Deputy of the Month for October 2010 -- Sara McLennan: Commander Moros explained
the reasons Deputy McLennon was selected as Octobers Deputy of the Month and
presented her with a plaque of recognition.
Deputv of the Month for November 2010 — Deputy Jason Holmes and Der)uty Marc
Rosenfeld: Commander Moros explained the reasons Deputy Marc Rosenfeld was
selected as one of November's Deputies of the Month and presented him with a plaque
of recognition. Commander Moros explained the reasons Deputy Holms was selected
as the other one of November's Deputies of the Month. He indicated he will present the
plaque to him upon his return from vacation.

REPORTS:
City Attorney Garganese reported on the compliance for the Porter Property and the
completion within the timeframe agreed to. He provided an update on the pending
litigation between the City, Secure Foundations and Cemex. He explained the details of
the settlement agreement which will reimburse the City for the out of pocket costs to
complete the repair work in the amount of $17,200.00. A motion was made by Mr.
Hoog, seconded by Mr. Petsos, to accept the settlement offer and authorize the
Mayor to sign the document. The motion carried 4-0 with voting as follows:

CONSENT AGENDA: Mayor Randels read the title of the items. He inquired if any items
are to be removed from the Consent Agenda for discussion. Ms. Walsh requested items
three and four be removed for discussion.

4.. Approve purchase of "Blackboard Connect for Government", a communications
tool, from Blackboard,' Inc. in the amount of $7,248.45.
A motion was made by Mr. Hoog, seconded by Mr. Petsos, to approve Consent
Agenda Items one and two. The motion carried 4-0 with voting as follows: Mayor

Item No. Three: Ms. Walsh and Mr. Petsos asked questions about the changes. Mr.
Greene and Ms. Apperson responded. The changes were discussed. Council
requested Staff to investigate whether it would be cost effective to purchase a
disability policy with a cost share between the City and the Employees and
reduce amount of accruals for sick time and provide a salary comparison to like
Cities prior to next year's budget workshops. A motion was made by Mr. Petsos,
seconded by Mr. Hoog, for approval. The motion carried 4-0 with voting as

Item No. Four: The benefits of using the system were discussed. It was noted this
system will not replace the newspaper notices or postings to the City's website, and will
allow emergency service personnel to send important messages to citizens and visitors.
A motion was made by Mr. Hoog, seconded by Mr. Petsos, to approve. The

ORDINANCES: Second Public Hearin_q:
5. Ordinance No. 14-2010 Amending Chapter 54 Parks and Recreation of the
Code of Ordinances; Authorizinq the City Council to Award Franchises for Commercial
Vending Activities. on the City's Beaches by Competitive Bid Pursuant to„ -Certain
Requirements and Restrictions; Providing for the Repeal of Prior Inconsistent
Ordinances and Resolutions; Incorporation into the Code; Severability; and an Effective
Date: City Attorney Garganese read the title of Ordinance into the record. The merits
of the Ordinance were discussed as well as concerns of commercialization of the
beach. It was noted the City of Cocoa Beach did not support this type of activity within
their City limits. The Public Hearing was opened. Mr. Patty spoke of his State and
County licenses, which allow him to sell food or beverages from the wet portion of the
beach. He explained his activities and noted his work to pick up trash on the beach. He
indicated anyone who sells must have also have a state license. He objected to having
to bid against others since he was the first person to begin selling. Mr. Leo Nicholas
asked if the Ordinance. limits the number of carts or locations vendors can have, to
which Mr. Greene responded by saying the City Council controls the number of carts
through the franchise agreement. Mr. Nicholas urged for the Ordinance to include the
limitation on the number of carts. The Public Hearing was closed. A motion was
made by Mr. Randels, seconded by Mr. Hoog, for approval of Ordinance 14-2010
at the second Public Hearing. The motion carried 3-1 with voting as follows:

6. Ordinance 18-2010, Amending Chapter 66, Article 111, Excavations, of the Code

Incorporation into the Code, Severability; and an Effective Date: Attorney Garganese
read the title of the Ordinance into the record. Mayor Randels gave a brief explanation
and indicated this Ordinance does not apply to private streets. A motion was made by
Mr. Petsos, seconded by Ms. Walsh, to approve Ordinance 18-2010. The Public
Hearing was opened. No comments were received and the Public Hearing was closed.

