Summary: City Staff has been working as part of the A1A Action Team to reinvigorate
efforts to improve the State Road A1A Corridor. The AlA Action Team consists of
representatives from the City of Cape Canaveral, Cocoa Beach, Brevard County,
Patrick AFB, Canaveral Port Authority, and barrier island businesses. The focus of the
Al Action Team is to identify desired improvements to the Al Corridor from Pineda
Causeway in the south to Port Canaveral in the north and procure funding for the design
and construction. To that end, the Team is preparing an A1A Action Plan to develop
solutions for Al A and prioritize projects that will lead to a safe, multi -modal corridor.
The Space Coast Transportation Planning Organization (TPO) is providing
administrative support for the AIA Action Team and is leading the effort to obtain
funding. Georganna Gillette, Transportation Program Specialist for the TPO, will
present to the Council a description/update of the AIA Action Plan, its purpose and
funding status.

THE GOAL OF THE AM ACTION PLAN IS TO
transform a popular and critical 1960s highway into a
multi -modal route to serve visitors, residents, mer-
chants and commuters, and to support the vision
and economic prosperity of the beachside communi-
ties.
A1A is a critical connection to the Space Coast, pro-
viding access to beach communities and connecting
Patrick Air Force Base with Port Canaveral. Over
4 million people visit this area every year. The area
served by this portion of A1A is undergoing econom-
ic challenges because of the changes with the Space
Program. This 14 -mile Scenic Byway corridor plays
a crucial role in the sustainability and livability of the
region.
The corridor is currently auto -oriented and experi-
ences safety problems, particularly for pedestrians
and bicyclists. The volume of pedestrian and bicycle
is much higher than in other corridors because of the
high number of visitors and beach -goers. Through
the development of vision plans, Cape Canaveral and
Cocoa Beach have identified the need to transform
this corridor into a corridor that serves all modes and
that supports the economic development goals of
the beach communities, the future space program
and the region.
The purpose of this Action Plan is to develop af-
fordable and implementable solutions for A1A and
to identify the priorities and actions necessary to
advance projects that lead to a safe, multi -modal and
economically -supportive A1A. Numerous studies
have been conducted (AIA Investment Study and
the AIA Alternatives Study) that identified the physi-
cal problems and potential solutions to these prob-
lems for the corridor. Other studies (Envision Cape
Canaveral) have identified the goals and objectives of
the area and have identified the future role of A1A in
the realization of the communities' vision.
This Action Plan is intended to be conducted in two
phases. Phase 1 will include the development of a
Draft Action/Implementation Plan, and Phase 2 will
include the assistance in implementation (preliminary
engineering/design build components) of high prior-
ity elements of the Action Plan. This Action Plan will
synthesize the work that has been done to date and
identify the common areas and potential conflicts of
these diverse plans. The A1A Action Team (a local
committee formed to lead this effort) will use this
information to identify and prioritize projects to move
forward for implementation.
Key elements of this Action Plan should include eco-
nomic development/land use policies, streetscape,
pedestrian and bicycle facilities, transit improve-
ments, operational improvements, safety improve-
ments, parallel network, access, signage and
wayfinding, utilities, and sustainability and livability
concepts, and cost and value/price assessments.

Dear Michele,
I wanted to personally thank you for Seaport Canaveral, Corp. contribution to the
Brevard County Sheriffs Office and the Cape Canaveral Volunteer Fire
Departments annual Thanksgiving Meals for those in need,
Your donation of $500.00 fed six families and six "Meals on Wheels " recipients
here in the City of Cape Canaveral. The sixfamilies had children who without
your help would have not have had a traditional Thanksgiving meal.
Likewise, the "Meals on Wheels" recipients were elderly (the oldest being 90
years old) who had no family or friends to share Thanksgiving with. Meals on
Wheels volunteers do not deliver meals during the holidays and again these
elderly citizens would have gone without a Thanksgiving meal.
Once again, you and Seaport Canaveral have come through for the Citizens of
Cape Canaveral. Thank you for your support and partnership with the Brevard
County Sheriffs Office and the Cape Canaveral Volunteer Fire Department.

contribution to the Brevard County Sheriffs Office and the Cape Canaveral
Volunteer Fire Departments annual Santa Wish List.
The donation of children's toys and clothes helped over 30 families and more
than 80 children here in the City of Cape Canaveral have a joyous Christmas.
Without you, your co-workers and most of all Seaport Canaveral, many of these
children would have had a sparse if not a disappointing Christmas. Likewise, the
donation to the family who lost a child and home to fire in Mims will be the most
appreciated. Toys and bicycles were collected for the children and the ,$500
Publix gift card you donated was presented to the parents.

