HomeMy WebLinkAboutMunicipal Election Agreement 1988 ti MUNICIPAL ELECTION AGREEMENT THIS AGREEMENT made and entered into this 20th day of CePtawber ,1988 by and between the CITY of Cape Canaveral , hereinafter referred to as "City ", and the BOARD OF COUNTY COMMISSIONERS AND SUPERVISOR OF ELECTIONS OF { BREVARD COUNTY, FLORIDA, hereinafter referred to as "County ". W I T N E S S E T H: 1 WHEREAS, the City has adopted a single permanent registration system with the County for the registration of sF electors of the City; and Y WHEREAS the City desires the County to conduct all elections for the City of Cape Canaveral ; and WHEREAS, the City agrees that it shall promptly notify the County of the proposed date and time of the election; and WHEREAS, the City will agree to fully cooperate with the i County in providing the proper information to the County in a timely fashion. NOW, THEREFORE, in consideration of the premises and covenants herein contained, the County and the City agree as follows: 1. The County agrees to do the following: (a) To set all election dates as provided in Section 100.51, Florida Statutes. The City recognizes that it shall not call any special election until written notice is given to the County and the consent of the Supervisor of Elections is obtained as to a date when the registration books can be reasonably available. (b) Provide adequate polling place facilities for each precinct. (c) Furnish and place at each polling place sufficient voting equipment. (d) Provide City Clerk with a list of registered voters qualified to vote in the City Election. # I (e) Appoint Clerks and Inspectors at each polling place to conduct the election. (f) Furnish and place at each polling place the registration records for each precinct. (g) Coordinate printing of ballots. (h) Provide for absentee voting in accordance with the provisions of the Laws of the State of Florida. (i) Handle tabulation and counting of all precinct and absentee ballots. Advertise official Logic and Accuracy Test of voting equipment pursuant to Florida Law. 2. The City agrees to do the following: (a) Furnish the County, by the close of business, on the last day of qualification, a certified copy, under seal of the City Clerk, of the proposed ballot showing the exact names of all qualified candidates for the election for each office as they will appear on the official ballot. The City shall also furnish the exact wording of questions or issues to be placed on the ballot by the same date. (b) To be bound by the Laws of the State of Florida and specifically the Election Code of the Florida Statutes in conducting the City Election. (c) Cause the sample ballot to be advertised in the newspaper as required by law. (d) The City shall be responsible for paying the cost of all .legal_ advertisements and all other costs of its election. (e) The City shall pay the normal rate paid by the County for the Election Board when its election is not held in conjunction with a County, State or National Election. 3. The Supervisor of Elections shall count all votes, including absentee votes, certifying in duplicate the votes cast for each candidate. The Supervisor of Elections shall deliver two copies of the Certificate of Results of election to the City s _ Clerk who shall transmit one copy to the Mayor. The Mayor and the City Clerk shall transmit the returns to the City Council at a special meeting for the canvassing of the election which shall be held as soon as practicable following the election. After receiving the returns, including absentee ballots, $ i the City Council shall approve the election results as submitted by the County and the City Council shall declare the results of the election based on said returns. The City shall then submit one copy of their Certification of Election to the Supervisor of Elections, This City Election Agreement shall remain in full force and effect and continue from year to year until terminated by either party by giving at least sixty (60) days written notice to the other party. Notice• to the County shall be given to the County's Administrative Director and the Supervisor of Elections. Notice to the City shall be given to the City Clerk, • THE PARTIES hereto, by their respective proper officials, execute this Agreement on the date aforesaid. I � NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cape Canaveral, Florida, as follows: I SECTION 1. The Mayor and the City Clerk are hereby authoriz- ed to execute an agreement with the Brevard County Board of County Commissioners to conduct the municipal elections in the 1 City of Cape Canaveral. A copy of said agreement is attached 1 I hereto and made a part hereof by reference. SECTION 2.