RESOLUTION:
8. Resolution No. 2010-34• Revised Fee Related to Chapter 66 Article 111
Excavations of the Code of Ordinances Related to Open Cuffing of Roads or Streets
Permitting, Fees and Inspections; Repealing Prior Inconsistent Resolution; Providing for
an Effective Date. Attorney Garganese read the title of the Resolution into the record.
Mayor Randels reviewed the fees and how they are changing. A motion was made by
Mr. Petsos, seconded by Ms. Walsh, for approval. The motion carried 4-0 with
voting as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, Absent; Mr. Petsos,
For; Mayor Randels, For; and Ms. Walsh, For.
DISCUSSION:
9. Exterior Renovation of the Canaveral Precinct. Building: Commander Moros
explained the proposed work. and options for different types of roofing materials. He
urged for approval of the proposed work with the metal roof as described in option one.
A motion was made by Mr. Randels, seconded by Mr. Hoog, for approval of the
siding with option one for the roof. Discussion ensued and included if a price was
received for completely re -stuccoing the building; when maintenance or repairs are
needed on other buildings that this option is used; whether there could be a second
floor on the annex building,and the indication that the plans for the building do not show
the appropriate footers for a second story; that Council Member Morgan expressed his
support for this project to City Manager Greene; the clarification that option one includes
hardy plank for the siding; the standing seam thicker green roof at a cost of $167,621.00
and the use of the remaining money from the 2009110 contract as well as from the
reserve. The motion carried 4-0 with voting as follows: Mayor Pro Tem Hoog, For;
Mr. Morgan, Absent; Mr. Petsos, For; Mayor Randels, For; and Ms. Walsh, For.

Mayor Randels explained that set up and tear down of the audio/visual equipment, for
the room to be used for other events, causes considerable extra work for employees.
He indicated the last weekend of January is the professional art show and the first

weekend of February is the student art show and requested the first meeting in
February, which is between the two shows, be canceled so the equipment could only be
taken down and set up once. A motion was made by Mr. Randels, seconded by Mr.
Petsos, to cancel the first meeting in February. The motion carried 4-0 with
voting as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, Absent; Mr. Petsos,
For; Mayor Randels, For; and Ms. Walsh, For.
Council Member Walsh wished everyone a Merry Christmas, and a healthy, happy and
safe New Year.
Council Member Petsos complimented Mr. Greene on the great weekly reports from the
Department Directors. He requested an additional weekly report from the City Manager
as well. A brief discussion ensued. Consensus was reached for Mr. Greene to also
submit a weekly report. Mr. Petsos expressed that Ridgewood Avenue is looking good
and wished everyone a Merry Christmas and a Happy New Year.

Free Air Laws in the State of Florida; Providing an Effective Date.

Summary: Mayor Randels requested this item be placed for discussion after receiving
a letter from Americans for Nonsmokers' Rights (ANR) regarding the preemption of
Smoke -Free Air Laws in Florida. They are the leading national lobbying organization
(501 (c) 4) dedicated to nonsmokers' rights, taking on the tobacco industry at all levels
of government, protecting nonsmokers from exposure to secondhand smoke and
preventing tobacco addiction among youth. ANR pursues an action -oriented program of
policy and legislation.
Formed in 1976, ANR's activities began with efforts to enact legislation to protect
nonsmokers in the workplace and enclosed public places. ANR has promoted clean
indoor air ordinances in thousands of communities and states, and assists countries
and communities around the globe to enact smoke-free regulations. As of October 1,
2010, there are 3,173 municipalities with laws in effect that restrict where smoking is
allowed. There are 902 municipalities, 32 states, 2 commonwealths, and at least 51
countries that have a 100% smoke-free provision in effect in workplaces, and/or
restaurants and/or bars.
ANR urges Restoration of Local Control of Smoke -Free Air and tobacco to Florida's
communities by passing legislation deleting the existing line of preemptive code in state
law. To support this initiative, ANR suggests encouraging the Florida League of Cities
to adopt a Resolution Supporting Restoration of Local Control of Smoke -Free Air.
The'City Council reached consensus at the December 7, 2010 City Council Meeting to
support a Resolution restoring Local Control of Smoke -Free Air Laws in the State of
Florida.