Police Athletic League. Sergeant Scott Pikus informed me he spoke with you to

during that conversation you expressed interest in helping the youth of the City.
Your interest in the Youth Center resulted in you and your company donating a
new 50" Panasonic plasma television.
The City of Cape Canaveral Youth Center is used for after school care, weekend
dances, teen night, and is home to the Brevard County Sheriffs Cape Canaveral
Police Athletic League (PAL). The television will be used by children of all ages
for both educational purposes and for some just plain fun (our annual Mario Cart
Challenge)

PRESENTATION
Subject: Deputy of the Month for December 2010 — Corporal Donald Frantzen
Department: Brevard County Sheriffs Office Cape Canaveral Precinct
Summary: Corporal Donald Frantzen was instrumental in assisting the Cape
Canaveral Precinct during its recent building renovation process. Corporal Frantzen is
a reserve deputy and works for AT&T full time. He came in on his own time on a
Saturday to assist in moving phone lines from the Precinct to our temporary quarters
and when we were ready to move back across the street, Corporal Frantzen showed up
again to make sure the transition back into our facility was fairly painless. During the
entire process, Corporal Frantzen assisted in any way he could to ensure that any
phone loss suffered by the Precinct was minimal. In addition, Corporal Frantzen often
fills in for Deputies who are sick or on leave at a moments notice. Because Corporal
Frantzen is a Military Reservist, all the time he provides to the Precinct is at no cost to
us. Corporal Frantzen is also very active in fund raising events for PAL (Police Athletic
League) and has helped to raise hundreds of dollars for this worthy cause.

Subject: Check presentation to the United Way of Brevard County - proceeds from the
15th Annual Reindeer 5K Run/Walk. Plaque presentation to the major sponsors of the
Reindeer Run in the form of Keys to the City.

Summary:
The 15th Annual Reindeer 5K Run/Walk was held at Cherie Down Park on Saturday,
December 11, 2010. The purpose of this 5K (3.1 mile) run/walk is to raise money for
the United Way of Brevard County. There were 363 participants in this year's event.
Activities included a kid's fun run, door prizes, a visit from Santa, and an awards
presentation. The race raised $3,363.82 for United Way.
Major sponsors donating $1,000.00 in the form of cash or services will receive plaques,
in the form of Keys to the City. The following businesses were major sponsors for this
year's Reindeer Run; Law Firm of Brown, Garganese, Weiss & D'Agresta, P.A., Lite
Rock 99.3, Running Zone, Clear Channel Outdoor, Bright House Networks, Pioneer
Printing & Graphics, and Waste Pro.

City Attorney Garganese provided an update on the Harbor Heights Easements. He
indicated the revised easements are finalized and have been sent to the attorney
representing the property owners. He hoped an answer would be received prior to the
next Council Meeting.

