CITY OF CAPE CANAVERAL CITY COUNCIL MEETING • JANUARY 21, 2025 AGENDA ITEM SUMMARY • PRESENTATIONS/INTERVIEWS Subject: Presentation by the National Weather Service Melbourne office to present the City of Cape Canaveral with a StormReady Certification. Department: Community and Economic Development — Resilience Division Summary: The City of Cape Canaveral (City) is a barrier island community located between the Banana River Lagoon and the Atlantic Ocean that is vulnerable to the various impacts of severe weather such as hurricanes and thunderstorms. Impacts associated with these meteorological phenomena can include lightning, heavy rainfall, hail, storm surge, powerful winds, coastal flooding, rip currents, and tornadoes. This 2024 Atlantic hurricane season brought extreme devastation to portions of the United States (US), with a total of 18 named storms forming between June and November according to the National Oceanic and Atmospheric Administration (NOAA). Of these 18 named storms, five made landfall in the US as hurricanes, three striking Florida directly (Debbie, Helene, and Milton). According to AccuWeather, a private meteorological forecasting and reporting firm, the season likely caused upwards of $500 billion in damages and economic losses when accounting for data points such as uninsured losses, job and wage losses, crop losses, infrastructure damage, business and supply chain disruptions, travel delays, airport closures, evacuation and relocation costs, long- term tourism impacts, and emergency management and other government expenses for cleanup and recovery efforts. More than 230 deaths have been directly linked to the 2024 hurricane season. In an effort to continuously improve the City's preparedness and readiness for hazardous weather events, and given the record -setting nature of the 2024 Atlantic hurricane season and its impacts to the community, Staff set about the process of achieving a StormReady Certification. The StormReady Program is a voluntary program facilitated by the National Weather Service (NWS) intended to help communities across the country improve public messaging and safety skills to help save lives and property before, during, and after a storm event. The certification process also serves as an audit of local emergency management procedures to ensure execution of proper preparedness measures. Each StormReady Certification is facilitated by a submitting entity's local NWS office; in the case of the City this is the NWS Melbourne office located at the Melbourne Orlando International Airport. NWS Melbourne is responsible for issuing forecasts, alerts, watches, and warnings across 10 East Central Florida counties (Volusia, Lake, Orange, Seminole, Brevard, Osceola, Indian River, St. Lucie, Martin, and Okeechobee). To officially become a StormReady community, the following criteria must be met: • Establish a 24-hour warning point and emergency operations center — City Staff retains access to 24/7 weather warnings via the AlertBrevard system, NOAA weather radios in all critical facilities, and via social media alerts from NWS Melbourne. City Hall serves as the City's emergency operations center as needed. City Hall is rated to withstand a major hurricane (category 3+), can function off grid via an onsite emergency backup diesel generator, can maintain space -based Internet services via a rooftop Starlink unit, and sits at a high elevation relative to the surrounding area. • Have more than one way to receive severe weather warnings and forecasts and alert the public — Staff shares the aforementioned warnings via local Everbridge notifications (text City of Cape Canaveral City Council Meeting • January 21, 2025 Presentations/Interviews Page 2 of 3 and phone calls), through the City's Weekly Update email listserv, official social media channels, and on City Hall's digital marquee alongside the heavily trafficked State Road A1A. • Create a system that monitors weather conditions locally — In collaboration with Stetson University and Florida Atlantic University, the City maintains eight remote sensor sites that are continuously monitoring local atmospheric conditions as well as water levels within the Banana River Lagoon. Much of the data recorded by these remote sensor sites is publicly accessible via the Internet or is available upon request. To measure water levels in the Atlantic Ocean, the City uses the NOAA operated Trident Pier tide gauge in Port Canaveral. • Promote the importance of public readiness through community seminars — City Staff hosts multiple annual educational outreach events relating to hurricane season preparedness, flood mitigation, and stormwater awareness in conjunction with partners such as NWS Melbourne, Brevard County Emergency Management, universities, and other community entities. • Develop a formal hazardous weather plan, which includes training severe weather spotters and holding emergency exercises — The City utilizes its official "Tropical Cyclone Preparedness and Recovery Plan" each storm season to ensure preparedness activities are conducted in a systematic and efficient manner with specified tasks/assignments for each department. In conjunction with Brevard County Emergency Management, Staff participates in an annual training exercise to simulate a significant hurricane impact at the Brevard County Emergency Operations Center and the City's Emergency Operations Team hosts an internal Staff training session before each hurricane season begins. A StormReady Certification will help the City to maintain and/or improve its ranking within the National Flood Insurance Program's Community Rating System (CRS), which states that any participating community that achieves a StormReady