Home My WebLink AboutOrdinance No. 01-2005ORDINANCE NO. 01 -2005 AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, REPEALING IN ITS ENTIRE'T'Y CHAPTER 40, ARTICLE 11, HUMAN RIGHTS; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT [ORDINANCES AND RESOLUTIONS, SEVERABILITY, INCORPORATION INTO THE CODE, AND AN EFFECTIVE BATE. WHEREAS, the City Council finds that discrimination based on race, creed, color, national origin, or sex is intolerable; and WHEREAS, the City Council also finds that there are ample State and Federal regulations prohibiting and penalizing such discriminatory practices; and WHEREAS, the City Council further finds that it does not have the resources to police such discriminatory practices in the private sector in the manner provided for in Chapter 40, Article 11, City Code; and WHEREAS, the City Council hereby deems that this ordinance is in the bests interests of the public health, safety, and welfare of the citizens of Cape Canaveral; and WHEREAS, the act of repealing Chapter 40, Article II, City Code should not be construed in any manner whatsoever as promoting, condoning, or encouraging discriminatory practices on the basis of race, creed, color, national origin, or sex. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Brevard County, Florida as follows: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings and the intent and purpose of the City Council of the City of Cape Canaveral. Section 2. Code Amendment. That Chapter 40, Human Relations, Article II of the Code of Ordinances, City of Cape Canaveral, Florida, is hereby amended as follows: (underlined type indicates additions and type indicates deletions, while asterisks �* * * } indicate a deletion from the ordinance of text existing in Chapter 40. It is intended that the text in Chapter 40 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this Ordinance }. Section 5. Severability. If any section, subsection, sentence, clause, hrase word or provision oft p p his ordinance is for any reason held invalid or unconstitutional b an court of competent Y jurisdiction, p whether for substantive, procedural, or any other reason, such p ortion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6 . Effective Date. This Ordinance shall become effective immediate) u pon adop y p p on by the City Council of the City of Cape Canaveral, Florida.
