CALL TO ORDER ROLL CALL PUBLIC PARTICIPATION Any member of the public may address any items that do not appear on the agenda and any agenda item that is listed on the agenda for final official action by the Community Appearance Board (CAB) excluding public hearing items which are heard at the public hearing portion of the meeting, ministerial items (e.g., approval of agenda, minutes, informational items), and quasi-judicial or emergency items. Citizens will limit their comments to three (3) minutes. The CAB will not take any action under the "Public Participation" section of the agenda. MINUTES CALL TO ORDER: A meeting of the Community Appearance Board took place on January 31, 2024, at City Hall Council Chambers, 100 Polk Avenue, Cape Canaveral, FL. Chairman Wasserman called the meeting to order at 6:00 p.m. The Board Secretary called the roll. ROLL CALL: MEMBERS PRESENT: Randy Wasserman Bob Nienstadt Pamela Paisley Angela Trulock Elana Whitehead OTHERS PRESENT: Kyle Harris Renee Yother Chairperson Vice Chairperson Board Member Board Member Board Member Senior Planner Board Secretary PUBLIC PARTICIPATION: Chairman Wasserman swore in all giving testimony for the item(s) on the Agenda. OLD BUSINESS: None NEW BUSINESS: 1. Approval of Meeting Minutes — January 25, 2023: Board Member Whitehead made the motion to approve the minutes as written, seconded by Vice Chairperson Nienstadt. The motion carried unanimously. 2. Approval of Meeting Minutes — November 1, 2023: Board Member Paisley made the motion to approve the minutes as written, seconded by Chairperson Wasserman. The motion carried unanimously. 3. Per Section 2-171, the Community Appearance board shall elect a Chairperson and Vice - Chairperson, by majority vote, at the first meeting held in January, unless there is no January meeting, then the next meeting held: Motion to re-elect Randy Wasserman as Chairperson made by Board Member Paisley, seconded by Board Member Whitehead. City of Cape Canaveral, FL Community Appearance Board Meeting Minutes - January 31, 2024 Page 2 of 2 4. Review Level II Application for Exterior Painting of Existing Commercial Building — 8660 Astronaut Boulevard (Parcel ID: 24-37-15-00-757) — Arthur Berger, Applicant/ Owner: The presentation showed the existing color scheme and the proposed color scheme for the exterior of the building. As an aside, Mr. Harris informed the Board that the Applicant is installing Tesla Super chargers on the parcel directly behind this building and intends to capitalize on the Mixed -Use Ordinance, specifically the live -work aspect. Discussion ensued regarding the final outcome of the building; additional structural renovations, landscaping and the signage. Chairperson Wasserman made a motion to approve the application, seconded by Board Member Whitehead. The motion carried unanimously. REPORTS AND OPEN DISCUSSION: Mr. Harris informed the Board of a coffee shop chain interested in locating in the City. (1) The plans and specifications of the proposed project indicate that the setting, landscaping, ground cover, proportions, materials, colors, texture, scale, unity, balance, rhythm, contrast and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. (2) The plans for the proposed building or structure are in harmony with any future development which has been formally approved by the city within the surrounding area. (3) The plans for the proposed building or structure are not excessively similar or dissimilar to any other building or structure which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within 500 feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: a. Front or side elevations; b. Size and arrangement of elevation facing the street, including reverse arrangement; or c. Other significant features of design such as, but not limited to: materials, roof line and height or design elements. (4) The plans for the proposed building or structure are in harmony with the established character of other buildings or structures in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. (5) The proposed development of the building or structure is consistent and compatible with the intent and purpose of this article, the Comprehensive Plan for Cape Canaveral, and other applicable federal, state or local laws. (6) Within the C-1, C-2, and M-1 zoning districts, any exterior building or roof color used shall be well designed and integrated with the architectural style of the building and surrounding landscaping in order to create a subtle and harmonious effect and promote aesthetic uniformity within the district. Bright or brilliant colors shall not be permitted except for use as an accent color within the C-1, C-2, or M-1 zoning districts. The property is unique in that it is located within City proper but accessed through George King Boulevard in Port Canaveral. While the site is currently vacant, the Comprehensive Plan designates City of Cape Canaveral CAB Regular Meeting • November 20, 2024 Agenda Item # 1 Page 2 of 2 the property's future land use as commercial, supporting the proposed hotel use and its accessory uses (restaurant and pool). The site is adjacent to vacant land and surface parking serving the Port in both the City of Cape Canaveral and Port Canaveral. The Cape Canaveral Volunteer Fire Department is the closest building to the project. At six stories in height, the product will be visible from A1A. The development will provide the second closest hotel views of the port and space operations, behind the Holiday Inn properties. This project will be a catalyst for economic development benefits to the City and the Cape Canaveral Community