PUBLIC PARTICIPATION: Peg Schaller, business owner of Ellie Mae's Tiki Bar, discussed appreciation for City Manager Morley's working to resolve issues previously brought to the City's attention. City of Cape Canaveral, Florida City Council Special Meeting • April 22, 2024 Minutes • Page 2 of 3 ITEM FOR DISCUSSION: Review of Community and Economic Development Department roles, responsibilities and discuss actions proposed to resolve current issues for properties located on Fillmore Avenue and Jackson Avenue. UPDATE: Mayor Morrison distributed copies of the original January 24, 2024 Special Meeting update* from the City Council Regular Meeting of March 19, 2024. City Manager Morley thanked Ms. Schaller, and informed Council that Ms. Schaller provided additional information to him, which will be researched and reviewed with Staff. City Manager Morley requested to meet with City Council on May 7, 2024 to present a detailed report of findings on the issues at Fillmore Avenue and Jackson Avenue. A motion made by Council Member Willis, seconded by Council Member Davis, to schedule a meeting for May 7, 2024, starting at 4:30 p.m. The motion carried 5-0. Staff presented the Building Inspection Report listing the individual Fillmore properties referenced in Attachment 2 generated from BS&A. Discussion ensued and included the following items: 1: A written statement from the Building Official with updates will not be available until the project is complete, and if any additional clarification is needed it will be provided in the forthcoming Findings Report. 2: A tracking spreadsheet of all tasks related to Fillmore Avenue has been created and is public record, and an executive summary will be distributed to Council when finalized. RES Manager Miller introduced Kiel Causby, P.E. and Tucker Hunter both with Kimley-Horn and Associates, and distributed a memo* of the engineering report created by Kimley-Horn to Council. Mr. Causby shared a brief project overview presentation of The Villas at Fillmore Avenue. 3: Florida Power & Light (FPL) has complied with removal of all overhead lines and installation of underground lines consistent with the current City Code. City Manager Morley directed Staff to place caution tape and cones around the debris. City Attorney Garganese suggested that if the property owner disapproves, they can have it removed. City Manager Morley instructed Staff to have FPL confirm line locations and burial depth, and assured Council that follow-up will be added to the task list. 4: City Manager Morley confirmed for Council that these items will be in the Findings Report which will be discussed at the May 7, 2024 meeting. 5: City Manager Morley informed Council that these Code revisions and department updates will be presented at a later date as more work needs to be done. Mayor Morrison recessed the meeting at 2:15 p.m. The meeting reconvened at 2:33 p.m. Discussion ensued regarding Code Enforcement issues involving 114, 116,118, and 120 Jackson Avenue: 1: A report showing all actions and correspondence related to Code Enforcement at 114, 116, 118, and 120 Jackson Avenue for the period of January 1, 2016 to January 24, 2024, which shall include all records available, public records requests, watermarks on all record drafts, functionality and reports of BS&A Software (BS&A) . City Manager Morley assured Council a more acceptable report will be provided. City Manager requested a copy of the flowchart be emailed to him and the Council. City Attorney Garganese discussed the revision of the City Code in 2019 to remove inconsistencies with State law, and due to these revisions already implemented in the Code for administrative procedures, indicated no reason for further revisions be made at this time. 3: Code Enforcement requirements to maintain Code Enforcement Officer credentials, contracting third -party help to provide objective recommendations for improvements, and recommendation to display Code Enforcement credentials on the City website. 4: A BS&A report of the City's current open cases for distribution to Council, Staff's request for adequate time to generate the report and review by City Manager prior to distribution, the City's previous financial software and data from Springbrook uploaded into BS&A, efforts to remedy the data transition gap, and confirmation from City Manager Morley for the electronic distribution to Council. 5: City Manager Morley will produce a conclusions and recommendations report subsequent to the Findings Report, projecting a June time -frame of availability, and how the improvements will allow more acceptable response times to provide information and services to citizens. City Manager Morley, thanked the Council, Peg Schaller, the Fillmore townhome owners, and Staff. Administrative/Financial Services Director, John DeLeo, thanked Executive Assistant to the City Manager/Office Manager Day for working overtime in preparation for the meeting. A new as -built is recommended once the stormwater management system has been reconstructed. Adequate detail should be provided on the new as -built to ensure consistency with the approved plans. Any future modifications to the retention area should be reviewed by the City to ensure the peak discharges rates and runoff volume are not further exceeded and the required treatment volume is provided. Existing Inlet Remediation Options: Install the Type C structure and modify the existing structure per the