Mayor Randels explained the purpose of the Consent Agenda and read the title of each
item. He inquired if any items are to be removed from the Consent Agenda for discussion.
1. Approve Minutes for Regular City Council Meeting of January 4, 2011.
2. Approve Change Order No. 5 to Brewer Paving & Development, Inc., in the
Amount of $58,194.49 for Field Adjustments for the Ridgewood Avenue Improvements
Project.
3. Accept Library Board Annual Report and approve recommendations for Capital
Expansion Fund Expenditures.
A motion was made by Mr. Morgan, seconded by Mayor Pro Tem Hoog, to
approve the three Consent Agenda Items as presented. The motion carried 5-0
with voting as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, For; Mr. Petsos,
For; Mayor Randels, For; and Ms. Walsh, For.
DISCUSSION:
4. Discussion of City Code Section 110-486 - Resort Dwellings, Resort
Condominiums; Non -Conforming Use Status and Expiration: Mayor Randels provided
a brief review of the number of resort dwellings and resort condominiums. He read the
summary of a memo provided by the City Attorney's Office related to the re -opening of
the application period and which lead to the prior council discussion at the October 19,
2010 meeting. Mayor Randels also noted an e-mail requesting a vote on the matter. A
lengthy discussion ensued and included Council Member Petsos' opinion that there was
a consensus at the October 19th meeting not to re -open this item; Mr. Morgan's opinion
that the process that removed the right for a person who has not renewed a City license
to receive a new one was wrong (Section 110-97) and should be changed; the possible
role of the Planning and Zoning Board in any changes to this section of the Code and
the desire of the Planning and Zoning Board Chairman Russell for the Council to
provide clear direction for any changes they wish to be made; how difficult it is to
prosecute individuals who are advertising resort rentals and do not have a license; a
pilot project that the Department of Business and Professional Regulation is operating,
which allows the local agent to work closer with the local municipalities before new
State licenses are issued; and a request from Council Member Morgan to have more
time to review this item prior to any decisions. During the discussion, Mr. Tom
Hermansen, Mr. Roger Dobsen and Ms. Sandra Trudeau spoke in opposition to re-
opening the application window. Consensus was reached to continue the
discussion of the Ordinance at the next Council Meeting.

Council Member Walsh noted the host City is responsible to provide two individuals for
the registration desk for the Space Coast League of Cities dinners and those two
dinners are paid for by the League, should those individuals wish to stay. She
distributed a listing of the 2011 meetings and noted Cape Canaveral is the host for April.
It was noted the City plans to have the event at Manatee Sanctuary Park again this
year, similar to last year's event.
Council Member Petsos noted Council Member Walsh was installed as the Treasurer of
the Space Coast League of Cities.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA; APPOINTING A SECOND ALTERNATE MEMBER
AS A FIRST ALTERNATE MEMBER TO THE PLANNING AND ZONING
BOARD OF THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by City Code
Chapter 58.26 created a Board known as the Planning and Zoning Board; and
WHEREAS, it is now incumbent upon the City Council of the City of Cape
Canaveral to appoint a Second Alternate Member as a First Alternate Member to said
Board.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. Ronald B. Friedman is hereby appointed as a First Alternate Member

Summary: Public Works Staff obtained three bids for the milling/paving/striping of
portions of Washington Avenue, Church Lane, Columbia Drive, Thurm Boulevard, and
North Atlantic Avenue. Washington Avenue, Church Lane, and Columbia Drive were
previously patched by the City's contractor after the installation of a new force main, but
have recently exhibited a "washboard effect". The proposed project includes the
milling/paving/striping of Washington Avenue (both lanes from Magnolia Avenue to
North Atlantic Avenue), Church Lane (both lanes - entire roadway), Columbia Drive
(west -bound lane only from near SR AIA to Treasure Island Condominiums), Thurm
Boulevard (both lanes — 800 feet of the easternmost portion), and North Atlantic Avenue
(south of Monroe Avenue). The low bidder for the project was APAC Southeast, Inc.
(APAC) in the amount of $81,530. The three bids are summarized in Attachment #1.
City Staff requested that additional tasks be completed by the low bidder since the bids
were obtained. These additional tasks include (1) the striping (double yellow line) of the
entire length of Thurm Boulevard from SR A1A to West Central Boulevard and (2)
widening of the asphalt entranceway to City Hall along the eastern side of the building.
It is estimated that additional funds in the amount of $4,000 will be required to complete
these tasks. Therefore, the total cost for the completion of all tasks is $85,530.

Summary: The Ancient Order of Hibernians is America's oldest Irish Catholic Fraternal
Organization founded concurrently in the coal -mining region of Pennsylvania and New
York City on May, 1836. As has been the custom in previous years, the President of
Division 2, Brevard County, Ancient Order of Hibernians in America, delivered a letter to
the Mayor requesting the City issue a Proclamation declaring March as Irish American
Heritage Month in support of celebrating the contributions of Irish Americans over the
years. The Order will hold a St. Patrick's Day Parade in Melbourne as co-sponsor.
The members of the Order request the City issue a Proclamation designating March
2011 as "Irish American Heritage Month".