Certification will be awarded additional points. Currently, the City is a Class 8 community, allowing for up to a 10% discount on flood insurance for private property located in floodplains. Staff is undergoing a 5-year recertification process to advance the City to a Class 7 community, which would allow for up to a 15% discount on flood insurance. Signage (Attachment 2) will be placed at City facilities denoting the City's new StormReady Certification. Staff will work to maintain this certification indefinitely as the City continues to strive towards always improving community hazard mitigation and adaptation measures. As of June 20, 2024, there were a total of 3,371 designated StormReady sites that include counties, municipalities, tribal nations, military installations, universities, and commercial properties. Following this certification, Staff will next begin the process of achieving a TsunamiReady Certification from the NWS so as to be better prepared for this hazard should the need arise and to further improve the City's CRS rating. PUBLIC HEARINGS: 6. Ordinance No. 01-2025; amending the City of Cape Canaveral Comprehensive Plan Coastal Management and Future Land Use Elements to address Perils of Flood in accordance with the requirements of 163.3178(2)(F), Florida statutes and other applicable law; providing for the repeal of prior inconsistent ordinances and resolutions, severability, incorporation into the Comprehensive Plan, an effective date and legal status of the plan amendments, first reading: City Attorney Garganese read the title into the record and explained the Item. The City Attorney also explained that another version of the Ordinance's Exhibit "A" was distributed to the City Council that identified the proposed amendments in Word track changes, and that the track changes version will be attached to the Ordinance, and also included the Planning and Zoning Board's recommendations. The Public Hearing was opened. There being no comment, the Public Hearing was closed. Discussion ensued. City Attorney Garganese discussed the proposed Ordinance, and Council's concern regarding potential stormwater impacts to building elevations and new development and adjoining properties, the Council referenced Brevard County Code Sec. 62-3724 of which he read the portion "Development shall not adversely impact the drainage of adjoining properties." Chief Resilience Manager Eichholz indicated both the proposed Ordinance and building elevations ordinance can run concurrent through the process. Council reached consensus to move forward regarding a separate ordinance to control building elevation. A motion was made by Mayor Pro Tem Kellum, seconded by Council Member Jackson, to adopt Ordinance No. 01- 2025, with Exhibit "A" referenced by the City Attorney, at first reading. Capital Projects Director Carlisle provided an update regarding the Hurricane Milton flooding issues at mobile home parks in the City, including an agreement with Career Source which could pay for 95% of the work that is needed to dredge the City's Central Canal. Discussion included deploying City -owned equipment to private property under a declared State of Emergency, City Manager discretion to address an emergency situation, an emergency defined as threat to life or damage to property, and the challenge of prioritization among competing interests for emergency assistance. Brevard County Sheriff's Office Commander Keck discussed enforcement, current City and County penalties and fines, suggested adding non -emergency phone numbers on signage, and escalating maximum fines. Animal Enforcement Officer Christopher Hahn discussed the recent incident of a dog attack on the beach in Cape Canaveral. Discussion ensued. Brad Pervell, resident and property owner, discussed health related concerns related to unleashed dogs, owners' failure to pick up after pets in Sandpiper Park, and desire to increase the fines for citations to a flat $400. City Attorney Garganese advised Council that the City adopted the County Animal Control Ordinance by reference, explained the County's matrix of fines that are graduated depending on violations, and pointed out the City has its own specific provisions with respect to dogs unleashed or on the beach. Council reached consensus for Staff to bring back a new animal control ordinance including new fines which align with the County for Staff to create community outreach messaging with input from the Culture and Leisure Services Board. 10. Update to the January 24, 2024 Special Council Meeting: City Manager Morley discussed the latest changes to the Update. Discussion ensued. Abrasive blast the interior concrete surfaces between termination lines, up to 240 square feet, providing a surface profile equal to an ICRI CSP 5 or greater, as per SSPC-13/NACE 6 standards. f. Pressure wash the interior concrete surfaces between and including termination lines and routed crack, at a minimum 3500 psi to remove dirt, oil, grease, and other contaminants from the substrate. g. Apply Immersion rated bonding primer to the exposed concrete of the routed crack, up to 40 linear feet, to create a bonding surface for final sealant. Evaluate and document any damage to the tanks diaphragm, reinforcing steel, and prestressing wires. Remove scale and rust from exposed metal and apply a corrosion inhibitor, per manufacturer's recommendation. Patch back surfaces with a one component, cementitious, structural repair mortar bringing the patched area flush with adjacent surfaces. The results of the analysis will be reviewed by an engineer and will provide information to develop course of action recommendations for the possible repair and restoration of the tank wall. i. Apply