approved plans. Regrade the driveways of Lot 1 & 2 and raise the existing inlet while maintaining positive slope into the inlet. Kimley-Horn and Associates SUBJECT: Villas at Fillmore — Stormwater Memorandum Parcel Numbers: 24-37-23-67-*-1 24-37-23-67-*-2 24-37-23-67-*-3 24-37-23-67-*-4 BACKGROUND: The City of Cape Canaveral ("City") has been notified of potential drainage infrastructure and site work not constructed per the approved plans prepared by Allen Engineering, Inc. ("Allen Engineering") dated September 24, 2020, for a residential site off Fillmore Avenue known as the Villas at Fillmore. The site consists of two (2) duplex buildings totaling four (4) dwelling units. In 2022, Certificate of Occupancy were issued for the residential units. Currently, Florida, Power, & Light Company ("FPL") is removing an overhead power pole located in the rear of the site which has disrupted a portion of the constructed retention area. Based on conversations with the City, once FPL is finished the retention area will be restored to the approved design conditions. The City has requested Kimley-Horn to perform a site visit to observe the constructed drainage system and review project documents uploaded to the City. Kimley-Horn will compare the site observations and as-builts to the original approved plans and evaluate the site and plans based on current City code standards. A copy of the approved plans and as-builts are included in Appendix A and Appendix B respectively. The approved plans prepared by Allen Engineering, dated September 24, 2020, specified the following drainage infrastructure improvements listed below. • A dry retention pond wraps around the sides and rear of the duplex buildings. • Finish floor elevations are at elevation 10.10. • A 24-inch outfall structure located in the retention area between lots 2&3 with a rim elevation of 9.25. • A 12-inch HDPE pipe that conveys the stormwater from the outfall structure to a proposed Type C structure. • A Type C structure located between the Lot 2 and 3 in the green area between the driveways. This structure shows a proposed rim elevation of 6.65. • An 18-inch HDPE pipe that conveys water from the proposed Type C structure to the existing drainage structure located within the Lot 2 driveway. • An existing drainage structure that was proposed to be raised such that it would be flush with the proposed paver driveway. The existing grate was to be replaced with a solid cover. Kimley-horn.com 7341 Office Park Place, Suite 102, Melbourne, FL 32940 321-430-1138 Attachment to the April 22, 2024 City Council Special Meeting Minutes Page 2 FINDINGS: Site Visit and Document Review: Kimley-Horn conducted a site visit on February 26, 2024 to observe the drainage system of the site and reviewed the as -built signed by Allen Engineering dated 07/08/22. Site photos from the field visit are included in Appendix C. The following deviations from the approved plans are noted below: • The constructed retention area does not match the cross -sections outlined on the approved plans. o As-builts callout the bottom of the retention area at elevation 9 instead of 8 per the approved plans. o Field measurements show that the retention area width varies from 6-4 feet and does not match the approved plans. o Field observations show the side slopes vary through the retention area and the slopes appear steeper than 4:1. • A 12-inch outfall structure was installed instead of the 24-inch outfall structure. Based on the as -built, the rim of the outfall structure was installed at elevation 9.12 instead of 9.25 per the approved plans. • The as -built does not provide the size of the pipe installed, but a field measurement shows that a 12-inch pipe was installed, which is consistent with the approved plans. See Photo 4 in Appendix C. • The proposed Type C structure was not installed. Based on the site visit, a water main and gas line was flagged where the proposed structure would have been installed. Instead, the constructed drainage system ties into the existing drainage inlet located at the edge of the driveway. The existing drainage inlet was not raised per the approved plans. See Photo 2 in Appendix C. • An additional yard drain was installed in the front yard which was not shown in the approved plans. The yard drain appears to have been added to connect the outfall pipe to the existing drainage inlet located at the driveway. • Based on the as-builts the lowest finish floor elevation is 9.94. which is 2 inches lower than the approved plans. Water Quality: Per City Code: • Sec. 90-149.1.b - Retention volume shall be provided equal to 50 percent of the amounts stated in subsection (1)a. of this section, computed for wet detention or runoff from the first inch of rainfall, whichever is greater. The storage must be recovered within 72 hours following rainfall. • Sec. 90-149.1.a - Wet detention treatment volume shall be the first inch of runoff from the developed project and offsite areas draining into the treatment facility or the total runoff of 2.5 inches times the percentage of imperviousness, whichever is greater. Based on the Stormwater Computations prepared by Allen Engineering dated September 2020, the site is required to treat 894 cubic feet of stormwater runoff. The retention area was designed to provide 1,243 cubic feet of treatment and recovers the treatment volume in 11 hours. Based on the review of the as-builts and field observations, the following was