Redevelopment Agency. The developer intends to install 111 trees onsite, 89 of which have multiple trunks, and 43 of which are non-native (Crape Myrtle trees). The remaining xxx of the lot includes 15 different types of shrub, groundcover, grass, and sod. The facade features a heavily articulated design as encouraged by the A1A Economic Opportunity Overlay District ("EOOD") regulations applicable to the subject site (Article X of Chapter 110 of the CCCO). Should the Community Appearance Board approve the application, the Planning and Zoning Board would then review the Site Plan Application for conformance with the corresponding set of required findings and make a recommendation to Staff. Subsequently, the applicant will apply for Building Permit for complete review and approval by all Departments prior to construction. Reviewing staff must find compliance with the EOOD regulations prior to building permit issuance. City of Cape Canaveral CAB Regular Meeting • November 20, 2024 Agenda Item # 2 Page 2 of 2 Two-story residential developments exist in all four directions from the subject site, where the applicant intends to construct only single -story residences. Building up instead of out would result in a more harmonious development pattern, reduce stormwater impacts, and improve Comprehensive Plan consistency. The building covers 34.6% of the site, within the 35% allowed by CCCO, and the total impervious surface coverage is 48% of the lot. The applicant proposes to plant 44 palm and buttonwood trees in addition to shrubbery and sod. The project only installs sidewalk along Buchanan Avenue, interfacing with the five driveways. The Comprehensive Plan supports pedestrian infrastructure along both frontages. The elevations indicate a beige facade, brown roofing and single -car garage doors, and two clerestory windows per dwelling unit. Should the Community Appearance Board approve the application, the Planning and Zoning Board would then review the Site Plan Application for conformance with the corresponding set of required findings and make a recommendation to Staff. Subsequently, the applicant will apply for Building Permit for complete review and approval by all Departments prior to construction. General: S-01 Survey (Prepared by Others): 1. Per Sec. 110-222.2.h: Identify location and type of existing trees four inches in diameter or larger. Reply: Per Mr. Art Berger phone conversation with Mr. Smith and city Arborist, the existing vegetations are mainly Brazilian pepper that are in process of being removed. The existing pepper trees have strangled existing trees and they are not able to be saved. The proposed landscaping will replace any of the existing tress that do not appear to be worth saving. C-100 SWPP/Demo Plan: 1. Update the general statement to reflect the proposed conditions. Reply: General statement on sheet C100 has been revised. 2. Show proposed mitigation efforts for trees that are to be removed. Reply: Based on phone conversation between Mr. Berger, Mr. Smith and city Arborist, the vegetated part of the site that might require mitigation, is covered with Pepper trees that have strangled existing trees and are currently being removed. Proposed landscaping far exceeds the minimum required and will replace & cover any mitigation required for removing existing trees. C-200 Site Plan: 1. Update the general statement to reflect the proposed conditions. Reply: general statement has been revised to note 5-unit apartment 2. Update the zoning and adjacent zoning information with current zoning. Reply: Per current zoning map Kyle Smith, the zoning for the project & the adjacent zoning is R-2 3. Provide additional detail on soil stabilization. Reply: Soil stabilization for the area in question has been specified on revised drawings. Please see Page 1 of 5 Orange -Buchanan Apartments Reply to City Review Comments Dated: June 11, 2024 CIVIL & STRUCTURAL ENGINEERING INSPECTIONS SI - 0829 EB - 0007218 Di/ / ADS OOC ATES INC. revised sheet C-300 for the. 4. Maintain power pole separation to the driveways per FDOT clear distance requirements. Reply: The existing power meets the FDOT minimum distance. In addition, a bollard is proposed to be installed to prevent accidental damage to the existing power pole. C-300 Drainage Plan: 1. Verify sidewalk grading of eastern apartment building. Reply: Sidewalk grading of Easter apartment is similar to other four units and we cannot see any issues with grading to address. If grading is of the concern, please be more specific of the area you are referring to. 2. Verify grading near garage and building entrances as there appears to be low points that may cause ponding. Reply: We could not locate a low point near the garage & main entrance to address. The area in question has roof covering and it appears adequate slope has been provided to avoid any possible ponding. 3. Verify grading at the driveway aprons as there appears to be a ±15% slope. Reply: Per FDOT index 522-003, page 3 of 4, flared driveway such as proposed, can have slope up to 14.2%, see attached. At proposed driveways, only East drive has slope of 12.6% (7.4 -6.4/7.15) with remaining have less slope than which are below FDOT allowed slope for the type of the driveway proposed. C-400 Utility Plan: 1. The provided GIS map from the City of Cocoa does not show a 6" water main along Orange Ave. The GIS map shows a 4" water main along Buchanan. If a 4" water main is not sufficient, the necessary infrastructure improvements to support the development must be shown. Reply: The 4" water main is sufficient to serve the project. Permit for the water serving the project has been reviewed and approved by city of Cocoa Utilities and their requirements will be followed. 