a prime coat of a two -component high solids epoxy primer at 6.0 — 8.0 mils DFT per coat, to the interior wall concrete surfaces between termination lines, up to 240 square feet, per manufacturer recommendations. j. Apply two coats of a two -component, vertical grade, liquid applied, asphalt extended polyurethane waterproofing membrane, at 29.0 — 31.0 mils DFT per coat, to the interior wall concrete surfaces between termination lines, up to 240 square feet, per manufacturer recommendations.) k. Perform a high -voltage spark test to reveal pinholes, voids, or imperfections in the two -component, vertical grade, liquid applied, asphalt extended polyurethane waterproofing membrane and mark their locations. MATERIALS AND SERVICES FURNISHED BY CLIENT OR OTHERS It is understood that the following services shall be provided by others without expense to CCR: a. Client will grant or obtain free and uninterrupted access to the structure for all equipment and personnel necessary for CCR to perform the work set forth in this Proposal. It is imperative that hatch covers are not installed prior to the completion of CCR's scope of work to allow for maximum hatch opening. The Client will notify any and all processors of the project site that the Client has granted CCR free and uninterrupted access to the site. CCR shall be responsible for site cleanup and repair of damages caused by CCR or its subcontractors. b. The Client is responsible for the accuracy of locations for all subterranean structures and utilities. CCR will take responsible precautions to avoid known subterranean structures, and the Client waives any claim against CCR and agrees to defend, indemnify, and hold CCR harmless from any claim or liability for injury or loss, including costs to defend, arising from damage done to subterranean structures and utilities not identified or accurately located. Please be sure that all circuit breakers are ground -fault protected. If it is necessary for CCR to supply its own electric power, add $500.00 per week to the contract amount. Results of this test must be 4A or greater. If the results of this test are less than a 4A, CCR and the Client will have to re-evaluate the proposed scope of work and pricing. I. INSURANCE CCR represents and warrants that it and its agents, staff, and Consultants employed by it is and are protected by worker's compensation insurance and that CCR has such coverage under public liability and property damage insured policies, which CCR deems to be adequate. Certificates for all such policies of insurance shall be provided to the Client upon request in writing. Within the limits and conditions of such insurance, CCR agrees to indemnify and save Client harmless from and against loss, damage, or liability arising from negligent acts by CCR, its agents, staff, and consultants employed by it. CCR shall not be responsible for any loss, damage or liability beyond the amounts, limits, and conditions of such insurance or the limits described in Section 7, whichever is less. The Client agrees to defend, indemnify, and save CCR harmless for loss, damage, or liability arising from acts by Client, Client's agent, staff, and other consultants employed by Client. ASSIGNMENT AND THIRD PARTIES Neither the Client nor CCR may delegate, assign, sublet or transfer their duties or any interest in this Proposal without the written consent of the other party. Both parties agree there are no intended third -party beneficiaries to this Proposal, including other contractors or parties working on the project, or, if necessary, a surety of CCR. 6. LABOR If CCR is required to employ persons of an affiliation desirable to the Client, or other contractor employed by him or the general contractor thereby resulting in increased costs to us, the contract price shall be adjusted accordingly. Such requirement shall not provide that CCR sign a contract with any labor organization. In the event of a labor stoppage, we shall not be in default or be deemed responsible for delay of the progress of this contract or damage to the Client or the contractor so long as CCR has sufficient qualified employees available to perform the scope of work. Our proposal is based on our crew performing our Scope of Work in accordance with our standard safety program. If any additional safety requirements are placed on us (not required by OSHA) such as: site training, additional safety equipment, or permit -required confined space, the cost for such additional requirements plus 30% for overhead shall be reimbursed to us. This proposal is predicated on open -shop labor conditions, using our own personnel. 7. SCHEDULE, COMMENCEMENT, AND DELAYS If the readiness of the project site or conditions do not allow efficient execution of our work on or before the Anticipated Construction Start Date our contract price will increase $200.00 per man hour of crew delay until other productive work can be scheduled for the assigned crew. Schedule changes not caused by CCR, including but not limited to delays to the Anticipated Construction Start Date, additional mobilizations and demobilizations not included in the original price, and other delays that impact CCR and cause actual additional costs shall be equitably compensated via change order procedures for time and price. It is agreed that we shall be permitted to execute our work without interruption. If delayed at any time for a period of 24 hours or more by an act or neglect of the owner, his representative, or other contractor employed by him, or by the general contractor, or by reason of any changes ordered in the work, we shall be reimbursed $200.00/manhour until the crew is able to resume work on the project. Any additional remobilizations will be reimbursed to CCR. In the event an agreement apart from this proposal is preferred, such agreement shall include this Proposal and all the conditions herein unless both parties agree in writing to specifically omit any condition. 