The City is requesting a variation for the minimum clear recovery zone requirement along State Road Al (SR A1A) for the installation of three bus shelters and eight bus benches/trash containers. The current minimum clear recovery zone requirement for SR Al within the City limits is 24 feet (based on a speed limit of 45 miles per hour with no curb and gutter system present). The proposed minimum clear recovery zones for the bus shelters and bus benches /trash containers are (1) seven sites at greater than 20 feet and four sites at between 15 feet and 20 feet. The City is attempting to rehabilitate a number of residential and commercial areas within the City limits; these plans include the general cleanup of the SR A1A corridor. A significant part of the City's efforts along SR Al is the installation of bus shelters and bus benches /trash containers at all Space Coast Area Transit Authority (SCAT) bus stops. Currently, there are 11 bus stops along SR Al within the City limits. Residents waiting on SCAT buses at these locations are exposed to the weather and frequently use dilapidated chairs, benches, and other items to sit on and wait for buses (many times immediately adjacent to the roadway) — thus the lack of safety and the general unsightliness of the bus stop sites. The City has received grant funding through Brevard County (SCAT) for the installation of three bus shelters (break -away design) and eight bus benches /trash containers (removable) along SR Al within the City limits. The project also includes the installation of bus shelters and bus benches /trash containers at numerous locations on City -owned streets. The current speed limit on SR A1A within the City limits is 45 miles per hour. In addition, a curb and gutter system is not present along the roadway — drainage swales are present in most areas. With a maximum FDOT right -of -way of 100 feet, it is not possible for the City to install bus shelters and bus benches /trash containers on SR A1A at the required minimum clear recovery zone distance (24 feet) and remain in the FDOT right -of -way. No other non - compliance issues have been identified with the proposed sites (i.e., within 15 feet of a fire hydrant, within site visibility triangles at intersections, etc.). (Note: Numerous past attempts by the City to have the speed limit reduced to 35 miles per hour on SR Al within the City limits have not been successful. In addition, construction of a curb and gutter system on SR Al is not anticipated in the near future.) We appreciate your time and consideration of this matter. Introduction As we stated during our meeting, the City is attempting to rehabilitate a number of residential and commercial areas within the City limits; these plans include the general cleanup of the SR A 1 A corridor. Other City -wide efforts include the completion of a Master Visioning Plan, revising various planning and zoning ordinances, and the possible establishment of a Community Redevelopment Agency (CRA). A major part of the City's efforts in the general cleanup of SR A 1 A is the construction of bus shelters and the installation of bus benches at all Space Coast Area Transit Authority (SCAT) bus stops. Currently, there are 11 bus stops along SR AIA within the City limits (see attachment A). Residents waiting on SCAT buses at these locations are exposed to the weather and frequently use dilapidated chairs, benches, and other items to sit on and wait for buses (many times immediately adjacent to the roadway) — thus the general unsightliness of the bus stop sites. J r - � To fund the proposed project, the City has received grant funding for FY2009 -2010 through SCAT to perform all tasks relating to the construction of bus shelters and the installation of bus benches along SR AIA as well as at 12 other bus stop locations along City streets. Attachment B includes photographs of each proposed site with approximate distances of all proposed structures relative to SR A IA. Bus Shelters /Bus Benches /Trash Containers. The City is proposing the construction of three bus shelters and the installation of eight bus benches/trash containers at the 11 bus stop sites along SR AIA. The bus shelter locations (3) will include a "break- away" shelter design (4' x 10') selected by the City Council and approved by SCAT and will require an at -grade concrete pad approximately 5' x 12'. Each bus shelter site will also include a removable concrete trash container. The bus bench locations (8) will include a removable concrete bench (5' in length) and removable concrete trash container. Each bus bench location will require an at -grade concrete pad approximately 4' x 7'. Right -of -Way Issues Since the speed limit on SR AIA is 45 miles per hour within the City and there is no curb and gutter system currently present, Chapter 14 -20, Florida Statutes, mandates that bus shelters and bus benches have a minimum clear recovery zone of 24 feet. However, due to the wide pavement and the maximum of 100 feet of Florida Department of Transportation (FDOT) right -of -way, it is not possible for the City to meet these requirements. Therefore, as shown on the attached site - specific photographs, the City is respectfully requesting that construction of bus shelters and the installation of bus benches /trash containers be allowed by the FDOT at the 11 locations with a clear recovery zone of less than 24 feet. The proposed clear recovery zone for each location will vary depending on the specific location (see attached photographs). No other non - compliance issues have been identified with the proposed sites (i.e., within 15 feet of a fire hydrant, within site visibility triangles at intersections, etc.). Please note that the measurements (e.g., distance from the proposed bus shelter to the "white line ") shown on the photographs are estimates — since the exact right -of -way line is not known at this time. However, please note that the right -of -way lines will be surveyed by a professional surveyor at each proposed location prior to any construction activities occurring. In addition, the concrete pads for each bus shelter or bus bench will be placed at the back of the right -of -way - the furthest distance in the right -of -way from the "white line" (see attached photographs).