WHEREAS, by 1776, nearly 300,000 natives of Ireland had emigrated to
the colonies that would become the United States; and
WHEREAS, following the victory at Yorktown over the English, a French
Major General reported that the Congress owed its existence, and America possibly owed
its preservation to the fidelity of the Irish; and
WHEREAS, at least 8 signers of. the Declaration of Independence were of
Irish origin; and
WHEREAS, 18 Presidents have proudly proclaimed their Irish -American
heritage; and
WHEREAS, in 1782, Commodore Oliver Perry, an Irish -American,
achieved his major naval victory in the Battle of Lake Erie; and
WHEREAS, on June 14, 1794, Irish born John Barry was the first naval
hero of the American Revolution and became Commander -in -Chief of the United States
Navy; and
WHEREAS, in 1892, Irish born James Hoban, and Irish immigrants,
assisted in the construction of the United States Capital; and
WHEREAS, Captain John Barry fought the last sea battle of the
Revolutionary War off the coast of Florida and saved the United States Treasury; and
WHEREAS, in 1943, the Sullivan brothers made the ultimate sacrifice for
democracy and freedom in the world and later had the Destroyer USS Sullivan
commissioned in their memory; and
WHEREAS, Governors and mayors of over 37 states and cities have or will
designate March of this year as "Irish -American Heritage Month"; and
WHEREAS, Irish -Americans have provided leadership in the Political,
Business, and Religious areas of this country since its inception; and

Once again, the Brevard County Irish American Community celebrates its heritage.
Ever since its start under the leadership of the first executive officer, IrishAmerican
Andrew Jackson, Irish Americans of Florida have provided leadership to their
communities.
We are very proud of the current local leaders who are members of the State,
County and Town/City Councils
In the past, the month of March, St Patrick's Day month, has been designated Irish
American Heritage Month throughout the Nation. The Ancient Order of Hibernians
will hold a St Patrick's Day Parade in Melbourne as co-sponsor. We would also
request that your office issue a Proclamation designating March 2011 as "Irish American
Heritage Month", in support of the celebration of the contributions of the Irish
Americans over the years. We have provided a few suggested WHEREAS for your

Summary: Staff has assembled a Five -Year Plan to complete the Ill (Infiltration and
Inflow Retention) Program on all manholes and lift station wet wells throughout the City.
Most manholes are 45+ years old. The City has 12 lift stations with aging wet wells.
Relining will provide protection, repair voids and enhance the structural integrity of
manholes and wet wells. This will reduce the hydraulic load on the Wastewater
Treatment Plant from excessive Ill, which reduces the capability/capacity of the facility.
Phase 1 includes 88 manholes and one wet well - costs are $101,998 to Hinterland
Group Inc. using ("piggybacking") the South Seminole and North Orange County
Wastewater Transmission Authority Bid # 2009-003, Wastewater Pump Station
Construction and Rehabilitation Contractor Continuing Services (Cooperative Purchase
Agreement).

General Description:
REFRATTA HAC 100 is a super high strength repair mortar
specifically designed for use in the sanitary sewer 1
wastewater industry. As a 100% Pure Fused Calcium
Aluminate material, it is highly resistant to Microbiologically
Induced Corrosion ( MIC ) commonly found in municipal
wastewater systems. It is ideally suited for application to lift
-stations, manholes, pump stations and wet wells through a
wet shotcrete method. As a super high early strength
monolithic rehabilitation mortar it has excellent
properties for eliminating infiltration and inflow.
REFRATTA HAC 100 has excellent adhesion properties,
high compressive strength as well as superior abrasion
resistance. The natural occurring elements of REFRATTA
HAC 100 provide excellent resistance to highly acidic
environments and naturally inhibit growth of Thiobacillus
Bacteria commonly found in wastewater environments.