8. PAYMENTS Periodic and final payment, including any retention, shall be made within net 30 days of sufficient invoice from the date our work is completed, or the billing is received, or in accordance with applicable state Prompt Payment law, whicheverisearlier, and is to be received by us in our accounting office at 250 SW 36th Terrace, Gainesville, Florida 32607. All costs for third -party contracts and billing management services, or use of any software, as may be required by the Client or Owner, will be added to the Contract Price by change order. Any reasonable legal or other expense necessary for the enforcement of this Proposal orforthe collection of monies due shall be borne by the party atfault. If sales tax is excluded from our price, or on materials contained in our price, in accordance with project specifications, such exclusion is subject to receipt of adequate tax exemption documents from you or the project owner prior to commencement of Work to allow for our application of same. If proper tax exemption documentation is not received or is not adequate to provide exemption, we reserve the right to receive reimbursement of all sales tax CCR is obligated to pay due to the tardiness, lack of, or inadequate exemption documentation on behalf of you or theowner. 9. DISPUTE RESOLUTION In the event of a controversy or claim related to this Proposal, then the Parties will engage in high-level management discussions within five (5) days of written notice to the other Party. If the issues remain unresolved, then the Parties will engage in Mediation per AAA Construction Industry Mediation Rules in the State of the place of the Project, unless an alternative location is agreed upon by the Parties in writing. The mediation shall be convened within thirty (30) days of a Party's mediation request. Each Party shall be responsible for their own attorneys' fees for the mediation; and the mediator costs shall be shared equally by the Parties. If the matter still remains unsettled after submission to mediation, the Parties may engage in litigation in the state or federal court having jurisdiction in the location of the Project, and the laws of State of the Place of the Project shall control jurisdiction, unless otherwise agreed to by the Parties in writing. The Prevailing Party shall be entitled to reasonable attorneys' fees and costs from the Non -Prevailing Party, upon an award of the Court. 10. CHANGES IN SCOPE AND LIMITATIONS If the Client wishes to have CCR perform any additional repairs or remediation of the tank(s)/structure(s) or accessories, it shall authorize such work in writing and pay CCR its standard rates for such work. It is agreed that CCR shall not be responsible for any consequential, special, or delay damages, or any force majeure events, including but not limited to acts of God and pandemic. CCR does not assume responsibility for differing, latent, or concealed conditions which differ materially from those indicated in the Subcontract/Contract documents or from those ordinarily found to exist and not inherent in the Work, including but not limited to weather or subsurface conditions, and not caused by CCR's fault or negligence. 11. TERMINATION This agreement may be terminated by either party upon seven (7) days' written notice in the event of substantial failure by the other party to perform in accordance with the terms hereof. Such termination shall be effective if that substantial failure has been redeemed before the expiration of the period specified in the written notice. In the event of termination, CCR shall be paid for services performed to the termination notice date plus reasonable termination expenses. In the event of termination, or suspension for more than three (3) months prior to completion of all work contemplated by the proposal, CCR may complete such analyses and records as necessary to complete their files and may also complete a report on the services performed to the date of notice of termination or suspension. The expense of termination or suspension shall include all direct costs of CCR in completing such analyses, records, and reports if necessary. 12. WARRANTY CCR will warranty its workmanship and materials on its work covered in this Proposal for a period of one year after completion of its work. Prior to leaving the location, CCR personnel will perform a walk-through with the responsible party overseeing our work for the Client. The warranty will begin on the date of the final walk-through, date of signed certificate of completion, or date of CROM's final invoice, whichever occurs first. In case any defects in CCR's workmanship or materials appear within the one-year period after completion and acceptance of CCR's work, CCR shall promptly make repairs at its own expense upon written notice by the Client that such defects have been found. CCR's warranty is limited to defects in CCR's workmanship and materials, excluding active leak repairs, inspections, cleaning, and disinfection services ("Services"). CCR shall endeavor to perform these Services with that degree of care and skill ordinarily exercised under similar circumstances by contractors practicing in the same discipline at the same time and location. Discussion continued regarding the City's utility franchise agreement with FPL, how much leverage, if any, the City has in regards to FPL's actions, next steps on the Fillmore Avenue project, reversion of stormwater inlet and swale revisions, Allen Engineering