1. CALL TO ORDER
The session shall commence at an open meeting. The City Attorney shall advise the City
Council that he desires their advice concerning the litigation set forth below. The person
chairing the meeting shall announce the commencement and estimated length of the
Attorney -Client Session and the names of the persons attending. The Attorney -Client
portion of the meeting will be closed to -the public and the Attomey-Client Session will
commence. At the conclusion of the Attomey-Client Session, the meeting shall be
reopened, and the person chairing the meeting shall announce the ten-nination of the
session.
11. ATTORNEY-CLIENT SESSION
Pursuant to Section 286.014(8), Florida Statutes, the City Attorney will be seeking
the advice of the City C ouneil regarding settlement negotiations and/or strategy
related to litigation expenditures concerning the ding litigation in, and for the
Eighteenth Judicial Circuit of Brevard County, Florida, styled as City of Cape
Canaveral, Florida v. Secure Foundation Systems, Inc., a Florida Corporation, and
CEMEX, Inc., a Louisiana Cofporation, Case No. 2010 CA 6701 ME
The persons scheduled to be, in attendance are Mayor Rocky Randels, Mayor Pro Tern
Bob Hoog, arid Council Members James Morgan, Buzz Pets s, and Betty Walsh, and
City Manager David Greene, City Attorney Anthony A. Garganese, And a Court
Reporter.

with respect to any matter considered at such meeting or hearing, he or she will need a
record of the proceedings, and that, -for such purpose, he or she may need to ensure that a
verbatim record of the proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based" - per Section 286.0105 Florida,5tatutes.