noted: • The retention area width appeared to be narrower than the width shown on cross -sections per the design plan. • Bottom of retention is at elevation 9 opposed to being at elevation 8 per the design plans. • The rim of the outfall structure is set at elevation 9.12 compared to 9.25 per the design plans. Per field observations, the constructed retention area appears narrower and swallower than the retention area in the approved plans. Also, the outfall rim was set at a lower elevation. As a result, based on these observations the retention area provides 18 cubic feet of treatment which is only 2% of the required treatment volume. It is be noted that the calculated treatment volume is a rough approximation based on the field observations and the limited information provided on the as-builts. To accurately calculate the provided treatment volume, a formal survey would need to be completed. A copy of the Stormwater Treatment Calculations based on the as-builts and field observations are included in Appendix E. Water Quantity: Per City Code: • Sec. 90-148.1.a - The post -development peak rates of discharge must not exceed the pre - development rate for the 25-year, 24-hour and the five-year, 24-hour storms. • Sec. 90-148.2 - The post -development volume of direct runoff must not exceed the pre - development level for a 25-year, 24-hour storm event. Although the requirements aren't met, the Stormwater Computations state "Stormwater Management has been utilized to the greatest extent possible given the circumstances of the small site. It is believed that the increase in the peak discharge rate and total runoff is negligible." A memorandum dated December 2, 2020, prepared by the City Engineer at the time recommended approval of the design plans to the City. Therefore, the City approved the plans allowing with the increased discharges rates and runoff. A copy of the memorandum is included in Appendix F. Based on conversations with the City and residents, the site has no history of flooding and the soils in this area are known to have good percolation rates. The residents voiced their concerns that during heavy storm events the water overtops the 12-inch outfall structure and continues to sheet flow to the front yard and ultimately drains into the existing inlet at the edge of the driveway. The overtopping could be caused by the limited storage volume within the constructed retention area. The overtopping could also be caused by the reduced inlet capacity of the smaller outfall structure. The approved plans specified a 24-inch outfall structure. Additional City Code Stormwater Requirements: Per City Code: • Sec. 90-172 — Both dry and wet detention/retention areas may be used in the design of the City's stormwater management systems. The perimeter banks of either system shall have a slope no greater than 4:1; unless otherwise approved by the city engineer. • Sec. 98-111.e.3 - The minimum size of storm sewers or culverts shall be 15 inches. Equivalent elliptical pipe sizes may be substituted based on the approval of the city engineer. The side slopes of the retention area are not called out on the as -built but based on field observations, the side slopes vary throughout the site and appear to be steeper than 4:1. Also, the outfall pipe is a 12-inch which is consistent with the approved plans but per City code, Sec. 98-111.e.3, the minimum storm sewer size is a 15-inch. Although the retention area per the approved plans, does not meet the City's water quantity requirements, Allen Engineering stated the increased peak discharge rates and runoff are negligible and, the City approved the design plans based on recommendation of the City Engineer at the time. Therefore, it is recommended once FPL completes their work that the retention area is reconstructed to be consistent with the approved plans prepared by Allen Engineering. • A resident noted that during heavy storms, the water overtops the existing 12-inch outfall structure and sheet flows through the front yard. The 12-inch outfall structure should be replaced with a 24-inch outfall structure per the approved plans. Also, once the retention area is reconstructed, it will provide more storage and reduce the amount of water overtopping the structure. • The rim of the outfall structure should be raised from 9.12 to 9.25 to provide adequate water quality treatment per the approved plans. • A new as -built is recommended once the retention area has been reconstructed to confirm its consistent with the approved plans. Adequate detail will need to be provided on the new as - built to ensure consistency with the approved plans. • Any future modifications to the retention area should be reviewed by the City to ensure the peak discharges rates and runoff volume are not further exceeded and the required treatment volume is provided. • Existing Inlet Remediation Options: 1. Regrade the driveway of Lots 1 & 2 and raise the existing inlet while maintaining positive slope into the inlet. Ensure the sidewalk meets ADA requirements. Based on the as-builts, it appears the inlet can be raised slightly to create a smoother slope transition. A survey is recommended prior to performing any work. 2. Install the proposed Type C structure and modify the existing structure per the approved plans. Based on field observations, a potential gas main was identified in the area that may require relocation. A survey is recommended prior to performing any work.