to perform a recertification review of the property's stormwater system at the conclusion of the project, an upcoming Staff meeting with representatives from the Fillmore Avenue project, preference to have a member of City Council present at said meeting, costs of contracting an independent engineering firm to review the project, past Council Meeting debates on costs and necessity of engineering reviews and analyses, and preferences to move forward expeditiously. City Manager and City Attorney present any findings and or opportunities in a report to be distributed to the City Council on ways the City can improve our Community Development Department. Mayor Morrison recessed the Meeting at 4:55 p.m.; the Meeting reconvened at 5:07 p.m. Discussion ensued regarding the properties at 116, 118 and 120 Jackson Avenue and included Code Enforcement Staff efforts to populate the BS&A database with complete documentation, focusing on the most recent year and working backwards, upcoming finalization of a Code Enforcement Officer Handbook that will include a flowchart and standardized procedures, public access to BS&A and related training videos, training and certification requirements for Code Enforcement officers, building reports with BS&A and what may or may not be able to be included in such reports. Council reached Consensus to request the following, regarding the properties at 116,118 and 120 Jackson Avenue, as amended from Mayor Morrison's submitted item summary: 1. Provide a Report showing all actions and correspondence related to Code Enforcement at 114, 116, 118 and 120 Jackson Avenue for the period from January 1, 2016 through January 24, 2024. The Report shall include all records available, whether generated by the City's BS&A software system or any other record storage method employed by the City's Code Enforcement Department. 2. Create and distribute Administrative Procedures reviewed and approved by our City Attorney complying with FL State Law and City Code to be followed by our City Code Enforcement Officers. 3. For our City Code Enforcement employees, provide a listing of: a. Required certifications, training and ongoing continuing education, and b. Achieved certifications, training and ongoing continuing education. 4. Distribute a monthly BS&A report of all open Code Enforcement Cases and an annual report of closed Code Enforcement Cases. Include other important data provided by BS&A such as date created, status, and or any other information necessary to monitor. 5. Present any findings and or opportunities to be distributed to the City Council on ways the City can improve our Community Development Department as it relates to Code Enforcement. Mayor Morrison permitted Peg Schaller additional time to speak. Ms. Schaller asked Council to expand its scope of its request for Code Enforcement records back to 2016, detailed an open violation for sewage, alleged months and years of inaction on Code Enforcement complaints, claimed increases in insurance premiums and difficulties with acquiring and maintaining insurance policies for her business as a result of the City's actions and inactions, and questioned whether the City's Code Enforcement officers engaged in practices of retaliation and sexism. City of Cape Canaveral Fund Narrative Period Ended November 30, 2024 Revenue (2nd month of fiscal year = 17%) Ad Valorem Tax To date, the City has received 22.2% of Ad Valorem revenue. The City saw the first Ad Valorem payment in November, and should have the highest income in December. Local Option Gas Tax This amount represents an accrual for October and November. This is above target at 21.5%. Franchise Fees, Utility Service Taxes and Communications Service Tax This amount represents accruals for October and November, and some actuals for November. These are above target at 22.2% Permits and Licenses Permits and Licenses are below target at 6.4%. This will see greatest revenue in August/September when the BTR renewals are mailed out. State Shared Revenues These revenues are above target at 20.2%. This amount represents some actuals for October -November, as well as some accruals. This revenue source includes State Sales Tax, Municipal Gas Tax, Mobile Home Licenses, Alcoholic Beverage Licenses, and Local 1/2 Cent Sales Tax. Garbage and Recycling Revenues This amount represents actual collections for October and November. These are above target at 24.5%. Recreation Fees (Leisure Services) Recreation Fees are below target at 13.8%. Investment Income Investment Income is below target at 10.7%. Department: Community and Economic Development — Resilience Division Summary: The City of Cape Canaveral's six new networked public electric vehicle (EV) charging stations officially went "live" to the public on December 6, 2023. In total, the program offers twelve charging ports (two per station) every day to residents and visitors who either have an EV or a plug- in hybrid electric vehicle (PHEV). Charging station locations include: 1. City of Cape Canaveral Community Center (one station, two plugs) — Current operating hours: 24/7 as of November 19, 2024 2. Cape Canaveral City Hall (three stations, six plugs) — Current operating hours: 24/7 as of August 21, 2024 3. This report details data obtained in Q4 2024 (October 1, 2024 — December 31, 2024), the new program's fourth full quarter of operation. This report also details data obtained during the program's first full calendar year of operation (January 1, 2024 — December 31, 2024). The total upfront project cost of the City's second -generation networked charging stations was $111,912.94. The upfront cost of the City's original first generation non -networked charging stations was $14,892.30.
