Chairperson Bea McNeely called the meeting to order at 7:30 p.m. The Secretary called the roll. Motion by Harry Pearson, seconded by John Fredrickson, to approve the meeting minutes of February 28, 2007. Vote on the motion carried unanimously. 2. Recommendation to the City Council Re: Caribbean Vistas Preliminary Replat, Section 23, Township 24 South, Ranqe 37 East, Replat of Lots 9 & 10, Avon by the Sea Subdivision - Daniel and Kathleen Coons, Applicants. Todd Peetz, City Planner, gave an overview of the property. He noted that the Preliminary Replat was for four proposed townhouse units. He advised that the existing swimming pool was already removed; and there were no easements being vacated. The Board members reviewed the staff reports and submittal packet. Daniel Coons, Applicant, advised that the existing single family structure will be demolished. Brief discussion followed. Todd Peetz, City Planner, advised that the Public Works Director was not in attendance. He gave an overview of the easement vacation request, based on the staff report from the Public Works Director recommending the easement vacation be granted. Brief discussion followed. Motion by Harry Pearson, seconded by Lamar Russell, to recommend approval of the requested easement vacation for Perlas Del Mar. Todd Peetz, City Planner, advised that the City has issues with a few of the existing industrial uses not being compatible with abutting residential properties, more specifically, Ambassador Services and Coastal Fuels. The Board members asked for staff direction. Todd Peetz suggested that the Board review principal uses and uses by special exception in the M-1 zoning district. He further suggested creating performance standards and criteria for: separation, noise, dust, smoke, emissions, odor, lighting, residue, and buffering. Discussion was held regarding regulating and enforcing nuisances; potential incompatibilities; creating buffer districts; property rights; establishing distance requirements; types of principal uses; defining light manufacturing, and types of similar uses. A citizen of Solana Lakes voiced her concerns regarding smoke, odor, and emissions coming from the asphalt at Coastal Fuels. The Board discussed utilizing the City of Sanford's nuisance ordinance, as an example, when the City considers implementing a nuisance code during the zoning code review. Planning & Zoning Board Meeting Minutes March 14,2007 Page 3 OPEN DISCUSSION John Fredrickson inquired about the Gould's special exception. Todd Peetz, City Planner, responded that the special exception has a granted time extension. John Fredrickson inquired about the special exception that was granted for parking boats and RV's next to Builder's Supply. Todd Peetz, City Planner, replied that there has been no contact from the petitioner. John Fredrickson asked staff to keep the Board updated on the status of granted special exceptions. Todd Peetz, City Planner, advised that the City is having a Community Celebration on Saturday, March 17th, from 11 :00 a.m. - 2:00 p.m., at Manatee Sanctuary Park. He will have an information table and will hand-out a survey regarding community topics. He distributed a sample of the survey and asked the Board members for feedback. The letter of understanding is a recommended action by the FDCA after completing community meetings regarding the Comprehensive Plan. I Summary Explanation & Background: I I The Planning and Zoning Board and City Council are about to review the Evaluation and Appraisal Report (EAR). A part of the process is to hold community meetings to discuss relevant issues of the comprehensive plan. The community meetings are to help determine through community input what is working well and what areas that the City can improve. The City of Cape Canaveral will definitely grow, but in order to make it a good growth, we must put bicycle paths, sidewalks, and overpasses on Astronaut Blvd. to provide the type of shopping traffic that would help a mixed-use growth. Maybe some of these expenses could be covered by new developments that like mixed use of their land. RENTALS Affordable housing is a problem for owners as well as renters due to the increases in insurance and taxes - it is something we will have to \^/ork together to resolve. I feel that we must remember the foresight of the people many years ago who created a tax base and growth for our City and not penalize them now with restrictions in rental of their investment properties. Instead, current ordinances must be enforced - maybe hiring more people to enforce these codes and ordinances is the solution. Please introduce an ordinance in the City which provides for a minimum of 30 or 90 day rentals so we preserve the residential character of the City. Please hire professional grant writers to support the City's applications for grants to I I I progressively plan for the City's future. I i PORTER PROPERTY Please try to find a way to purchase the Porter property. I I I Consider buying the land at the Porter I properties for an 'Enchanted Forest' for Cape Canaveral. BOARDWALK It would be great to have a Cape Canaveral boardwalk, area for w;:!lkinP". shopping, .. ~--- ----07 sightseeing, dining and living. H II would love to see a boardwalk. I'm concerned about the density at Cape Caribe. It has a 'timeshare' on C I that consists of condo units owned by its purchasers which is much higher density than nearby townhouses and condos. It also has a timeshare on the beach on residential zoning. It also has a much higher density than the rest of the area around it. Is a timeshare a residence or commercial? It cannot be both, and the impact is population density that exceeds local limits and creates a nuisance for its neighbors. The nuisance includes playing outdoor music late at night during the summer. No other residence or condo owner does this. So, what is Caribe? GENERAL I am more concerned with traffic increase than density issues; however, I would like to see this remain a small town. We need more shops for consumers, not I I I more car rental agencies - boardwalk on I President St. area, bakeries. Please consider administrative rezoning areas of the city which are currently mis-zoned. As an example, areas up and down North Atlantic Ave. (feeder streets) are zoned commercial. I I Almost all of that land is being converted to residential. Unfortunately, changing the uNsafe requires permitting and thousands of dollars in fees in order to get the property to be changed. I A community cultural center with local history exhibits would be a way to preserve our heritage. l'rn not certain about requiring new developments to build amenities. That would depend on what is currently available in the area, bicycle and pedestrian paths are always a plus. Please encourage car businesses to be closer to or in the Port rather than in the City of Cape Canaveral. Please prioritize the businesses we want to attract to the City so we can plan proactively for the City's future. Please provide a modernized government complex for the City. Also encourage new technology to I orocess the waste on board the shiDs so it does I 1---------- not have to be dumped in the ocean at all. Something MUST be done about the garbage that washes up on the coast from gambling ships and I cruise liners. i have spent entire Saturday I I mornings cleaning it up and my impression is that I it mostly comes from gambling ships. I recommend the City work with surrounding communities to assess the impact of proposed development on the density and use of the beaches. Currently, Cape Caribe is proposing more hotels and the Port is proposing another hotel and Conference Center without an assessment of impact on the beaches. Recommend that the State of Florida prohibit the sale of fireworks in the state, so our beaches will be preserved.