Surface Preparation:
Surface preparation is absolutely vital to optimum
performance and standard industry practices should be
employed, While project specifications may vary it is
universally understood that preparation by high pressure
water blasting or sand blasting should be utilized to remove
all previous coating materials and surface contaminants.
REFRATTA HAC 100 should be applied after all active
infiltration and inflow are eliminated.
Mixing and Application Equipment:
Approved application equipment is strongly recommended
for mixing and application. When mixing, add prescribed
amount of water to hopper prior to introducing
REFRATTA HAC 100 followed with deliberate addition of
material to hopper. Care should be given not to mix
material excessively and introduce air content to wet mix.
When hopper is full of mixed material it should be dumped in
to holding bin and a new batch prepared.

Summary: This program initiative to provide stand-by emergency power at the City's
key lift stations was started three years ago with Phase 1, purchase and installation of a
stand-by generator for Lift Station #1 on Washington Avenue and Phase 2, purchase
and installation of a stand-by generator for Lift Station # 3 on West Central Boulevard.
The next planned phase is to purchase and install a stand-by generator for Lift Station
#2 on Center Street. The general purpose for the generators is to maintain
uninterrupted waste water service for City residents in the event of electrical power
outages, hurricanes and storms; thus assuring the Health, Welfare and Safety of City
residents. This will be an ongoing initiative until completion of all six major City lift
stations (1, 2, 3, 4, 7 and 9). Anticipated installation is approximately 90 days after the
purchase order is issued/received.

Transfer Switch cost - $ 7,985.00
TOTAL COST - $46,574.00

INSTRUCTIONS: Listed above, -you will find the model numbers of the vehicles that will be included in this year's contract.

The automatic transfer switch shall automatically transfer the load to the generator supply in the event of utility
supply failure and return the load to the utility supply upon restoration. The automatic transfer switch power switching
devices shall be mechanically and electrically interlocked to prevent the utility and generator supplies from being
interconnected.
All timers should be Field adjustable to ensure proper field site compatibility.

a.When the voltage on any phase of the utility supply is below present levels of rated voltage for a preset time delay, a
• . contact shall close to initiate start of the standby generator.
b. The load shall transfer to the generator supply when the generator voltage and frequency have reached acceptable
present levels and the warm-up time delay has expired.
c. When the utility supply is restores to the above present levels of rated voltage on all phases, load transfer from
generator to utility supply shall be initiated following expiry of the utility return timer.
d. Once the transfer mechanism operates and opens the generator power switching device, the transfer mechanism shall
stop in the neutral position (i.e. with the both power switching devices open) for the duration of the neutral delay timer
setting to allow load voltage to decay prior to reconnecting the utility supply.
e. The load shall he re -connected to the utility supply once the neutral delay timer expires and the transfer mechanism
continues operation and closes the utility power switching device.
f. The load shall immediately retransfer to the utility supply (if within acceptable limits) should the generator supply fail
prior to the expiry of the utility transfer delay.
g. The generator set shall continue to operate following a load transfer for a cool down delay period, and then a contact

shall open to stop the generator set.
An "on load" test mode may be initiated which shall cause a simulated utility failure condition and transfer the load to
the generator set. The transfer sequence shall be the same as for a utility power failure except a neutral delay sequence
shall occur when transferring from utility to a generator source.
The load shall immediately retransfer to the utility supply (if within acceptable limits) should the generator supply fail
during an "on load" test mode.
5. FACTORY TESTING:
a. A certified factory test report shall be shipped with each switch at time of shipment.
b. The automatic transfer switch shall be factory tested prior to delivery to the purchaser. The following test shall be
conducted by qualified factory personnel:
c. Visual Inspection
d. Mechanical Tests
e. Electrical Tests
f. Final Inspection
6. ELELD TESTING AND COMMISSIONING:
a. The automatic transfer switch shall be field tested once installed at the project site to confirm proper operation of the
system. Schedule and witness testing activities shall be coordinated with the project engineer, site contractor, and
owner as required in advance of the testing date. A qualified local factory -trained field representative shall conduct the
necessary test to ensure proper operation of the switch.
b. Visual Inspection: Electrical and Mechanical inspection to verify the installation is correct as recommended by the
transfer switch manufacturer and as per National Electric Cods (NEC) requirements.
c. Mechanical Tests: As a minimum, the following mechanical tests shall be performed on the transfer switch:
d. Power conductor torque verification
e. Verification of mechanical interlock
£ Manual ATS Mechanism Operation
g. All Mechanical Fasteners/Wire Connections Tight
h. Confirmations of correct transfer switch voltage, current and withstand ratings as is required for the application.
i. Meggar testing the power cabling to the transfer switch.
j. Verification of correct power cabling phasing and phase rotation prior to energization.
k. Confirmation of settings for all timers & voltages sensors.
I. Full Function test -normal operation — 3 complete cycles of failing the utility supply, and transfer load to/from the
generator set.
m. Verification of all test modes operates correctly.
7. CONDITIONS,
a. In addition to equipment specified, each automatic transfer switch shall be equipped with all necessary equipment as
specified by the manufacturer for this model and shall include but not be limited to the following necessary items:
b. Shrink Wrap applied to the product to ensure a clean finish.
c. One complete set of operation and maintenance manuals.
d. A two (2) year or 1500 hour from date of standard standby warranty will apply from date of successful start-up.
Labor, materials, and travel for the warranty period repair will be paid by manufacturer during normal business hours.