RESOLUTION 2011-01
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, SUPPORTING
RESTORATION OF LOCAL CONTROL OF SMOKE-FREE AIR LAWS IN
THE STATE OF FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, numerous studies have found that tobacco smoke is a major
contributor to indoor air pollution, and that breathing secondhand smoke is a cause of
disease in healthy nonsmokers, including heart disease, stroke, respiratory disease,
and lung cancer; and
WHEREAS, the World Health Organization has determined that there is no safe
level of exposure to secondhand tobacco smoke, and in 2007 declared that there is
undisputable evidence that implementing 100% smoke-free environments is the only
effective way to protect the population from the harmful effects of exposure to
secondhand smoke; and
WHEREAS, in 2010 the U.S. Surgeon General reported for the first time the
damage smoking can do at the cellular and organ level and the evidence on the
mechanisms by which smoking causes disease indicates that there is no risk-free level
of exposure to tobacco smoke; and
WHEREAS, local governments have both the right and the responsibility to adopt
laws that protect the health and safety of their residents; and
WHEREAS, more than 3,100 local governments throughout the country have
successfully implemented smoke-free air laws to protect people against the harmful
effects of secondhand smoke; and
WHEREAS, the tobacco industry, in an effort to negate such local legislation, has
long had as its chief legislative strategy the preemption of local authority to regulate
tobacco; and
WHEREAS, multiple states have successfully overturned preemption and
restored local control to enact and enforce smoke-free air laws; and
WHEREAS, Florida has had a preemptive state law since 1985, which prohibits
local government from enacting laws that restrict smoking in any indoor or outdoor
settings, such as workplaces and public places, or restrict the marketing, advertising,
and point of sale of tobacco products; and
WHEREAS, protecting people from the harmful effects of secondhand smoke is
best accomplished by local communities working directly with the people most affected
by smoke-free air laws; and

WHEREAS, the Florida Legislature should not deprive local governments of the
authority to protect people from the harmful effects of secondhand smoke;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cape
Canaveral, Florida urges the Florida Legislature to repeal the State's preemption of
local smoke-free air and other tobacco -related laws, and restore the right of local
governments to enact and enforce smoke-free air and other tobacco -related laws.
AND BE IT FURTHER RESOLVED that the City Council of the City of Cape Canaveral,
Florida strongly encourages other local governmental entities in Florida to adopt similar
resolutions.

Summary: Mayor Randels requested Staff design a Resolution in support of the
reThink Program. Initiated by the Florida Department of Transportation (FDOT) for
Central Florida, reThink promotes efforts to help commuters get to work, decrease
congestion, improve air quality, conserve natural resources and save money. reThink
also provides information and education to Central Florida employers and residents
offering programs and services such as Ridematching, Employer Outreach, Commuter
Outreach, Incentive Programs and Emergency Ride Home.
FDOT is working with Brevard County to pass a similar Resolution in January 2011; the
City of Deltona in Volusia County passed a Proclamation in support of the Program in
November 2010.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, SUPPORTING
ALTERNATIVE MODES OF TRANSPORTATION TO COMMUTERS
LIVING IN CENTRAL FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, reThink has been initiated by the Florida Department of
Transportation to promote alternative modes of transportation to commuters living in
Central Florida; and
WHEREAS, reThink is committed to promoting alternative modes of
transportation, such as carpooling and vanpooling, walking and riding bikes, taking
public transit and telecommuting; and
WHEREAS, reThink is a Central Florida program designed to help people save
money, reduce traffic congestion, improve air quality and conserve natural resources;
and
WHEREAS, reThink conducts outreach and provides information and education
to Central Florida employers and residents; and
NOW, THEREFORE, BE 1T RESOLVED that the City Council of the City of Cape
Canaveral, Florida has chosen to support, promote and utilize the programs and
services offered by the Florida Department of Transportation's reThink program.

