City Clerk Virginia Haas Building Official Todd Morley City Planner Todd Peetz DISCUSSION 1. City Code Review: Article VI Site Plans 110 -222 through 110 -339. City of Cape Canaveral, Florida Code Review Workshop June 20, 2006 Page 2 of 4 ARTICLE VI. SITE PLANS* Ms. Bea McNealy requested to review item 110 -222 (1)(g) regarding preliminary plats which should be approved by the City Council not the Planning and Zoning Board. The ordinance concerning approval of preliminary plats will be approved for second reading at tonight's City Council meeting. Attorney Garganese stated that a conforming amendment to subparagraph (g) needs to be adopted in conjunction with the approval of the ordinance. Mr. Russell asked that considering the proposed change, why should the Planning and Zoning Board see the final plat. Attorney Garganese responded to Mr. Russell that the Planning & Zoning Board should act in an advisory capacity in regards to preliminary and final plats. City Council agreed that the Planning and Zoning Board should recommend preliminary and final plats to City Council. Mayor Randels stated that City Council never sees the structure on the plats. Attorney Garganese stated that City Council should give approval for the preliminary plat and it should be stated in the ordinance. He continued that this change could be added to ordinance 07 -2006 which was being approved at tonight's meeting. Attorney Garganese responded to Mr. Russell that a lot is subdivided when an applicant records the plat in the county public records. Attorney Garganese continued that should an applicant divide land in conjunction with site plan approval, the site plan will only be considered after the City Council has approved the preliminary plat. Mr. Peetz explained that developments of four units or less are not reviewed by the Planning and Zoning Board therefore there is no site plan. Mayor Randels clarified that this section pertains to more than four units. Attorney Garganese stated for conformity purposes that each section containing the word Planning & Zoning Board would be replaced with City Council and the change could be adopted by Ordinance 07 -2006. Mayor Randels summarized the change to 110- 122(1)(g) "In those site plans which require a subdivision of land, no site plan shall be approved until the City Council has given approval to the preliminary plat." Mayor Randels moved on to section 110 - 222(2) Topographic surveys. Mr. Morley requested adding to the requirements to show all vacated easements. Mr. Peetz noted that existing easements are shown on the surveys and requested that the existing and proposed easements also be shown on the site plan. Mr. Morley suggested adding "easements being vacated by this plan ". Mr. Morley mentioned the Sea shell Cay development where the north and south sewer easements were vacated by the submitted site plan. Attorney Garganese suggested adding to the information required by the site plan "existing or proposed easements ". He continued that if the proposed public easement was a part of the plat, the applicant would desire to depict that easement on the plat before recording. Further, if the easement was private access, the City would want to ensure that the easement is prepared and recorded in conjunction with site plan. City of Cape Canaveral, Florida Code Review Workshop June 20, 2008 Page 3 of 4 Attorney Garganese replied to Mr. Russell that the City Council can impose conditions, safeguards and require easements. Mayor Randels summarized the changes to 110 - 221(2)(c) "Lot lines and dimensions of all setbacks, structures and existing or proposed easements. Mr. Donald Dunn asked if parking is considered under roof. Mr. Peetz requested requirement of the total impervious area for stormwater drainage purposes and total building coverage ratio. Discussion continued regarding lot coverage and lack of green space. Ms. Bea McNeely noted that she attended a conference recently where they spoke about "Green Roofs ". Changes requested to 110 - 222(4): (4) Square footage o. building fef the following: a. Living area. b. Parking area. c. Other. d. Total impervious area and building coverage ratio. e. Total under roof. Sec. 110 -223. Review procedures. Mayor Randels questioned if five copies of the site plan are sufficient. Mr. Peetz replied that at this stage five is sufficient. Mr. Peetz replied to Mayor Randels that the City Planner and Public Works Director each get a copy of the site plan, however, the applicant is required to mail a copy of the site plan to State Department of Environmental Protection. Changes requested to 110 -223: (b) The site plan shall be submitted by the building department to the following department heads for their review and comments: (1) City engineer or registered engineers approved by the city. (2) Building department. (3) Fire marshal. (4) City Planner (5) Public Works Director Mr. Peetz stated that often applicants will ask for site plan review immediately following staff's initial red line changes so applicant may submit for the next Planning and Zoning Board agenda. Mr. Boucher summarized that once the Building Official deems all revisions have been submitted and all comments reviewed, he shall schedule the site plan for the next Planning & Zoning Board. Mr. Boucher noted that agendas are prepared seven days prior to any meetings. Changes requested to 110 -223: City of Cape Canaveral, Florida Code Review Workshop June 20,2006 Page 4 of 4 (c) Within 14 days of the time the plans are received by the various department heads, they shall submit, in writing, to the building department, a written report commenting on factors relating to the site plan. (d) The building department shall give a copy of the written comments to the applicant or his representative to review, respond to and make any changes he deems appropriate to conform to the comments and recommendations from the department heads. e) Subsequent re-submittal will be reviewed by staff within 14 days. 4e4 After incorporating all of staffs written comments the applicant shall submit. seven ELEVEN copies of the revised sit plan to the building department, - - - • . .•- - - _ - I- - - - • - _ - - - • • = in =- - - - _ - =- - •• - • _ - - -, _ - -, - • - - - • - - _ - - • = • no later than five SEVEN days prior to the planning &zoning board meeting. Mr. Morley responded to Mayor Randels that there is a site plan checklist provided to the applicant for submittal to the board. Recommended change: (f) All plans shall be made available to the planning and zoning board for its review and recommendation to the city council. The building official 1 shall prime PROVIDE a site plan checklist to be submitted to the planning and zoning board when a site plan is reviewed.