In addition to equipment specified, vehicle shall be equipped with all standard equipment as specified by the manufacturer for
this model and shall comply with all EPA Emission Standards and all Motor Vehicle Safety Standards as established by the
U.S. Department of Transportation regarding the manufacture of motor vehicles.
The successful bidder shall be responsible for delivering vehicles that are properly serviced, clean and in first class operating
condition. Pre -delivery service, at a minimum, shall include the following:
a. Complete lubrication.
b. Check all fluid Ievels to assure proper fill.
c. Adjustment of engine to proper operating condition.
d. Inflate tires to proper pressure.
e. Check to assure proper operation of all accessories, gauges, lights, and mechanical features.

While the Florida Sheriffs Association, Florida Association of Counties and Florida Fire Chiefs' Association have attempted to

needs and preferences are going to vary from agency to agency. In an effort to incorporate flexibility into our program, we have
created specific add/delete options which allow the purchaser to tailor the vehicle to their particular wants or needs.
The following equipment delete and add options and their related cost are provided here to assist you in approximating the total cost
of the type vehicle(&) you wish to order through this program. Simply deduct the cost of any of the following equipment items you
wish deleted from the base unit cost and/or add the cost of any equipment items you wish added to the base unit cost to determine the

7. S,IART UP AND TESTING:
a. Vendor must coordinate all start up and testing activities with the engineer and owner. After installation is completed
by others and normal power is available, the vendor must perform a one (I) day start-up including the use of building
load. The start-up technician will instruct all necessary personnel how to operate and maintain the equipment in
accordance to the manufacturer's requirements.
S. CONDITIONS:
a. In addition to equipment specified, each generator shall be equipped with all standard equipment as specified by the
manufacture for this model and shall include but not be limited to the following necessary items:
b- Initial filing of oil and antifreeze.
c. Shrink wrap applied to the product to ensure a clean finish.
d. During the start-up, the technician shall record the following information and provide to the owner for his records:
e. Record Operating Voltage, Hz, Ph, and connected load (Amperage)
f. Package information consisting of Make of generator (Cat, Wacker, or Tradewinds), Model (TJ 125 TP20, DP 125,
etc.), Serial number of complete package, and Start-up date.
g. Record engine and generator serial numbers.
h. One complete set of operation and maintenance manuals.
i. Two (2) year or 1500 hour standard standby generator warranty. Labor, materials, and travel for the warranty period
repair will be paid by manufacturer during normal business hours.
In addition to equipment specified, vehicle shall be equipped with all standard equipment as specified by the manufacturer for
this model and shall comply with all EPA Emission Standards and all Motor Vehicle Safety Standards as established by the
U.S. Department of Transportation regarding the manufacture of motorvehicles-
Thesuccessful bidder shall be responsible for delivering vehicles that are properly serviced, clean and in first class operating
condition. Pre -delivery service, at a minimum, shall include the following:
a. Complete lubrication.
b. Check all fluid levels to assure proper fill.
c. Adjustment of engine to proper operating condition.
d. Inflate tires to proper pressure.
e. Check to assure proper operation of all accessories, gauges, lights, and mechanical features.