2. Update plans to show that the water main along Buchanan Avenue is a 4" water main rather than 6" water main. Reply: The existing water main along Buchanan is 6" and reduces to 4". 3. Provide roadway open cut detail and replacement curb detail.4. Update project description in fire flow calculations. Reply: No roadway open cut is required or proposed at this time. The required directional bore for water main construction is shown per city of Cocoa Utilities & Brevard County. If open cut is determined to be required due to sewer lateral not being as shown on city as built drawings, plans will be revised, and submitted to city of Cape Canaveral along with the required details for review and approval prior to construction. Note has been added to sheet C400 regarding the revised drawing requirement. 4. Confirm whether reclaim water will be utilized for irrigation on this site. If so, call out the connection point, show the tapping location, meter and reclaimed water sign location. Reply: The project will be served with re -use line and meter location is shown on landscape drawings and on sheet C400. Confirm that the areas shown in Table 1 site which contributes to the ROW or Tailwater node are accurate. Reply: Please see attached revised drainage report. The area shown on table 1 is based on the topo survey of the project site provided by project surveyor. 6. Update Table 1 to utilize the correct runoff curve numbers and verify the weighted CN number calculation. Reply: The project site is currently vacant and contains open area on majority of the site with some trees that are not salvageable. The site is currently developed on on all Four (4) sides. Based on the soil classification, soil type onsite is a type "B" soil. Based on TR-55, the site could be best classified as pasture grassland with fair condition, therefore, curve number of 69 for type "B" soil is used for fair condition. 7. Show where the length and slope values from Table 2 are coming from. Update as necessary. Reply: The length & slope used for calculating time of concentration is based on the topo info provided by the project surveyor. Please see attached drainage report. 8. Update Table 3 to be consistent with this project's information. Reply: Table 3 has been updated to be consistent with project info. 9. The post conditions CN values should be utilizing the CN values for a 1/8 acre residential classification as found in TR-55 Table 2-2A. Update the CN values and the weighted CN value. Reply: The curve number noted for 1/8 acre residential is used for designing a 1/8 acres residential subdivision which the actual impervious is not known at time of the design and a 68% impervious is assumed. The impervious area for the site is known and is below 50%, therefor the actual impervious & pervious areas are used to determine the curve number instead of using a value given when the actual impervious area is not known. Please see attached revised drainage report. 10. Table 5 minimum treatment depth appears to be measured in feet rather than inches. Verify and update. Reply: Minimum treatment depth has always shown as inch over the site or as ac-ft for the required volume. 11. Table 5 treatment volume does not match the stage storage volumes as shown in Table 6. Reply: Treatment volume shown on table 5 is same as what is used for stage storage volume. See attached drainage calculation. Verify the correct CN value is being used in the BMP Trains Pre -Condition and Post- Condition. Reply: Curve numbers used in the BMP Train program for pre -condition is the same as what is used in the drainage calculation and is CN = 69. 13. Verify what areas are being counted as DCIA in the post -condition to get to 25%. Reply: The DCIA area noted is for the building roof area that has mono slope and drains to the rear and is 29%. However, the DCIA values are not used in BMP or drainage program to be concern about. 14. Update the post -condition landuse to Multi -Family as it is more representative than Low- Density Residential. Reply: Multifamily land use designation is used for the BMP program as commented. However, you cannot have different classification for different parts of the drainage analysis for the same project. If we are to use 1/8 acre single family for post condition analysis, it cannot be multifamily for the BMP part. It needs to be one or the other. 15. The BMP Trains model does not appear to be utilizing any treatment methods. Please verify and update. Reply: The BMP analysis is based on net improvement which for post condition runoff to meet the pre -condition. Please see attached drainage calculation. 16. The BMP Trains report states that the nitrogen and phosphorus removal targets are not met. Revise the design to provide adequate treatment for the proposed development. Reply: Per our comment on the previous project you reviewed, there is a glitch on the BMP printout when you use print all option it does not show the post condition removal percentage. However, if you review the print out, you will notice that the post treated runoff values are lower than the pre- condition which indicates compliance. Please see attached revised drainage report that printed the input and the BMP results separately which demonstrates compliance with nutrient removal requirement. Please note, Cape Canaveral does not have an ordinance requiring meeting nutrient removal but they require meeting pre -post for 25 year storm & if we are to follow SJRWMD, they require nutrient removal but do not require meeting pre, post for 25 year storm.
