Motion carried 5-0. PUBLIC PARTICIPATION: Bob Levine, 111 Lincoln Avenue, discussed noise and other disruptive activities involving the vacation rental next door to his townhome, explained that he would have called the police but has to share construction work with that neighbor, and inquired what the Council will be doing about vacation rentals in the City. Mayor Morrison indicated he would follow up with the City Manager. John Benton, visitor, discussed a Code reduction hearing. City of Cape Canaveral, Florida City Council Regular Meeting • June 18, 2024 Minutes • Page 2 of 4 Peg Schaller, resident, property and business owner, requested the City Council keep the City's Organizational Values in mind to resolve the issues related to Agenda Item #10 Update to the January 24, 2024 Special Council Meeting. CONSENT AGENDA: 1. Approve Minutes for the May 7, 2024 Special Meeting. 2. Approve Minutes for the May 21, 2024 Regular Meeting. 3. Approve Minutes for the May 23, 2024 Workshop Meeting. 4. Approve the purchase of one (1) Sandbagger Model II unit in the amount of $23,204 and authorize the City Manager to execute the same. A motion was made by Council Member Willis, seconded by Council Member Davis, to approve the Consent Agenda. The motion carried 5-0. ITEMS FOR ACTION: 5. Approve quote from Razorback LLC in the amount of $148,000 for the Effluent Transfer Pump Station Structural Rehabilitation and authorize the City Manager to execute the same: City Manager Morley explained the Item. Lamar Russell, resident, discussed flooding concerns in the area of Harbor Heights, and inquired about lift stations, stormwater pump stations and back- up power. Capital Projects Director Carlisle explained the City only has one stormwater pump which is being installed at Center Street, and the difference between sanitary sewer lift stations and stormwater pumps. Discussion ensued. A motion was made by Council Member Davis, seconded by Council Member Jackson, to approve the quote from Razorback LLC in the amount of $148,000. The motion carried 5-0. 6. Resolution No. 2024-02; amending the Defined Contribution Retirement Plan for the general employees of the City of Cape Canaveral, Florida; providing for the repeal of prior inconsistent resolutions, severability and an effective date: City Manager Morley explained the Item. Discussion ensued. Council reached consensus to bring back data from more cities, and for Administrative/Financial Services Director DeLeo to provide information regarding the Florida Retirement System (FRS). No action was taken. 7. Designate one (1) City Official to be the Voting Delegate at the Florida League of Cities 2024 Annual Conference scheduled for August 15-17, 2024 in Hollywood, Florida: City Manager Morley explained the Item. Council Member Willis nominated Council Member Davis to be the Voting Delegate. Discussion ensued. A motion was made by Council Member Willis, seconded by Council Member Jackson, to designate Council Member Davis as the City Voting Delegate at the Florida League of Cities 2024 Annual Conference. The motion carried 5-0. ITEMS FOR DISCUSSION: 8. Building Code and Flooding (Submitted by Council Member Jackson): Council Member Jackson explained the Item. Discussion ensued. C+ED City Planner Harris discussed efforts regarding the drafting of impervious surface codes and ratios, the City Council and Planning and Zoning Board Joint Educational Workshop Meeting with the East Central Florida Regional Planning Council held on March 27, 2024, and the City's Comprehensive Plan and land development amendments. Discussion ensued. C+ED Director Dickey discussed the estimated six to nine month process of City of Cape Canaveral, Florida City Council Regular Meeting • June 18, 2024 Minutes • Page 3 of 4 getting policy statements and the Comprehensive Plan updated/implemented, and possible interim flood control measures to present to the Council working with the City Attorney. Lamar Russell, Planning and Zoning Board Chair, discussed implementing pervious concrete requirements. City Attorney Garganese discussed lot coverage areas in R-1 Zoning. No action was taken. 9. Discussion on the role of Mayor Emeritus (Submitted by Council Member Kellum): Council Member Kellum explained the Item. Mayor Emeritus Randels discussed working with residents in need of affordable housing, willingness to provide a report to the Council, and desire to donate statutory pension money towards a property improvement fund for those who really need it. City Manager Morley confirmed he, the Mayor and Mr. Randels discussed a Rocky Randels Fix -Up Fund Program. Discussion ensued. City Manager Morley discussed he will work with Staff and City Attorney Garganese regarding Mr. Randels retirement fund idea. Mayor Morrison recessed the meeting at 7:35 p.m. The meeting reconvened at 7:53 p.m. 10. Update to the January 24, 2024 Special Council Meeting: City Manager Morley explained the Item. Discussion ensued. City Manager Morley requested clarification on consensus regarding if Council wants to have a meeting in July, what preparation could he do for that meeting, and provided an estimation of how long it would take to resolve issues based upon the presented recommendations for Fillmore and Jackson Avenues. Discussion ensued. City Manager Morley discussed that the Fillmore fieldwork completion time cannot be determined at this date. Council reached Consensus to schedule a Special Meeting on July 10 or 11, 2024. A motion was made by Mayor Pro Tem Kellum, seconded by Council Member Jackson, to extend the meeting. The motion carried 4-1, with Council Member Willis voting against. REPORTS: Council Member Davis discussed the Federal Court preliminary injunction, and Florida Commission on Ethics Financial Disclosure 2023 Form 1 is due July 1, 2024. Council Member Willis discussed the 2023 Form 1 due date was extended to July 15, 2024, attendance at the Central Florida Safety Strategic Planning Meeting as a panelist for the Florida Department of Transportation (FDOT) where he discovered the City of Cape Canaveral takes safety far more serious than other communities based on its accomplishments, attendance at Disaster 101 for Senior Officials for which he distributed handouts to the Council, and announced his graduation from the Florida League of Cities Advocacy Course. Council Member Jackson discussed attendance/completion of the Florida League of Cities Institute for Elected Officials (IEMO) I, attendance at Florida Training for Emergency Management (FTEM) Conference, and will share materials with Council and Staff. Mayor Pro Tem Kellum discussed attending a Cape View Elementary School community outreach event at the Cape Canaveral Community Center, the loss of Title I Funding, and the need for affordable housing to keep the School open, and announced the VFW Post 10131 is planning a Christmas -in -July Benefit for Cape View Elementary. City Manager Morley noted the Coffee with the City Manager on Friday, June 21, 2024 at 10:00 a.m. at Manatee Sanctuary Park. City of Cape Canaveral, Florida City Council Regular Meeting • June 18, 2024 Minutes • Page 4 of 4 Mayor Morrison apologized for not attending the 2024 Cocoa Beach Jr./Sr. High School Graduation on Tuesday, May 21, 2024 due to a City Council Meeting that same night, expressed congratulations to the graduates, and thanked Staff for preparation and release of the 2023 State of the City, available on the City website.