In Central Florida, 80% of people are driving alone to work every day. That means more than
1.3 million single -occupancy vehicles on the road affecting your quality of life and everyone's
bottom line.
By reThinking the way we get to work, we can decrease congestion, improve air quality,
conserve natural resources, and save everyone a lot of money. Currently, the rate of drive -
alone trips in Central Florida is having a negative impact in each of these areas.
• Congestion
o Those 1.3 million cars with only one person per vehicle contribute to local road
congestion. In fact in 2007, each of us wasted 36 hours just sitting in traffic.
• Air Quality
o Mobile sources (i.e. cars) account for one-third of the nation's air pollution.
o Cars emit a lot of nasty things from their exhaust pipes which have been connected to
heart problems, asthma, and other health issues.
o By the end of 2010, the EPA is going to change the national air quality standards;
depending on what level they choose, Central Florida may not be in attainment. What
this means is a potential freeze on any federal dollars coming to this area for road
projects until we improve local air quality.
• Conserve Natural Resources
o Many trips we take in the car are less than 5 miles. Several short trips can use twice as
much fuel as a longer multi-purpose trip covering the same distance when the engine is
warm.
o Stop -and -go traffic doesn't help fuel economy either: In 2007, each of us wasted 24
gallons of gas due to traffic.
o Imagine 18 -wheelers lined up from Key West to LA to Salt Lake City—that's how many
trucks it would take to hold all of the gas the US wasted due to congestion in 2007
(that's 2.8 billion gallons of gas).
• Save Money
o Each of us spends almost 20% of our income on transportation —the less you make, the
higher the percentage.
o Though it may seem that the only cost to drive is the price of gas, each mile you drive
actually costs you 54 cents.
o If your daily commute is in line with the national average (15 miles each way), you are

In Central Florida, 80% of people are driving alone to work every day. That means more than
1.3 million single -occupancy vehicles on the road affecting your quality of life and everyone's
bottom line.
By reThinking the way we get to work, we can decrease congestion, improve air quality,
conserve natural resources, and save everyone a lot of money. Currently, the rate of drive -
alone trips in Central Florida is having a negative impact in each of these areas.
• Congestion
o Those 1.3 million cars with only one person per vehicle contribute to local road
congestion. In fact in 2007, each of us wasted 36 hours just sitting in traffic.
• Air Quality
o Mobile sources (i.e. cars) account for one-third of the nation's air pollution.
o Cars emit a lot of nasty things from their exhaust pipes which have been connected to
heart problems, asthma, and other health issues.
o By the end of 2010, the EPA is going to change the national air quality standards;
depending on what level they choose, Central Florida may not be in attainment. What
this means is a potential freeze on any federal dollars coming to this area for road
projects until we improve local air quality.
• Conserve Natural Resources
o Many trips we take in the car are less than 5 miles. Several short trips can use twice as
much fuel as a longer multi-purpose trip covering the same distance when the engine is
warm.
o Stop -and -go traffic doesn't help fuel economy either: In 2007, each of us wasted 24
gallons of gas due to traffic.
o Imagine 18 -wheelers lined up from Key West to LA to Salt Lake City—that's how many
trucks it would take to hold all of the gas the US wasted due to congestion in 2007
(that's 2.8 billion gallons of gas).
• Save Money
o Each of us spends almost 20% of our income on transportation —the less you make, the
higher the percentage.
o Though it may seem that the only cost to drive is the price of gas, each mile you drive
actually costs you 54 cents.
o If your daily commute is in line with the national average (15 miles each way), you are
spending at least $4,000 a year just to get to work.

reThink's ERH Program is a back-up plan in case you have to arrange transportation home due to

expense of your emergency ride home.
You must register with reThink in order to use the ERH reimbursement system. After registering,
you may request reimbursement for emergency transportation home up to four times a year, up to
$150 for each occurrence.
How to Qualify

transportation you use to get to work. You must use this
mode at least two times a week to qualify.