Subject: Discussion of City Code Section 110-486 - Resort Dwellings, Resort
Condominiums; Non -Conforming Use Status and Expiration.

Summary: At the January 18, 2011 City Council meeting, the City Council discussed the
potential application of the current nonconforming use provisions of the Resort Dwelling and
Resort Condominium Ordinance. At the meeting, there appeared to be consensus by the
Council to make at least one modification to Section 110-486(c)(2) to relax the nonconforming
use termination provision based solely on the 30 day lapse of the State license. In addition,
Councilmember Morgan made a request for additional time to further evaluate the Ordinance.
The Council agreed to continue discussion of the matter after Councilmember Morgan had an
opportunity to finish his evaluation. Since the last meeting, Councilmember Morgan has had an
opportunity to evaluate the Ordinance and to discuss the same with Staff.
The following relevant City Code excerpt addresses the loss of non -conforming status for any
non -conforming resort dwellings or resort condominiums:
(c) Any resort dwelling or resort condominium deemed nonconforming pursuant to this section
shall lose its nonconforming status if anyone of the following occurs:
(1) The resort dwelling or resort condominium use is abandoned pursuant to section 110-
197 of this Code;
(2) The Division of Hotels and Restaurants of the Florida Department of Business and
Professional Regulation revokes the resort dwelling's or resort condominium's license for
whatever reason, or if said license should otherwise expire or lapse at any time for a period
of time in excess of 30 days.
(3) The resort dwelling or resort condominium unit has been repeatedly found to be in
violation of applicable building, fire and zoning code requirements on more than three
separate occasions within the previous three-year period commencing on the date that the
most recent violation was cited. For purposes of this subsection, the term violation shall
include those violations declared by the state or the city or a combination of violations
declared by the state and city.
This Agenda item is submitted to permit the City Council to continue its discussion of the
nonconforming status provisions of the Resort Dwelling and Resort Condominium Ordinance
and to provide Staff direction the City Council deems appropriate.

Sec. 110-486. - Resort dwellings, resort condominiums; nonconforming use status,
expiration.

Resort dwellings and resort condominiums that are not located within a C-1 zoning district shall be
deemed a nonconforming use subject to the provisions of chapter 110, article V, Nonconformities,
of this Code, provided said resort dwelling or condominium is declared existing in accordance [with]
the terms and conditions set forth in this section.
In order to be declared existing under this section, the owner of the resort dwelling or resort
condominium shall timely obtain a certificate of nonconforming status from the city manager as
follows:
The owner shall file a written notice of intent with the city manager within 30 days of June
19, 2007, which declares and registers the owner's intent to duly license an existing
dwelling unit or condominium unit as a resort dwelling or resort condominium in
accordance with applicable provisions of F.S. ch. 509. The city manager shall promulgate
a form to be used by owners for purposes of declaring their intent under this subsection. A
$100.00 filing fee per existing unit and a $100.00 filing fee for a preliminary nonconforming
certificate is also hereby established and required to be paid by the owner at the time of
filing the notice of intent. If the owner falls to timely file a notice of intent within the 30 -day
time period for a particular dwelling or condominium unit, the owner shall be barred from
claiming nonconforming status under this section for said unit.

