware of this meeting and stated that he would send a representative. • The Outdoor Entertainment Event Committee is required to review and approve or deny each application. This application has not been reviewed. Council approval or denial of the requested fee waiver does not remove the requirement for committee approval. Requested Council Action: Waive fees as requested. Council may direct staff to review the existing timeline and potential new timelines in light of the recent direction to create a two-tiered system for outdoor entertainment events. Financial Impact: $500 application fee and $500 clean-up deposit. EXEMPTIONS Legally organized non-profit organizations and City-organized events may seek a waiver of any of the outdoor entertainment event fees provided that the City determines that all code sections dealing with the health, safety and welfare of those in attendance, as well as the general public, have been otherwise provided for as required by said code. VI CLEAN-UP DEPOSIT The applicant agrees to provide all necessary labor and/or equipment to effect a full and complete clean-up of property in and around the site, provided such clean-up results directly or indirectly from the outdoor entertainment event. Additionally, the applicant agrees to submit a clean-up deposit of $500. If, in the discretion of the City Manager, it becomes necessary to utilize City labor and/or equipment to complete such clean-up, the costs of such clean-up shall be deducted from the deposit. Expiration of variance or special exception; abandonment. (a) Any variance or special exception approved by the board of adjustment pursuant to this article shall expire 12 months after the effective date of such approval unless a building permit based upon and incorporating the variance or special expiration is issued by the city within said time period. Upon written request of the property owner, the board of adjustment may extend the expiration date, without public hearing, by an additional 12 -month period, provided the property owner demonstrates good cause for the extension. Such request shall be submitted to the board of adjustment prior to the expiration of the first 12 -month period. In addition, if the aforementioned building permit is timely issued, and the building permit subsequently expires and the subject development project is abandoned or discontinued for a period of six months, the variance or special exception shall be deemed expired and null and void. (b) Thereafter, a variance or special exception shall expire and become null and void if the use granted thereunder is abandoned or otherwise ceases to exist for a period of 18 consecutive months. As used herein, abandoned shall mean that the applicant has gone out of business, let all business licenses lapse or has otherwise changed the use of the property in conformance with this Code. Once a variance or special exception has lapsed due to abandonment, the applicant roust resubmit its request for variance or special exception pursuant to this article. (Ord.
