MINUTES
CALL TO ORDER: The Chair called the Meeting to Order at 7:00 P.M. and led the pledge
of allegiance.

REPORTS:
City Attorney Garganese provided an update on the Harbor Heights Easements. He
indicated the revised easements are finalized and have been sent to the attorney
representing the property owners. He hoped an answer would be received prior to the
next Council Meeting.
BUSINESS & CULTURAL DEVELOPMENT BOARD REPORT: No report.

Mayor Randels explained the purpose of the Consent Agenda and read the title of each
item. He inquired if any items are to be removed from the Consent Agenda for discussion.
1. Approve Minutes for Regular City Council Meeting of January 4, 2011.
2. Approve Change Order No. 5 to Brewer Paving & Development, Inc., in the
Amount of $58,194.49 for Field Adjustments for the Ridgewood Avenue Improvements
Project.
3. Accept Library Board Annual Report and approve recommendations for Capital
Expansion Fund Expenditures.
A motion was made by Mr. Morgan, seconded by Mayor Pro Tem Hoog, to
approve the three Consent Agenda Items as presented. The motion carried 5 -0
with voting as follows: Mayor Pro Tem Hoog, For; Mr. Morgan, For; Mr. Petsos,
For; Mayor Randels, For; and Ms. Walsh, For.
DISCUSSION:
4. Discussion of City Code Section 110 -486 - Resort Dwellings, Resort
Condominiums; Non - Conforming Use Status and Expiration: Mayor Randels provided
a brief review of the number of resort dwellings and resort condominiums. He read the
summary of a memo provided by the City Attorney's Office related to the re- opening of
the application period and which lead to the prior council discussion at the October 19,
2010 meeting. Mayor Randels also noted an e-mail requesting a vote on the matter. A
lengthy discussion ensued and included Council Member Petsos' opinion that there was
a consensus at the October 19th meeting not to re -open this item; Mr. Morgan's opinion
that the process that removed the right for a person who has not renewed a City license
to receive a new one was wrong (Section 110 -97) and should be changed; the possible
role of the Planning and Zoning Board in any changes to this section of the Code and
the desire of the Planning and Zoning Board Chairman Russell for the Council to
provide clear direction for any changes they wish to be made; how difficult it is to
prosecute individuals who are advertising resort rentals and do not have a license; a
pilot project that the Department of Business and Professional Regulation is operating,
which allows the local agent to work closer with the local municipalities before new
State licenses are issued; and a request from Council Member Morgan to have more
time to review this item prior to any decisions. During the discussion, Mr. Tom
Hermansen, Mr. Roger Dobsen and Ms. Sandra Trudeau spoke in opposition to re-
opening the application window. Consensus was reached to continue the
discussion of the Ordinance at the next Council Meeting.

Council Member Walsh noted the host City is responsible to provide two individuals for
the registration desk for the Space Coast League of Cities dinners and those two
dinners are paid for by the League, should those individuals wish to stay. She
distributed a listing of the 2011 meetings and noted Cape Canaveral is the host for April.
It was noted the City plans to have the event at Manatee Sanctuary Park again this
year, similar to last year's event.
Council Member Petsos noted Council Member Walsh was installed as the Treasurer of
the Space Coast League of Cities.