Fxrept as provided in subsection (b)(5), within one year of filing the notice of intent
required by subsection (b)(1), the owner shall have obtained the requisite license from the
Florida Department of Business and Professional Regulation and certificate of occupancy
from the building official for the subject dwelling or condominium unit. Proof of the
requisite licensure and certificate of occupancy shall be submitted to the city manager
within the one-year time period, and upon receipt and verification of the same, the city
manager shall issue, and record in the official public records of Brevard County, Florida, a
certificate of nonconforming status to the owner for the subject dwelling or condominium
unit. If the owner fails to provide proof of the license and certificate of occupancy within
the one-year time period required by this subsection, the owner shall be barred from
claiming nonconforming status under this section even though a notice of intent was filed
under subsection (b)(1).
Proof of the requisite certificate of occupancy shall require the owner to satisfactorily
demonstrate to the building official compliance with all applicable building codes and to
also satisfactorily demonstrate to the fire chief compliance with all applicable fire codes. In
furtherance of this requirement, the owner shall be required to file with the building official
and fire chief a life safety plan for the subject dwelling or condominium unit within 30 days
following the filing of the notice of intent required under subsection (b)(1), unless filing of
the life safety plan is otherwise required by state law. Such plan shall contain the
information deemed necessary by the building official and fire chief in order to determine
compliance with the applicable building and fire codes. Upon acceptance of the life safety
plan by the building official and fire chief, the owner shall have 90 days in which to file
detailed plans and specifications covering all repairs and improvements required to
demonstrate compliance with all applicable building and fire codes, unless filing of the
plans and specifications is otherwise required by state law.
The one-year time period may be extended by the building official or fire chief for good
cause shown, provided that the owner has demonstrated a good -faith effort to comply with
the provisions of this section and the owner has not unlawfully used the subject unit in
violation of this section after June 19, 2007.
A preliminary certificate of nonconforming status for a resort dwelling or resort
condominium shall be issued for a dwelling unit that has not yet been constructed,
provided a site plan application for the construction of the dwelling unit has been approved
by, or filed with, the city by June 19, 2007, and pursuant to subsection (b)(1), the owner

has timely filed a notice of intent with the city manager which declares and registers the
owner's intent to duly license the proposed dwelling unit or condominium unit as a resort
dwelling or resort condominium in accordance with applicable provisions of F.S. ch. 509,
when the unit is constructed. However, upon issuance of a preliminary certificate of
nonconforming status, the owner shall be required to comply with the following additional
conditions in order to receive a final certificate of nonconforming status:
(i)
If a site plan was filed, but not yet approved, before June 19, 2007, the owner
shall have one year from June 19, 2007, to obtain site plan approval to construct
the dwelling unit(s) or condominium unit(s);
(ii)
At the time the dwelling or condominium unit receives an initial certificate of
occupancy from the building official, the unit shall meet the building and fire code
standards applicable to resort dwellings or resort condominiums; and
Within 60 days of receiving a certificate of occupancy for a resort dwelling or
resort condominium unit, the owner shall be required to obtain the requisite
license from the Florida Department of Business and Professional Regulation for
said unit and shall obtain a final certificate of nonconforming status.
If the owner constructs the units and fails to meet the aforementioned conditions,
the owner shall be barred from claiming nonconforming status under this section
even though a preliminary certificate of nonconforming status was issued.
Any resort dwelling or resort condominium deemed nonconforming pursuant to this section shall
lose its nonconforming status if any one of the following occurs:
(1)
The resort dwelling or resort condominium use is abandoned pursuant to section 110-197
of this Code;
(2)
(3)
The Division of Hotels and Restaurants of the Florida Department of Business and
Professional Regulation revokes the resort dwelling's or resort condominium's license for
whatever reason, or if said license should otherwise expire or lapse at any time for a
period of time in excess of 30 days.
The resort dwelling or resort condominium unit has been repeatedly found to be in
violation of applicable building, fire and zoning code requirements on more than three
separate occasions within the previous three-year period commencing on the date that the
most recent violation was cited. For purposes of this subsection, the term violation shall
include those violations declared by the state or the city or a combination of violations
declared by the state and city.
(d)
It shall be unlawful for an owner to operate a resort dwelling or resort condominium in a zoning
district other than C-1 (low density commercial district) unless the owner has obtained a certificate
of nonconforming status under this section. In furtherance of the public health, safety and welfare of
the public that occupy resort dwellings and resort condominiums, the city manager is hereby
authorized to take whatever lawful steps are necessary, with the assistance of the building official
and fire chief, to require that the operation of a resort dwelling or resort condominium with in the
city is in compliance with the city's zoning and certificate of occupancy requirements. Said steps
may include, but are not limited to, seeking injunctive relief in a court of competent jurisdiction.

Sec. 110-487. - Rental restrictions on dwelling units.
It shall be unlawful for any person to rent a dwelling unit for less than seven consecutive days in
any zoning district, excluding hotels, motels under subsection 110-332(4) and resort condominiums in the C-
1 zoning district.
